The Global Refugee Crisis: What Can We Do?

On Monday, March 4, the Institute for Human Rights co-sponsored an event with local education, faith-based, and policy organizations at Samford University, titled Addressing the Global Refugee Crisis – Part: What Can We Do? The panel discussion, moderated by Rachel Hagues (Assistant Professor at Samford University – Department of Social Work), included Carlos Aleman (Deputy Director at Hispanic Interest Coalition of Alabama), Mary Baxter (Resettlement Specialist at World Relief Atlanta), Cesar Mata (Organizing Fellow at Adelante Alabama Worker Center), Sarai Portillo (Executive Director at Alabama Coalition for Immigrant Justice), Leida Venegas (Refugee/Birmingham Resident from Colombia), and Lynda Wilson (Chair at Refugee Interest Group), where they addressed their organizations’ roles in the current refugee crisis and how local community members can get involved.

Baxter first addressed the audience by speaking about World Relief’s origin which stemmed from a faith-based relief effort that addressed the devastation in Europe after WW2. The organization began addressing refugee resettlement in 1979 and, today, are only one of nine organizations in the country that has a contract with the U.S. State Department to help resettle refugees. World Relief does case management work that covers child development, agriculture, and nutrition as well as teaches participants about navigating housing, U.S. laws, and obtaining proper documentation.  World Relief also offers legal services and English tutoring to make resettled refugees are on a supportive, sustainable path in the U.S. Finally, World Relief has a church mobilization program which helps amplify their faith-based humanitarian efforts.

Aleman informed the audience that Hispanic Interest Coalition of Alabama (HICA) is currently observing its 20th anniversary as an organization, but there is much needed work still to be done. Although 70% of HICA’s participants are of Mexican heritage, they are here to help any and every one that is in-need of assistance.  He argued that “refugee” is a political title because Cubans entering the U.S. during the Cold War were afforded this title. However, Central Americans fleeing to the U.S. currently don’t have that same benefit because the political environment has cultivated anti-immigrant rhetoric about those trying to cross the Mexico-U.S. border. HICA offers a Justice and Leadership Program that helps people achieve immigrant status as well as a Family Program that is case management-centered, the latter assisting children enroll for school and people navigating the court system.

Portillo also mentioned our current political environment by mentioning that refugees have been scapegoated for electoral purposes but that the Alabama Coalition for Immigrant Justice (ACIJ) will not be discouraged. ACIJ is a coalition of six non-profit organizations and hundreds of individual members throughout the state of Alabama. More specifically, ACIJ does preventative work, such as family emergency plans, that prepare people for economic, social, and/or legal challenges that relate to their immigrant status. You can help advance ACIJ’s mission of grassroots immigrant justice by volunteering or donating to their organization.

Aleman of Adelante mentioned how there are many problems facing their participant community and that the existence of immigrant detention centers, much like Etowah in Gadsden, is an issue that is not exclusive to this current presidential administration. As a result, Adelante has helped organize the #SHUTDOWNETOWAH campaign which is “committed to ending the human rights abuses at the Etowah County Detention Center” due the facility’s notorious mistreatment of detainees, including inadequate medical care, poor nutrition, and verbal abuse. Adelante also offers many volunteer opportunities, including the Accompaniment Program, which assists members with transportation to court hearings and probation appointments, a worker’s assembly called Asamblea!, and a Pen Pal Program.

Wilson briefly spoke about the Unitarian Universalist Church of Birmingham’s Refugee Interest Group whose three pillars are direct support, education, and advocacy as well as the remarkable journey of an asylum-seeking mother and her two children who fled Angola to Cuba, relocated to Ecuador, then walked a grueling 1800 miles to El Paso. Following, she introduced Leida Venegas, a refugee from Colombia and current Birmingham resident, who shared the story about leaving her country because of organized crime and governmental conflict. Venegas also fled to Ecuador where she corresponded with the United Nations and U.S. government for over a year then moved to Birmingham. With only three suitcases and her children, Venegas relied on her case worker from Catholic Social Services and church volunteers who have assisted her with housing, learning English, and transportation to obtain documentation. She insisted such volunteering has been vital and is very thankful to all of those who’ve committed their time and opened the door to their home.

As demonstrated, the current refugee crisis is not only in the hands of the U.S. government but to anyone who wants to get involved. Many organizations addressing this pressing issue have limited resources so lending a helping hand could change or possibly save a life. What can you do to address the current refugee crisis?

International Women’s Day: Continuing the Fight while Celebrating the Victories

Today is International Women’s Day. This year’s theme is “Think Equal, Build Smart, Innovate for Change.” In her context statement about the theme, UN Women Executive Director Phumzile Mlambo-Ngcuka states that the changing world continues to shape the lives of people and “we have to be intentional about its use to positively impact the lives of women and girls. [The theme] puts innovation at the centre of efforts to reflect the needs and viewpoints of women and girls and to resolve barriers to public services and opportunities.” Innovation highlights the game-changers and activists willing to “accelerate progress for gender equality, encourage investment in gender-responsive social systems, and build services and infrastructure that meet the needs of women and girls.” The goal of today is to celebrate the incredible achievements of women and girls who seek to overcome their marginalized status in their communities, level the representation across various academic disciplines and professional fields and undo the cycles of intersectional injustices to bring about a more equitable world.

History

What started as a response to a women’s labor strike in New York 1909 became an international movement to honor the rights of women and to garner support for universal women’s suffrage. In 1913-14, International Women’s Day was a tactic to protest World War I as a part of the peace movement. The UN adopted 8 March as the official date in 1975 during the International Year of Women. Gender equality and the empowerment of all women and girls is Sustainable Development Goal #5 in 2015.

