Due Process: Is It Standard Operating Procedure?

I read “The Presumption of Guilt: The new liberal standard turns American due process upside down” the other day. I found this piece presumptuous at worst, and revelatory at best. The WSJ editorial board outlines three core tenets potentially derailing due process in the Kavanaugh appointment, most notably the presumption of his guilt. These core tenets, in the board’s estimation, will defend against a mockery of “the new liberal standard of legal and political due process.” What strikes me most about this piece is the presentation of their core beliefs about the justice system in America: “The core tenet of Anglo-American law is that the burden of proof always rests with the person making the accusation.” What the board revealed is the ever-present reality that populations of color in this country know and experience daily, and this fact is symbolized in the very name of the board’s ideal legal system itself: Anglo-Saxon. The law is not as colorblind or unbiased as the justice system would have us believe. The law is not for the protection of all; it is for the protection of Anglo-Americans. It is a law to the exclusion of everyone else. This blog, using the outlined WSJ tenets as section headers, speaks to the presumption of guilt applied daily to marginalized populations without due process.

Tenet #1: The core tenet of Anglo-American law is that the burden of proof always rests on the person making the accusation. Non-whites do not get the benefit of the doubt, even when video evidence, witness statements, or 911 recordings indicate otherwise. For marginalized persons, few opportunities transpire to make an accusation or offer a defense. Consider any number of non-threatening Sikhs, Muslims, Native Americans, or Blacks who find themselves on the receiving end of the “fear” of a White person for their safety. The accusatory nature of white America against persons of color, especially Blacks, living their lives has become so galvanized that #whileblack is a social media phenomenon.

#WhileBlack spotlights White Americans willingly interfering and causing disruption in the lives of Black people. Whether a politician canvassing a neighborhood or realtor checking on a property or a White grandmother riding home with her Black grandson, White Americans usage of the police as quenchers of irrational fear may result in the death of another unarmed and unassuming citizen. A few months ago, a group of Black women packed their car following their vacation when White residents phoned the police, accusing the women of robbing the AirBnB house where they stayed. Even after pleading their case, the officers did not believe the Black women. A White student at Yale phoned the police on two different Black students on two different occasions because she believed they did not belong on the campus. Colorado campus police detained two Native American students visiting a university when a White parent complained that the boys seemed threatening because they did not say much during the tour. In addition to highlighting the direct and structural violence that non-Whites face over the course of the day, #whileBlack showcases that the mastery of accusation and othering heavily favors the dominant party.

Tenet #2: An accusation isn’t any more or less credible because of the gender, race, religion or ethnicity of who makes it. This tenet suggests that any accusation is worthy of address. Recent history, including accusations against Roy Moore and this current case, tell us that many Americans presume the innocence of white males in the entertainment industry and political arena over white women. Thus, revealing a gender bias. Just ask Bill O’Reilly, Les Moonves, and Louis C.K. Presently the exceptions to this rule are men of color like Aziz Ansari and Bill Cosby.

Accusations of sexual misconduct by women of color are often dismissed or discredited. In 1991, Anita Hill came forward with allegations against Supreme Court nominee Clarence Thomas. When Lupita Nyong’o said Harvey Weinstein sexually harassed her, Weinstein denied the possibility of it, despite more than 40 other women making similar and more explicit claims. This tenet, however, is inaccurate if you are Carolyn Bryant or Donald Trump. Carolyn Bryant lied to a judge and jury in 1955. With that lie, she sentenced Emmett Till, a 14-year-old Black boy from Chicago, to a lynching by Bryant’s husband and other family members. Donald Trump, in 2008, initiated and perpetuated the birther narrative about President Obama. Despite the release of Obama’s birth certificate in 2011, many doubt Obama and believe Trump.

Tenet #3: The right to cross-examine an accuser. This tenet is the crux of due process as exercised under the auspices of a third party, whether a mediator, a judge, or an adjudicator. “The denial of cross-examination is a major reason that campus panels adjudicating sexual-assault claims have become kangaroo courts.” The right to confront an accuser is a component of justice; however, in many cases of sexual assault and violence, there is an invoking of “boys will be boys” and/ or “that’s just what we did in high school and college” to bypass cross-examination and the potential for prosecution altogether. This flippant attitude is primary to the problem. A double standard has always existed when describing the sexual behaviors of men and women.

In conclusion, what is interesting is for all the chatter of due process in this piece, the WSJ editorial board fail to recognize that due process is exactly what the women who have stepped forward desire. Due process allows the accusers the opportunity to tell their sides of the story and Kavanaugh to tell his side. It allows for cross-examination and a committee of his peers to decide if he should find himself rewarded with a lifetime appointment to the Supreme Court. Due process should bring about a more just society and system.

If the failure to administer due process signals “the new liberal standard”, how does it apply to conservative-led initiatives? Republicans control the executive, the legislative, and the judiciary – in effect, the Republican party is the chief executor of due process in all branches of government. Are Americans to infer that government officials have not implemented the due process as standard operating procedure? If there is a failure of due process, the burden of responsibility falls at the feet of the Republicans.

Due process seems like an overarching ideal outworked in the request to receive all the documents concerning his judgeship so proper vetting could take place in preparation for the confirmation hearing. It seems like a logical next step when considering the “committee confidential” emails that should not have been confidential; if there is nothing to hide, given the presumption of innocence and blind trust this society is to have for its leaders. Why is a due process so important in this case and for this person but not for others?

Where are the demands for due process for the children stolen from their parents and held hostage by the government as migrant families seek refuge in a country that once held so much promise? Where are the demands for due process when unarmed men, women, and children are murdered in their schools or on playgrounds, or streets or in their homes? Where are the demands for due process for the thousands of survivors of abuse in the Catholic Church? Where are the cries for due process when individuals commit suicide because they experience bullying because of something they cannot change or choose?

Articles 6-12 of the Universal Declaration of Human Rights outline the basic tenets of due process. If Kavanaugh has nothing to hide and believes, as an officer of the court, that the system is just, then he should have no issue facing his accusers, calling a cross-examination, and letting the justice system work. Unless he knows the demands for due process are inequitable because justice is not just.

What is the meaning of “due process” as a component of the justice system, if a potential justice stymies the rights of accusers during his pursuit of a position in the highest court of the land as an executor of the justice system?

Child Marriage Threatens Human Rights

Child marriage is an institution of the past, only existing when life expectancies were short and women’s rights were nonexistent, right? It no longer happens in the United States. Surprisingly, both statements are false. Your grandparents might have married when they were teenagers, and you might think that they were so young to be taking such a major, life-changing step. But, did you know that your neighbors might be doing the same thing? That’s because child marriage is a current practice in both the United States and abroad. Legislation and organizations are working to end it. They hope to make it a practice our own grandchildren might hear about but never witness. In May 2018, John Carney, the governor of Delaware, signed a law that requires people to be eighteen years old or older to marry. This made Delaware the first state in the nation to outlaw child marriage. The state of New Jersey followed Delaware’s lead when governor Phil Murphy signed a bill in June that banned marriage for participants under the age of eighteen.

What Is Child Marriage?

Most U.S. children who marry under the age of eighteen are sixteen or seventeen years old;  however, some are as young as twelve. Some states do not even have a minimum age for marriage. This article follows the definition of the United Nations, which defines a child as an individual under the age of eighteen. The organization’s Convention on the Rights of the Child states: “For the purposes of the present Convention, a child means every human being below the age of eighteen years unless under the law applicable to the child, majority is attained earlier.” According to the UN, “the child, by reason of his physical and mental immaturity, needs special safeguards and care, including appropriate legal protection, before as well as after birth.” The United Nations hopes that these safeguards shield children from a number of harmful factors, such as child marriage and even certain government policies. The UN high commissioner for human rights, for example, decried the U.S. federal government policy of separating immigrant children from their parents in 2018.

Child marriage is common worldwide. How common? Some statistics estimate that in the next decade alone, 140 or 150 million girls will marry before their eighteenth birthdays. Some children marry as young as the ages of seven or eight. While some people claim that child marriage is the product of a specific culture, it is common across many cultures, ethnic groups, religions, and countries. India has many child brides in its large population, but the rates of child marriage are also high in African countries near the Sahara Desert, such as Niger.

What Are the Risks of Child Marriage?

Most of the people entering child marriages are female. Proponents of child marriage state that the marriages exist to protect girls from violence and sexual predators. They state that child marriage offers girls better economic futures. But, child marriage often exploits girls instead of protecting them. It often decimates the girls’ futures. Child marriage often makes girls victims of sexual predators instead of protecting them from such violence. Many child brides are forced into marriage to adult men. These marriages might help the men avoid arrests and prosecution for statutory rape. Human Rights Watch and other opponents against child marriage state that the practice perpetuates the continued sexual abuse of minors and gives legal permission for their abusers to do so without criminal repercussions.