The Ladypad Project

This coming week, Dr. Tina Kempin Reuter and Dr. Stacy Moak will take 12 UAB students to the Maasai Mara in Kenya. The team, in collaboration with the I See Maasai Development Initiative, will fund education on women’s health rights and provide 1500 girls with materials, including underwear and reusable pads, for menstrual hygiene management. The project was awarded a grant through Birmingham’s Independent Presbyterian Church Foundation.

Continuing the Fight

International Women’s Day is not only about celebrating the accomplishments of women and girls, but it is also about shining a light on the continuing injustices faced by more than half of the world’s population. From femicide and early marriage to FGM and sexual violence and exclusion from peace talks, gender inequity discounts the contribution of women and girls to the overall value of humanity. Kofi Annan, the late UN Secretary-General, posited that the empowerment of women proves more effective than any other tool for development. Noeleen Heyzer concludes that although there are women’s issues and rights still to be raised and respected, including those outlined in the Convention on the Elimination of All Forms of Discrimination Against Women, there are many that we must continue to protect. March is Women’s History Month and our contributors will write about issues that continue to impact the lives of women and girls around the world.

 

Charles Billups: An Overlooked Civil Rights Icon

On Wednesday, February 13th, the Institute for Human Rights co-sponsored an event alongside UAB’s Department of English and the Jemison Visiting Professorship in the Humanities about the legacy of civil rights activist Reverend Charles Billups. The lecture was led by civil rights scholar Dr. Keith Miller (Arizona State University) then followed with a conversation from Billups’ daughter, Rene Billups Baker.

Charles Billups’ was a pastor at New Pilgrim Baptist Church in (Birmingham, Alabama) and one the founders of the Alabama Christian Movement for Human Rights (ACMHR), a faith-based organization addressing civil rights from 1956-1969. Members of ACMHR would meet every Monday night to coordinate boycotts and lawsuits relating to segregation. Billups was a friend of fellow ACMHR member and civil rights icon Reverend Fred Shuttlesworth and was the first person on the scene after Shuttlesworth’s house was bombed. Shuttlesworth would also be the one to drive Billups to the hospital after he was beaten by members of the Ku Klux Klan.

With the civil rights movement facing discouragement nationwide, Billups was chosen by the ACMHR to lead the 1963 Children’s Crusade in Birmingham because he attended all their strategy sessions. During the demonstration, local law enforcement warned demonstrators that if they were to not back down, they would turn the dogs and fire hoses loose. Matching their physical force with the soulful force of civil rights activism, Billups taunted these threats and, as fate would have it, firefighters refused to spray the demonstrators. As a result, the Children’s Crusade, and the larger Birmingham Campaign, become a model for non-violent direct-action protest and overall success for the civil rights movement.

As a result, this moment had arguably turned to the tide for the Civil Rights Movement, grabbing national attention from the New York Times and galvanizing organizers nationwide. The next year, President Lyndon B. Johnson signed the Civil Rights Act of 1964 which put a legal halt to racial discrimination in educational, employment, and public institutions. Years later, per Martin Luther King, Jr.’s request, Billups would move to Chicago, only to be murdered by an unknown gunman in November 1968; according to Baker, the police didn’t investigate her father’s murder.

After her father’s death, Baker claimed she was angry with the world as well as God; all Baker wanted back was her father. For years, she didn’t even like to murmur the words or discuss “civil rights”. However, through the years, she has learned to forgive and wants younger generations, such as her nieces, to know about her father’s pivotal role in the Civil Rights Movement. With a greater appreciation for her father’s perseverance and sacrifice, Baker closed by saying that he, MLK, Jr., and Shuttlesworth are all smiling down on her agreeing, “She’s alright now”.

Predatory Preparers: Exploitation Through Tax Returns

For most adults in the United States, the year starts with the tax season.  During this time, they have their tax returns prepared and filed and either pay any taxes they owe or receive a refund if they overpaid their taxes throughout the prior year.  This year, the tax season began on January 28 and continues until April 15.  There are a few different ways one can go about filing their tax return.  One way is to purchase an IRS-approved tax preparation software, like TurboTax or TaxSlayer, and file their return on their own.  One could also prepare their return manually, but the IRS prefers that people file electronically to decrease potential errors.  The last method is to seek out the help of a professional through a commercial tax preparation organization or a non-profit one.  Commercial organizations often take advantage of the low-income filers whose returns they prepare and who often qualify for the Earned Income Tax Credit, which results in a larger refund. 

The Earned Income Tax Credit 

The Earned Income Tax Credit (EITC) provides a subsidy to households with low incomes.  It was created in 1975 with the intentions of temporarily lessening the tax-burden for the working-poor after the 1973-1975 recession.  In 1978, the Revenue Act turned it into a permanent credit.  Since its creation, the EITC has been adjusted many times to make it more effective and requires tax-filers to meet certain criteria to receive it.  Since being implemented, the EITC program has distributed about $67 billion to about 28 million families. 

Qualifications for the credit include being a U.S. citizen or resident alien all year, not being married while filing separately from one’s spouse, having an investment income of $3,500 or less, not being a qualifying child of someone else, and having a valid Social Security Number by the due date of the return.  The amount of money that qualified individuals receive for the EITC depends on factors such as “earned income, gross adjusted income, filing status and whether or not they have a qualifying child.” 

The Problem 

Many people choose to file their taxes through for-profit tax-prep organizations.  These organizations are often concentrated in areas where a large percentage of the population is made up of people with lower incomes who qualify for significant refunds through the Earned Income Tax Credit program.  They prey on the people who need the money from the EITC the most.   