If the child brides have children themselves, it can lead to medical and social problems. Sandra L. Hofferth states that teenage pregnancy can cause “low birth weight, complications of the mother’s pregnancy and delivery, and health problems associated with poor perinatal outcomes; greater risk of perinatal death; lower IQ and academic achievement later on, including a greater risk of repeating a grade; greater risk of socio-emotional problems; a greater risk of having a fatal accident before age one; and finally, a greater probability of starting one’s own family at an early age.” Marrying young can also wreak havoc with the young brides’ mental health. Le Strat, Dubertret, and Le Foll have found that females who marry in childhood are “more likely to seek and access health services.” These mental health conditions can include depression or drug addiction, two illnesses that can affect the mind and the body and can require extensive treatment. These studies both illustrate how child marriage can create mental and physical problems for young brides and their children.

Child marriages often prevent girls from furthering their educations or starting careers. These limitations, their often-limited legal statuses, and their young ages often make it difficult for young spouses to act as equal partners in their marriages. Often, child brides (and grooms) suffer physical, sexual, and/or emotional abuse from their older and more powerful partners, yet, their lack of personal agency and physical power renders them helpless and powerless to stop spousal abuse and seek divorce. They might not be able to legally divorce their spouses if they are under the age of eighteen, even though they were legally permitted to marry them in the first place. Child marriage, then, often creates victims who continue to be victimized for years, sometimes for their entire lives. Children when they marry, these brides encounter limitations that could keep treating them as children economically and legally.

How Are Politicians Addressing Child Marriage?

Politicians have voiced different opinions about the practice. Former New Jersey governor Chris Christie said banning child marriage entirely would “violate the cultures and traditions of some communities in New Jersey based on religious traditions.” His successor as governor, Phil Murphy, signed the bill to end the practice in 2018, however. Many U.S. states have provisions that allow people to marry under the age of eighteen, especially if they have parental or judicial consent. Some states allow girls to marry under the age of eighteen if they are pregnant and will allow children to marry whether they want to or not. Pregnancy is another reason some legislators use for supporting child marriage, arguing that marriage can help end the stigma sometimes associated with teen pregnancy (even regardless of whether this pregnancy is the result of rape). Legislators in other states, meanwhile, are echoing Delaware and New Jersey’s actions and establishing a mandatory minimum age for marriage. In 2018, the state of Florida passed legislation requiring a minimum age of seventeen to marry if the participants have parental consent and their prospective spouses are no more than two years older than they are.

New Hampshire passed a law that requires all participants to be at least sixteen years old to marry. Previously, boys had to be at least fourteen to marry and girls had to be at least thirteen years old. This law came after the New Hampshire House of Representatives failed to pass a law that would have raised the legal age of marriage to eighteen for both sexes in 2017. Other U.S. states allow minors to marry under the age of eighteen, often with specific requirements. The state of Virginia, for example, allows emancipated minors to marry. It also allows sixteen-year-olds or seventeen-year-olds to marry if they have parental consent. Different laws, thus, exist in different states. Could these differences create confusion and assumptions about child marriage? People might assume that children under the age of eighteen are prohibited from marrying everywhere in the United States, yet that is clearly not the case.

How Are Organizations Addressing Child Marriage?

Many organizations are also addressing child marriage. Unchained at Last is a U.S.-based nonprofit organization provides emotional, legal, and social support to girls and women forced into marriage. The website allows legal and mental health professionals to apply to offer their pro bono services to help females impacted by child marriage. The organization was also instrumental in the creation and passage of New Jersey’s law to end the practice. Given that child marriage is a global problem, it makes sense that international organizations also work to combat it. The International Women’s Health Coalition (IWHC) has partnered with two Cameroon-based groups that help females forced into early marriage, the Association pour la Lutte contre les Violences Faites aux Femmes (the Association to Combat Violence Against Women, ALVF) and the Association pour la Promotion de l’Autonomie et des Droits de la Jeune Fille/Femme (APAD). The APAD provides skill-building programs and literacy to help victims of forced or young marriage. The organization educates the girls and women in these marriages and their communities about human rights. The ALVF also supports girls in Cameroon, stating on its homepage that “Our Association fights against all forms of violence against women and girls in the Far North of Cameroon.” The two organizations share goals and a common lineage, as members of the ALVF formed the APAD.

Girls Not Brides: The Global Partnership to End Child Marriage (Girls Not Brides) is another international coalition of organizations working to end forced marriages for girls and other forms of child marriage. The organization developed a theory of change in 2014. According to its website, this theory includes strategies its organizers believe can end child marriage, such as

  • Giving girls power and agency, including educating girls about their rights to refuse marriage and helping them develop the tools they need to make their own decisions.
  • Working with communities and parents to raise awareness about the risks surrounding child marriage and the benefits of supporting the human rights of girls and women.
  • Developing programs and organizations to ensure that girls have access to education, health services, and other resources so they can refuse child marriage or thrive after they enter such marriages.
  • Creating and developing policy and legal structures, such as legislation to close loopholes that permit people under the age of eighteen to marry.

Girls Not Brides hopes that these strategies will help girls lead happier, more successful lives as well as end child marriage.

How Can You Help End Child Marriage?

Organizations are enlisting the help of others to address child marriage. Girls Not Bride suggests that people can

  • Share facts and infographics to help educate others about the issue.
  • Use social media to discuss child marriage.
  • Sign petitions to generate attention about forced marriage and child abuse.
  • Donate to organizations around the world who work with affected young people.

Although many citizens of Western countries may not be aware that child marriage is a problem, it does in fact exist and often in their own communities. Child marriage has far-reaching, lifelong consequences. Ending it can improve the lives of girls and women worldwide.

THE NEW POOR PEOPLES CAMPAIGN: THE SOCIAL MOVEMENT YOU NEED TO KNOW

We are coming to Washington in a poor people’s campaign. Yes, we are going to bring the tired, the poor, the huddled masses…. We are coming to demand that the government address itself to the problem of poverty.”Reverend Dr. Martin Luther King Jr., 1967

In his last sermon, King echoed the words on the base of the Statue of Liberty to call for national and global attention to address the dire economic circumstances of the poor. He and others founded the Poor People’s Campaign to influence how Americans view poverty. While the 1960s are behind us, poverty is not. A new organization, a new Poor People Campaign, aims to address continuing economic privation.

Dr. King and the Southern Christian Leadership Conference organized the Poor People’s Campaign (also known as the PPC and the Poor People March) following sustained civil rights action and hard-won legislation. These actions and laws included bus boycotts, sit-ins, freedom rides, the formation of the Direct Action Task Force, and the passage of the Civil Rights Act of 1964 and the Voting Rights Act of 1965. From its beginning in 1968, the PPC advocated wages that were high enough to support a “decent life.” It strove to become a powerful, social force to change how America understands poverty and worked to end it. It criticized the portrayal of stereotypes of the nation’s poor as dirty and unhealthy. The Poor People’s Campaign was a populist struggle against economic inequality and a reform movement that questioned how race related to economic and political power. Poverty and prejudice were “related enemies,” according to King. He believed that the poor could effectively confront the power structure if they had economic security, expanded education opportunities, improved housing, and unemployment income.

King recognized that poverty, racism, and power were (and are still) intricately linked. He claimed that, “African Americans are not truly free until they reach economic security.” In 1968, a PPC brochure proclaimed, “Poor people are kept in poverty because they are kept from power.” The organization lobbied against dehumanization and poverty wages. It advocated for changes in the federal food program and a significant expansion of food stamps.

Even though King mentioned “racial imperialism” as the primary cause of poverty among African Americans, his anti-poverty proposals were not limited to black Americans.

A committee of hundred religious leaders from several racial backgrounds helped organize the PPC. More than fifty multiracial organizations attended the first meeting in Atlanta, Georgia, in March 1968. Attendees hoped to organize a march of thousands of people on Washington, DC to unify the nation. These plans shattered with the assassination of Reverend King in Memphis, Tennessee, on April 4, 1968.

Following this blow, the key leaders of the PPC, including the SCLC’s new president, the Reverend Ralph Abernathy and King’s widow Coretta Scott King, worked to coordinate a new march on Washington, DC. Their goal was to pressure Congress to pass legislation to address employment and housing issues as well as fund a war on poverty. The planned PPC march of 1968 divided into three stages. The first stage was the creation of Resurrection City, a makeshift town at the National Mall from Washington Monument to the Lincoln Memorial. In May and June 1968, this 15-acre urban area served as the home of 1,500 to 3,000 occupants of different racial backgrounds. Resurrection City included a makeshift city hall, a clinic, a general store, and a day care center named for Coretta Scott King. Even though these amenities only covered the bare necessities, some residents received medical attention for the first time in their lives. According to the new PPC, such conditions persist in 2018, as many poor Americans lack health insurance or adequate medical care.