In order to increase their profit, they put a great deal of effort into publicizing their services in a way that overshadows the far less expensive, sometimes even free, methods of filing tax returns.  Paul Weinstein, who co-authored a study on tax preparers with the Brookings Institution and the Progressive Policy Institute, suggests that most taxpayers could “have their taxes prepared for less than $100.”  According to Weinstein, tax-filers spend an average of $275 on the preparation of their taxes during the filing season.  The authors of the study found that individuals filing for the EITC spent $309 in Washington D.C. and $509 in Baltimore.  This means that these individuals were spending between 13 and 21 percent of their return to cover the cost of tax-preparation. 

There has also been evidence that suggests that individuals who qualify for the EITC and file through professional tax-preparers are more likely to have errors in their tax return than those who do not qualify for the EITC.  According to an investigation by the Government Accountability Office in 2015, about 60% of all professionally prepared taxes had errors, while between 89% and 94% of filers who qualified for the EITC had errors in their professionally prepared taxes.  This is a problem of significant concern, since people with low incomes are more likely to be audited by the IRS.  For people who receive the EITC, this could result in their refund being withheld until the end of the auditing process. 

Predatory tax-prep organizations may often go unnoticed, but many are recognized and forced to face the legal repercussions of their actions.  For example, Laquinta Q. Fisher of Lawton, Oklahoma was found guilty of a tax fraud scheme on January 24, 2017.  After lying to her clients and telling them that they could receive a refund for simply having a dependent child, she added fake income and fake dependents to their returns to increase their EIC.  She “was sentenced to 18 months in prison, three years of supervised release, and ordered to pay $133,955 in restitution to the IRS…”

Signs of a Predatory Tax-Prep Organization 

There are a few warnings signs you may want to look out for if you are concerned that a tax-prep organization may be predatory.  Since these groups target low-income tax return-filers, they often tell potential clients that they can promise them a large refund.  One red flag to watch for is if a preparer is being paid based on a percentage of the refund their client receives.  They have a clear source of motivation for trying to increase the refund.   

It is also possible that such an organization would have false credentials.  Every tax preparer is legally required to have a Preparer Tax Identification Number (PTIN).  The IRS has a directory of PTINs that can be used to look up a preparer with their name and location.  The PTIN can tell you if the preparer is “a certified public accountant, enrolled agent or a lawyer.”  It is also important to note that the directory does not prove that a preparer is qualified.  It is also a red flag if an organization suggests that they are endorsed by the IRS, as the IRS does not endorse any tax preparers. 

Another warning sign is if a preparer does their work in “temporary pop-up shops” that will be gone after the tax season ends.  In that case, there is no office for you to go to if any problems arise with your tax return.  It is a red flag if the preparer says that they will deposit you refunded into their bank account or asks you to sign a return that is incomplete.  

Why Is This A Human Rights Issue? 

In addition to being ethically questionable, the actions of commercial organizations that prey on low-income households also have the potential to negatively impact people’s access to their human rights.  For many people who are targeted by these organizations, every single dollar counts.  Every penny of the tax refund they receive is used to pay for the necessities, like food, water, power, rent, and clothing.  According to Article 25 of the United Nations’ Universal Declaration of Human Rights, “Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services…”  Many households rely on the refund they receive to access this right.  It is important that we spread awareness of this issue so we can prevent as many people as possible from being exploited by tax-prep organizations and connect them with the resources they need. 

Impact America: SaveFirst 

Impact America, originally Impact Alabama, is a non-profit organization that was founded to develop “substantive service-learning and leadership development projects for college students and recent college graduates.”  SaveFirst is one of Impact America’s programs, which provides free tax preparation services in communities which are often targeted by predatory tax-prep organizations.  College students who volunteer with SaveFirst are trained and IRS certified to prepare tax returns.  In 2018 alone, SaveFirst was able to prepare tax returns for 13,713 families and saved those families $5.5 million in fees.  Since 2007, they have prepared returns for 76,867 families and saved them $26.2 million.  The work done by Impact America helps to decrease the number of people that are being exploited by predatory organizations by giving them access to much better resources and services.

Disability Rights, Employment, and Housing in a Cross-Cultural Perspective

The ability to be rewarded for making meaningful contributions to society and to choose our own private residence are two facets of life many of us often take for granted.  However, many individuals with a form of disability often encounter barriers during their journey locating work and housing.  These barriers can arise from social isolation, discriminatory and / or inadequate governmental policies, economic hardship, or simply a lack of awareness of resources designed to aid persons with disabilities to find employment and housing.  These material and immaterial barriers fall under the broad umbrella of ableism, defined here as “the intentional or unintentional discrimination or oppression of individuals with disabilities”.  The following post explores four case studies surrounding the themes of housing and employment and how various cultures have either failed to address these needs or offered innovative solutions to persons with disabilities.  Finally, for the purpose of this blog, disability is defined, in accordance with the Washington Group (2018), as “problems, such as impairment, activity limitation or participation restrictions that include the negative aspects of functioning” in the following six domains: (a) walking; (b) seeing; (c) hearing; (d) cognition; (e) self-care; and (f) communication.  This blog post offers an anthropologically-informed context for to upcoming panel ‘Disability Rights, Employment, and Housing in a Cross-Cultural Perspective’ at the Institute for Human Right’s Symposium on Disability Rights.

Disability Rights & Employment: South Africa

South Africa’s government of apartheid came to power in 1948 and institutionalized a cultural and political zeitgeist of xenophobia, discrimination, and violence towards the Other.  Throughout apartheid’s hold on South Africa, systems of cultural and structural violence were erected both within social life and in bureaucratic policy.  Apartheid is most infamous for its impact on racially-motivated violence; however, other forms of discrimination were enabled by apartheid policy and philosophy as well.  Engelbrecht (2006) notes that education systems institutionalized apartheid policies in curricula development and inclusivity within schools.  This specifically barred children with disabilities from actively participating in the education system, from primary through tertiary levels.  Englebrecht (2006) contends children with disabilities were actively excluded from South African governmentally-controlled education systems.  This means children with disabilities during the apartheid regime did not receive adequate preparation for entering into the workforce, thus placing these individuals at a low ‘tract’ and preventing them from seeking or acquiring meaningful employment.  Englebrecht (2006) emphasizes that discriminatory and / or prejudicial national policies focused on one marginalized population (e.g. apartheid) often seep into the experiences of other marginalized populations as well.  In short, government-sanctioned racist policies immobilized the disability community.  To repress one group is to repress all groups.

The South African Human Rights Commission (SAHRC) was inaugurated in October of 1995, as mandated by the South African Constitution’s Human Rights Commission of 1994.  The SAHRC is charged with monitoring, preventing violations of, and educating the public about human rights within the South African context.  A specific function of the SAHRC is to examine how apartheid-era policies impacted South African civil society and how to eliminate the vestiges of structural violence still propagated by the former apartheid regime.  The SAHRC provides further evidence supporting Engelbrecht’s (2006) theory that the repression of children with disabilities would negatively impact South African workforce.  The SAHRC (2017) summarizes trends of disability employment, demonstrating that workforce equity (equally considering and making efforts to hire marginalized populations, such as the disability community) is nowhere near the South African Department of Labor’s goal of 7% by the year 2030.  In 2017, workplace equity was still under 2%, with 8 in 10 persons with disabilities unable to find employment (SAHRC, 2017).  A variety of reasons are given for this abysmally low number, including: lack of reasonable accommodation, inequality and discrimination, and a persistent inability to obtain a quality education.  The ghost of apartheid, it seems, haunts the disability community within South Africa, preventing a vast majority of persons with disabilities from obtaining education, training, and gainful employment.

Disability Rights & Employment: Ireland

In 2017, the British Conservative government announced plans to cut the Employment and Support Allowance for persons with disabilities who were deemed ‘capable of preparing to return to work’ by 30£ / week (~$40 / week).  The British government implemented this policy as a ‘motivational tool’ for persons with disabilities and as an austerity measure, despite the fact that previous disability allowances (akin to welfare or social security measures in the United States) left 1/3 of allowance recipients struggling to afford food.  However, the ministers of Ireland, taking cue from their outraged constituents, have chosen a different path to empower persons with disabilities to find employment.  Instead of the ‘pull yourself up by the bootstraps’ strategy of British Conservative MPs, Irish Minister for Social Protection Regina Doherty and Minister of State for People with Disabilities Finian McGrath have chosen to listen to persons with disabilities themselves to assess the best way to promote gainful employment within the disability community.  In response to a 2017 policy brief Make Work Pay, Doherty, McGrath, and other policy-makers are distributing questionnaires to adults with disabilities and parents of young children with disabilities to assess the employment needs of the disability community (Clougherty, 2017).  This approach to governance, one defined by inclusivity and direct participation of the disability community, shows promise in exploring the complicated relationship between disability and employment.

Of particular importance in the employment-disability nexus is accounting for an individual’s preference for work and her or his form of disability.  The Irish ministers understand that low-functioning persons with disabilities will, for the entirety of their life, be simply unable to work.  These individuals require assistance from the government thereby ensuring these persons are included in society and are able to participate in decisions regarding their lives and livelihoods.  On the other hand, some individuals are temporarily disabled and do not require the same social security from governments.  By asking for input from persons with disabilities themselves, the Irish policy-makers are better equipped to make educated, inclusive, and effective policies and programs aimed at insuring equitable and equal employment within the disability community.

Disability Rights & Housing: Libya

The State of Libya, located at the Northern-most tip of Africa and bordered by the Mediterranean Sea, is in the midst of rebuilding civil society following the catastrophic Libyan Civil War of 2011.  For over forty years, Muammar Gaddafi ruled over Libya, attempting to introduce a socialist regime and command economy to the Libyan State.  During his reign, Gaddafi allegedly sought to implement a political philosophy of jamahiriya (جماهيرية‎), meaning “state of the masses” in Arabic – akin to ‘direct democracy’.  Through this system, Gaddafi created the national General People’s Congress, whose directives (including any form of a Libyan Constitution) could be superseded by the Basic People’s Congress, municipally-led executive and legislative bodies.  Hypothetically, this system placed most political power at the local level; however, Gaddafi’s actual dictatorial rule inverted the political equation.  In the past half century, this political system (again, on paper) aimed to enshrine the rights of persons with disabilities through the passage of the 1981 “Law on Disabled People”, arranging for “government provision of housing, home care, education, prosthetic limbs and rehabilitation for people with disability in Libya” (Hamed el-Sahly & Cusick, 2016, p. 12).  In political practice, Libyan persons with disabilities suffered major human rights violations, including lack of housing and home care, due to insufficient mechanisms of care and cultural taboos.

Although political and economic recovery may well be on the horizon for post-conflict Libya, cultural barriers prevent many Libyans with disabilities from securing independent and safe housing.  In a comparative study, many Libyans express unfavorable attitudes towards persons with disabilities along three dimensions: (1) lower ratings of willingness to empower the disability community; (2) higher ratings of exclusion; and (3) lower ratings of similarity between disabled and non-disabled people (Benomir, Nicholson & Beail, 2016).  Most pertinent to issues related to housing, Libyan participants scored high on the ‘need to shelter’ persons with disabilities – meaning intentionally secluding these individuals from broader society for fear of communal judgement and the social stigma attached to disability.  Furthermore, efforts to facilitate the transition from being ‘sheltered’ (living with a family member) to an autonomous home life is seen as a problem ‘for and by’ the disability community – i.e., it is the responsibility of the disability community alone to solve social issues related to their situation in life (Cusick & Hamed el-Sahly, 2018).  This demonstrates that governmental policies intending to enshrine disability rights are insufficient – societies themselves must be willing to tackle these issues head on.