Resurrection City became a symbol for the PPC and made poor people and their fundamental human rights visible to the world. Sidney Poitier, Marlon Brando, and Barbra Streisand visited Resurrection City, reflecting the attention the encampment received and illustrating the longstanding relationship between celebrities and social issues that continues to this day. The activists arrived from nine regions of the country in groups called caravans. They camped in tents and endured terrible weather that brought severe rain and mud, forcing many residents to build primitive A-frame homes. Resurrection City’s permit expired on June 23, 1968. Police forcibly evicted people (sometimes with tear gas) from the settlement the next day. The second stage of the march would have consisted of hallmarks of the civil rights movement: civil disobedience, nonviolent mass demonstrations, and police arrests. The third stage of the march was a planned national boycott of large industries and shopping areas to pressure business leaders to acknowledge the movement’s demands.

Resurrection City and the other actions organized by the PPC did not produce the results King, the SCLC, and other activists had envisioned. The assassinations of Reverend King and Senator Robert F. Kennedy, and the Vietnam War hurt the movement causing many to blame Resurrection City leader Reverend Abernathy for the movement’s lack of leadership and disorganization. Racial prejudice, social frictions, and tension between Southern and Northern citizens eroded the movement further. While the movement was down, it was not out. While the Poor People Campaign’s proposed antipoverty legislation did not occur, the organization’s actions did continue discussions about poverty, race, and power. These sustained conversations helped contribute to the launch of the new Poor People’s Campaign (also known as the new PPC or the Poor People’s Campaign: A National Call for Moral Revival) in 2018. Like the PPC of the 1960s, the new PPC consists of a diverse coalition of activists battling poverty and racism, white supremacy, and greed.

Led by Reverend Dr. William J. Barber II, a Disciples of Christ minister and the leader of the Moral Mondays Movement in North Carolina, and the Reverend Dr. Liz Theoharis, a Presbyterian minister and the co-director of New York’s Kairos (the Center for Religions, Rights, and Social Justice), the new PPC calls for a national moral revival. The organization claims that although the United States is among the wealthiest of nations, it harbors severe economic inequalities that have persisted for decades, even centuries. Americans continue segregation by their living wages, according to the PPC. The organization has chapters in most U.S. states and strives to highlight problems associated with poverty and inequality. The new PPC worries that recent U.S. federal tax cuts for businesses and the wealthy have hurt less affluent members of society. Additionally, organizers reveal concern with increased funding to battle illegal immigration and illegal drugs, which can lead to rampant addiction. It fears that this funding detracts money and attention away from much-needed poverty programs.

To counter such power imbalances, the new PPC hopes to see a reinforcement of the Voting Rights Act to reduce the voting suppression of convicted felons. The modern-day activists of the new PPC argue that negativity surrounding poverty in America has persisted for centuries. They argue that an entrenched culture of racism and discrimination exists within the economic and political systems of the United States, and favors those with large bank accounts. The new PPC wants people to reconsider how they think about poverty. It emphasizes that poor people are victims of a power struggle, not moral failures. It asks for a moral revival to combat

  • While the U.S. economy has grown, the inequity between the richest and poorest Americans has also grown. Many lack money and health insurance.
  • Systemic racism. Imprisoned African Americans who are unable to vote, African American residents of Flint, Michigan grappling with a tainted water supply, and Muslims and immigrants facing discrimination are all examples of racism in American society.
  • In 2017, the U.S. federal government spent $190 billion on antipoverty programs while it spent $668 billion on the military.
  • Ecological destruction. Flint’s tainted water illustrates how ecological problems and pollution often affect minorities and the poor, who do not have the economic or political means to combat such problems.

The new PPC also boasts some familiar faces. Bernard Lafayette, a friend of Reverend King and the national coordinator of the first PPC, joined organization to train a new generation of PPC activists.

The question remains whether the new PPC will encounter the same problems Reverend King and other organizers faced during the 1960s: Is the message heard and received?