Disability Rights & Housing: Native Americans

Persons with disabilities with another form of marginalized identity (e.g. members of an indigenous group) are placed at a heightened risk for social isolation / exclusion, for physical and mental health concerns, and having disability-related needs go unmet (US Department of Health & Human Services, 2017).  Within American Indian / Alaska Native (AIAN) communities, this translates specifically into housing issues, as AIAN reservations already suffer from a lack of resources and infrastructural investment to provide for non-disabled AIAN individuals (US Department of Health & Human Services, 2017).  An estimated 21 – 69% of homes on reservations are overcrowded and have serious physical deficiencies compared with 5.9% of non-reservation US homes nationally (US National Council on Disability, 2003).  To address these intersecting concerns, the AIAN community, in tandem with the US government, have prepared and started implementing policy prescriptions to provide affordable, safe, and dignified housing to AIAN with disabilities.

Of primary concern in planning homes for persons with disabilities is utilizing principles of universal design – “guidelines for housing construction that would create a livable, marketable environment for everyone regardless of ability, age, or size” (US National Council on Disability, 2003, p. 94).  Currently, the American Indian Disability Technical Assistance Center provides assessments of universal design within reservations and makes design prescriptions if the home in question is not fully accessible.  Implementation of these prescriptions may fall to the American Indian Disability Legislation Project (AIDLP), a culturally-informed taskforce mandated to draft and pass legislation standardizing disability-related care (including autonomous and accessible housing) on Indian reservations (US Department of Health & Human Services, 2017).  The AIDLP, in addition to ensuring reservations adhere to the Americans with Disabilities Act, acts as a cultural liaison between the disability community and AIAN community to ensure disability concerns are handled in a culturally-appropriate manner.  Finally, the AIDLP and other AIAN-affiliated, disability-related advocacy groups ground their research and implementation efforts by tackling both material (e.g. physical accessibility) and immaterial (e.g. cultural stigma) barriers (US Department of Health & Human Services, 2017).

Towards a Global Culture of Disability Empowerment

The preceding case studies illustrate that disability rights, especially related to employment and housing, are high complicated issues.  Historical events, such as apartheid and civil war, interact with governmental policies, such as austerity measures and indigenous sovereignty.  Underlying each of these examples is the ‘culture’ surrounding disability – how peoples across the world value or stigmatize the experiences and perspectives of the disability community.  In some cases, such as South Africa, systems of discrimination have erected structural barriers holding back people with disabilities, even though disability-related stigma may have lost its potency.  In other cases, such as American Indian / Alaska Native communities, an additional marginalized identity may facilitate an even greater emphasis on seeking justice and equity for persons with disabilities.  As local, national, and global disability movements aim to eliminate social exclusion and promote equality in life and livelihood, the myriad cultures of disability must be unpacked and explained.  This post argues that moving towards a global cultural of disability empowerment is indeed possible.  Once this culture of empowerment has been adopted, disability-related concerns, such as employment and housing, will be addressed and rectified across the globe.

The Age of Human Rights?

The Institute for Human Rights at UAB is proud to take part in the annual Human Rights Day today, December 10th.  Today, the United Nations led the global celebration honoring the creation of the Universal Declaration of Human Rights and its subsequent influence on global affairs.  This is the last post in our series on Human Rights Day, exploring possible next steps to protect, maintain, and expand human rights across the globe.

Looking Ahead: Third Generation Rights & Beyond

Human rights are broken into three generations: (Saito, 1996)

  1. Civil & political, embodied by the UN’s International Covenant on Civil and Political Rights (ICCPR). These rights primarily protect the individual from government overreach, including the freedom of the press, right to ownership, and equality under the law.
  2. Economic, social, & cultural, embodied by the UN’s International Covenant on Economic, Social, and Cultural Rights (ICESCR). These rights primarily ensure equality and equity of individuals in society, including the right to work, freedom of association, and right to an education.

Third Generation human rights relate to ‘solidarity’ and broadly represent the rights of collectives, expanding human rights beyond the individual (exemplified in Generations 1 and 2; Saito, 1996). However, unlike the previous two generations, Third Generation human rights do not have a corresponding UN Covenant or Declaration to codify or clarify what these rights specifically entail. At this point in time, Third Generation human rights include the right of people to self-determination, to peace, and to the environment (Cornescu, 2009).  This last right, to the environment, is an interesting development.  This shifts the focus of human rights beyond the present circumstance and expands the purview of human rights into future generations.  If the human rights doctrine embraces this temporal expansion, what new rights may arise?

Pushing forward the jurisdiction human into years beyond the present requires a futuristic approach to the human rights agenda, attempting to account for potential crises that may threaten the lives and livelihoods of humans of the future.  Here are a few upcoming crises requiring the attention of the human rights community:

  • Climate Change. The US Global Change Research Program recently published the “Fourth National Climate Assessment”.  This assessment urges policy-makers to take action to mitigate the effects of the global climate change crisis.  If this crisis unfolds unchecked, marginalized populations (e.g. persons dealing with the consequences of poverty, indigenous groups, and so on) will first feel the brunt of climate change, followed by economic, health, and infrastructural catastrophe.  The unwillingness to take immediate steps to curb the effects of climate change infringes of the human rights of global populations.
  • Artificial Intelligence (AI). Harvard Political Philosophy Professor Dr. Mathias Risse (2018) recently published a research brief illuminating the Gordian Knot of ethics, human rights, and the creation of artificial intelligence.  Two concerns are particularly relevant to human rights: (a) the transmission of bias from human to machine (i.e. discrimination and prejudice along gender, ethnic, ableist, or ageist dimensions); and (b) the problem of value alignment (i.e. ongoing debate regarding how and which normative values should be imparted into machines).  By the same breath, Risse contends human rights advocacy networks would do well to integrate AI into their operations for two purposes: 1) to increase the efficiency and minimize human risk in humanitarian emergencies, and 2) to insert the human rights community into the AI community.  As AI technology develops, perhaps even to the point of artificial consciousness, human rights language must offer clear rules and safeguards concerning the human-AI relationship.
  • Genetic Engineering. He Jiankui Shenzhen, China, recently claimed the mantle of the first research scientist to use genetic engineering to alter embryos during fertility treatments (pending corroboration from peer reviewers).  The human right to our own genetic material has sometimes been referred to as 4th Generation human rights, and this generation declares the human genome is a crucial part of human heritage (Cornescu, 2009).  The use of genetic engineering has been considered a potential boon for eradicating diseases such as HIV/AIDS, while simultaneously harkening to Nazi sentiments regarding the creation of a perfect human race. In the coming years, the human rights community must decide, in no uncertain terms, how and if humanity itself should be subject to engineering, and how human rights fits into this process.
  • Space Colonization. (In)Famous technology personality and businessman Elon Musk claims he and his private spaceflight company SpaceX will send the first human beings to Mars at or before the year 2024, build Mars’ first city in the 2030s, and terraform Mars into an Earth-like planet throughout the 2100s.  As Musk and other billionaires seek to tame the Final Frontier, ethical concerns about the human right to and human rights in outer space must be clarified.  Most notable of these issues is that of “internality”: through lack of access and/or privilege, many humans will remain Earth-bound, with “no true escape… from the atomic bomb, terrorism, or the ecological crisis, which is already dramatically destroying our environment” (Calanchi, Farina & Barbanti, 2017, p. 215).  Stoner (2017) presents another arresting argument: space colonization is an inherently invasive act (a resurrection of the horrors of “New World” colonialism, nonetheless) and threatens to displace or destroy life on any extraterrestrial bodies that humans colonize.  Before hightailing it across outer space, perhaps our species should instead focus on the human rights crises on our home planet.

The Age of Human Rights?

Eighteen years ago, former UN Secretary-General Kofi A. Annan penned an editorial for Project Syndicate Magazine, lauding the fact that the UN and its member states broadly coalesced around the norm of human rights: “Above all we have committed ourselves to the idea that no individual – regardless of gender, ethnicity or race – shall have his or her human rights abused or ignored.” Cautiously optimistic from the international community’s recent outrage towards massive human rights violations and movement towards protecting vulnerable populations, Annan proclaimed that the 21st century will be the “Age of Human Rights”.  Annan’s optimism stemmed from his observation that global civil society had, in the span of 52 years, began to take seriously extrajudicial violence both within and between member states.  There is another reason to be optimistic as well.  Humans in the current day have a universal language, mechanism, and procedure to prevent global catastrophe; this was not the case leading up to the last catastrophe – World War II.

Human rights are not static concepts – they are constantly defined and redefined through developments in research, policy, and practice.  Human rights are also ideal forms – translating abstract concepts from documents such as the UDHR into the messy world of lived experience is a Herculean task.  The idea of human rights is challenged by both thought and behavior, whether the ideology of nationalism or the actions of genocidaires.  Human rights are claimed, in the sense that each one of us has a responsibility to report suspected human rights violations, to defend the notion of universal human rights from potential spoilers, and to self-advocate in instances where our rights might be diminished.  The human rights movement must also be forward-looking, anticipating future dangers well before they happen, pre-emptively codifying human rights to account for the scientific and ethical progression of human civilization.  The human rights movement is an opportunity for humanity to write its own rulebook, guiding our approach to thorny issues such as climate change, AI, genetic engineering, and space colonization.

These and more profound challenges await our species in the coming years, and an adaptive, cogent, and enforceable doctrine of human rights will prepare humanity to successfully transform these challenges into opportunities for growth for the human species.  This growth is utterly contingent upon a global commitment to the idea of human rights – that all individuals deserve a free and full life, dignified by our shared human condition and experience.  If the Age of Human Rights is indeed here, the global community should adopt an outlook of futurism in human rights: looking into the coming years, taking stock of critical issues on the horizon, and utilizing the human rights movement to brace global civil society for the coming winds of change.  It is not enough that the Age of Human Rights decries violence in all of its forms.  To future generations, the Age of Human Rights must be known for its foresight identifying, preventing, and transforming global and (perhaps) extraterrestrial challenges for the betterment of all humankind.

The History of the Universal Declaration of Human Rights

The conception of the Universal Declaration of Human Rights (UDHR) gave birth to human rights as they are known today. Adopted by the United Nations (UN) General Assembly on December 10, 1948, the UDHR was a response to the atrocities that took place during World War II. As half the globe laid in ruin and millions of lives were taken, a dormant side of humanity seemed to reawaken within the world powers, and an international prioritization of human rights emerged. The UDHR, comprised of 30 Articles defining human rights, was an expression of humanity’s resurgence, as well as an international commitment to never allow such monstrous acts to take place again.

Those tasked with composing the UDHR were members of the Commission on Human Rights, chaired by the dynamic Eleanor Roosevelt, who served as First Lady of the United States from 1933 to 1945. Roosevelt transformed the role of the First Lady by using her position as a platform for social activism in women’s rights, African-American rights, and Depression-era workers’ rights. After her husband, President Franklin D. Roosevelt, died in 1945, she was appointed to be the US Delegate to the UN and served in this role for 7 years. It was her experience and passion for social activism that prepared the widow Roosevelt to Chair the commission responsible for creating the UDHR. Roosevelt asserted the Declaration would reflect more than Western ideas; to accomplish this, the Human Rights Commission was made up of members from various cultural and legal backgrounds from all around the world, showing respect for differing cultures and their customs while also ensuring each region had a hand in creating the document. Under Roosevelt’s leadership, the diverse commission was able to craft the UDHR in a unique and culturally-competent way.

The UDHR was the first document in history to explicitly define what individual rights are and how they must be protected. The Preamble of the document outlines the rights of all human beings:

Whereas recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world,

Whereas disregard and contempt for human rights have resulted in barbarous acts which have outraged the conscience of mankind, and the advent of a world in which human beings shall enjoy freedom of speech and belief and freedom from fear and want has been proclaimed as the highest aspiration of the common people…

Thus, for the first time in history, human rights were assembled and codified into a single document. The Member States, or sovereign states that are members of the United Nations, came together in agreement to protect and promote these rights. As consequence, the rights have shaped constitutional laws and democratic norms around the world, such as the Human Rights Act of 1998 in Britain and the Civil Rights Act of 1964 in the United States.

The Commission on Human Rights defined human rights with the conception of the UDHR. By fusing dignity, fairness, equality, respect, and independence, the UN defines human rights as:

rights inherent to all human beings, regardless of race, sex, nationality, ethnicity, language, religion, or any other status. Human rights include the right to life and liberty, freedom from slavery and torture, freedom of opinion and expression, the right to work and education, and many more.  Everyone is entitled to these rights, without discrimination.

Human rights are the cross-cutting theme within every UN agency. They have inspired the UN’s Sustainable Development Goals (SDGs), which are goals to “provide peace and prosperity for people and the planet, now and into the future.” These planet-, urbanization-, and group-focused goals substantially contribute to the realization of human rights, as the human rights-based approach to development stipulates development is conducive to the promotion of human rights.  In the ideal sense, human rights are a guiding force toward living in global harmony, and through the promotion of the basic rights bestowed by the UDHR, the world has made strides toward achieving that harmony.

 

International Day of Persons with Disabilities 2018

Today, December 3, 2018, is the International Day of Persons with Disabilities (IDPD), an observance promoted by the United Nations (UN). This year’s theme, “Empowering persons with disabilities and ensuring inclusiveness and equality,” accommodates the 2030 Agenda for Sustainable Development’s pledge to “leave no one behind” which envisions sustainable urbanization, namely through a smart-city approach that prioritizes digitalization, clean energy, technologies, and service delivery. Such ambition is salient to persons with disabilities because, above all, achieving these goals will result in communities that are more accessible and inclusive for everyone.

It is argued the main contribution to why persons with disabilities have been excluded from public life is the practice of the medical model of disability (MMD) which embraces the perspective of non-disabled persons, reducing persons with disabilities to dysfunctional people in-need of medical treatment, with emphasis on normative functioning of the body. As a result, persons with disabilities are often assigned a sick role that exempts them from activities and expectations of productivity, leaving them as passive recipients of medical goods and services. These medicalized expectations of normality, restoration, and functional independence can devalue the lived experiences of persons with disabilities, thus inviting discrimination into their daily lives.

On the contrary, the social model of disability (SMD) challenges the knowledge/power differential employed by medical authorities and suggests empowerment for persons with disabilities, ultimately strengthening the patient role and influencing changes in treatment paradigms. Furthermore, the SMD argues that social practices are what disable persons with impairments, placing many persons with disabilities into isolating circumstances and preventing full civil participation. Whether it be employment in Alabama or being a refugee in Kenya, the SMD challenges the MMD by suggesting persons with disabilities are an oppressed group that experiences discrimination and deserving of equal treatment.

On December 13, 2006, the UN adopted the Convention on Rights of Persons with Disabilities (CRPD), an international agreement which details the rights of persons with disabilities and lists codes for implementation, suggesting both states and disabled people’s organizations (DPOs) are to coordinate to fulfill such rights. In the following years, nations spanning the globe have ratified the CRPD, such as Jordan (2008) and Ireland (2018), thus strengthening protections for persons with disabilities. Although the United States is one of the only nations to have yet ratified the CRPD, this international document is largely modeled after the Americans with Disabilities Act (ADA), signed in 1990, which prohibits discrimination toward persons with disabilities. As a result, we are only seeing the beginning of what is to come for accessibility and inclusion for persons with disabilities, both domestically and globally.

Africa – Not a Country but a Continent

One of the most famous blunders made by former U.S. President George W. Bush was, “Africa is a nation that suffers from terrible disease.” President Bush, like many others, misconstrued the fact that Africa is not a country, but a continent.

Africa consists of 54 different countries with a vast array of cultures, languages, religions, politics, agriculture, and cuisine. Many people assume that in Africa, people speak “African” or do not understand other languages; however, this is quite incorrect. In Africa, there are over 2,000 languages such as Arabic, English, French, Portuguese, and Swahili. Surprisingly the most spoken language is Arabic, with over 170 million speakers. Furthermore, English is the official language in 24 of the nations. “About 25 percent of the languages spoken in African countries aren’t recognized anywhere else in the world, which is a testament to its diversity and fullness.

There are approximately 200 independent countries in the world and a quarter of them are in Africa. In fact, Africa has a population of over one billion people and is the second largest continent in the world. To demonstrate the immensity of Africa, the USA, China, India, Europe, and Japan could all fit inside its geographic border.

People often view the countries in Africa as poor. While 218 million individuals live in extreme poverty, 1 in 3 Africans are considered middle class. Additionally, not all people in Africa live in “huts”. About 43% of individuals in Africa live in urban areas. In fact, there are more than 50 cities with a population of over a million people. Also, approximately 70% of Africa’s population is under the age of 30. So, when you combine this young demographic with diversified urban centers, you generate the possibility of innovation throughout the continent. Furthermore, their economy is expanding – out of the 10 fastest growing economies, 6 are in Africa. It is not possible to apply one concept to the entirety of Africa. Yes, some countries are poor, especially in sub-Saharan Africa; however, there are countries such as Nigeria, South Africa, and Egypt that are fairly wealthy. Nigeria exports the majority of the world’s oil, has a GDP of over $594 billion, and is projected to be one of the world’s largest economies in just a couple of years. While South Africa is a well-known tourist location, it also has the 18th largest stock exchange in the world. Egypt is one of the wealthiest countries in Africa.

In terms of landscape, Africa is quite diversified. While the Saharan desert covers one-third of the continent, there are also rainforests, mountains, and lakes. Africa’s largest vegetation zones do not comprise of deserts or rainforests, but, in fact, savannas which are tropical grasslands. There is a myriad of ecosystems in Africa. For example, the Sahara desert is the world’s largest hot desert and has over 300 species of wildlife such as the cheetah, ostrich, and hyrax. On the flip side, the Congo and the Nile are the world’s deepest and longest rivers, respectively. Africa is also home to numerous wetlands, specifically in the Botswana which includes saline lakes, freshwater forests, and massive floodplains. There are also tropical forests in Central and West Africa such as the Congo rainforest.

Western media tends to only portray the negative aspects of Africa – violence, revolution, and wars. However, there is so much more to Africa than the negatives because it is not all danger and violence. For example, Zambia is quite peaceful and has had six presidents since becoming independent in 1964. Furthermore, it has never had a civil war. In Liberia, the former President was named by Time as “one of the top 10 female leaders in the world”. Additionally, she earned a Nobel Peace Prize for her work in women’s rights. Western countries tend to show Africans as powerless and reliant on Western aid to survive. In fact, many ads in the West embody this stereotype by depicting Africans as sad, lonely, and dirty children that need money. However, this is nothing further from the truth. It is thought that Western countries are the ones who help out Africans and are responsible for their well-being. But the truth is that African people who live outside of Africa send more money to their families than all of the aid combined from the Western countries. That is not to say that Western countries should not offer assistance when it is needed, but they must change their minds about what it means to live in Africa. Africa is not helpless, there are many projects created by African people. A Somalian woman, Hawa Abdi, implemented a health clinic, which has now developed into a “school, refugee camp, and hospital for over 90,000 women and children made homeless in the war”. Another example would be the Akon Lighting Africa project, which provides electricity the usage of solar energy to those in Africa.

There are also many assumptions about Africa being a place that is technologically backward. They see it as a place without phones, social media, internet, etc. However, Africa is quite the contrary by becoming “the world’s second most connected region by mobile subscriptions with over 754 million connections”. Interestingly enough, people in Kenya are 4 times more likely to have a cell phone than have access to a toilet. Moreover, at least 80% of African people have access to a mobile device. There are also many innovative advances for renewable energy such as hydroelectric power and solar panels. A lot of African countries are ahead of Western countries when it comes to sustainable energy. Kenya alone gets 50% of their energy from hydroelectricity, while in the UK and US, only 11% of their energy comes from renewable sources. In terms of creativity, Africa has numerous resourceful inventions such as traffic-regulating robots, a biomedical smart jacket that can diagnose pneumonia, and a device that fuses live neurons into a silicon chip.

There is no way to identify Africa as simply one thing. Africa is diverse in areas such as people, language, economy, landscape, technology, and innovations.

On Tuesday, November 13, the Institute for Human Rights and Consulate General of Switzerland – Atlanta co-sponsored a showing Sonita, a film based on a 15-year-old girl from Afghanistan who immigrated to Iran in order to flee the Taliban. Over the course of the three years Sonita is filmed, she is able to receive assistance at a center for refugee children in Tehran, Iran where she works on her dream of becoming a rapper by performing for her classmates and pursuing a place to record her music.

What many people are unaware of is the Afghani tradition of forcing children into marriage, with Sonita’s family setting her price as $9,000. Without intervention from the filmmaker, Rokhsareh Ghaem Maghamim, who paid her family $2,000 to postpone her marriage, Sonita might have not made it to where she is now. To make matters worse, women are not allowed to sing in Iran. So, in order for Sonita to continue her dream of becoming a rapper, the shelter could no longer be affiliated with her. Maghami then managed to take Sonita to the United States, without her parent’s permission, to pursue a career in rap.

Maghami claimed, “I can’t film people who are suffering for something I can afford, when they are giving their life, their story, to me,” she says firmly. What about a film-maker’s duty to be an objective observer? She shakes her head. “It’s always a lie. You are never a fly on the wall. You are always an elephant in the room. You change everything with your presence. I don’t believe objectivity is important or even happens. Human stories are always subjective and personal. The film-maker decides, creates.”

Maghami started filming this documentary to help her cousin who worked at the refugee center, while her cousin just wanted to help Sonita find some training for her music. However, these selfless acts dramatically changed a young woman’s entire life.

Sonita shares the story of one young woman’s strength, perseverance, and the ability to use music as a vehicle to confront social injustice. This film not only gives the audience an inside look to both a tradition and country many are unfamiliar with, but also provides Sonita with the voice she needs to have her story heard.