New PPC activists arrived on Capitol Hill on February 5, 2018, to deliver their message of economic justice to the U.S. Congress. The Capitol Police asked them to leave before they gave this message. Fifty years after the formation of the first Poor People’s Campaign, it is clear that its messages and struggles endure. The new PPC organized a 40-day event in May to late June 2018 that featured nonviolent action by the poor, clergy, and sympathetic allies. Echoing the inclusiveness of the 1960s, this movement united people across race, economics, religion, gender, geography, and sexuality. Similar to the 1960s, the event featured acts of nonviolent civil disobedience, teach-ins, workshops, cultural events, and other activities. The 40-day event culminates tomorrow, June 23, in Washington, D.C. for a rally to Stand Against Poverty, Mass Rally & Moral Revival. Although the event ends, participation can continue in various activities by

  • Joining an organization. Whether people join the new PPC or another organization, people can provide strength in numbers.
  • Speaking out. Writing to political representatives, media outlets, and social media sites can help spread the message.
  • Voting and helping others vote. Voting is another way of voicing opinions. Working at polling places, encouraging others to vote, and working for voting rights helps gives agency to more people.

With spring break and summer just ahead, did you know you have a right to leisure and rest? It is in part because of Eleanor Roosevelt and the 18 representatives chosen by the Economic and Social Council in 1948, tasked with drafting the Universal Declaration of Human Rights (UDHR), a document that would become a cornerstone of peace around the world. Article 24 of the UDHR pronounces, “everyone has the right to rest and leisure, including reasonable limitation of working hours and periodic holidays with pay.” Researchers, writers, and business insiders market the right to leisure and rest as work-life balance. Harvard Business Review has an entire section of its current and archive database dedicated to the subject.

What is the right to leisure? Leisure is a part of the second generation of human rights. Roosevelt ascribed each right as a component of the “inherent rights of all individuals, without which no one can live in dignity and freedom.” In other words, it is a basic human right. She notes that the UDHR carries moral weight but no legal weight, thus making it easier for violations to occur. Often, governments through repressive systems and structures are responsible for human rights violations; however, the violation of leisure is often self-imposed.

A 2014 Gallup poll revealed that 42% of the polled full-time employees work 47 hours a week while 40% work 40 hours, and 8% work less than 40 hours. Ran Zilca suggests more people want community and relationship over a paycheck, but have not verbalized the desire for a job that will bring fulfillment. He concedes that unnamed values magnify discomfort and distress, clouding perspective. Age is also a factor in finding work/life balance. When all is said and done, work happiness depends on several factors, including having a life outside the office and possessing money to enjoy it.

The notion of “work/life balance” is recognized across the world as a difficult goal to attain because the lines between work and life are blurred. Paula Caproni, working wife and mother of two children under four, explains that achieving the Zen-like status of full balance is easier said than done, especially for the well-intentioned. Citing Martin and Knopoff, who assert, “it is not a stretch of the imagination to consider that a root of the work/life balance tension is that caretaking work in one’s own home—typically done by women—is undervalued and unpaid, and until this fundamental issue is resolved most other attempts that try to resolve work/life tensions are likely to be superficial at best”, Caproni hints that work/life balance is more about the flexible sharing of the work/life load, rather than the circular nature of devaluing the half often associated with women, prioritizing individualism over familial (or community) interaction, and misapplied excellence in the workplace. She acknowledges that the disconnection between the idea of work/life balance and the practical application may disappoint many who discover life values “do not fall into clean dichotomies that lend themselves to trade-offs or prioritization.” In other words, every attempt to compartmentalize one part of life from another will create frustration, disillusionment, and isolation since the ideal is unattainable. Caproni established rest amid the unpredictability of the ‘imbalance’ by embracing “tranquility over achievement, contribution over success, and choice over status”, creating an internal dialogue that helped to name essential values, changing both life and work accordingly.

David Maume states, “Research has looked at the symbolic meaning of time use and linked it to a person’s identity.” Men and women have different perspectives when approaching and participating in vacations. Gender roles plays a significant role in how often and if vacations happen in the lives of people. Generally, while on vacations with families, women are tasked with meeting the emotional and physical needs while men focus on work-related tasks. On one hand, women sacrifice their personal enjoyment for the sake of others, seeing vacation as an enjoyable ‘disruption of work’ that allows “work on daily family life and cement bonds between family members.” On the other, a man’s career and subsequent job concerns may lead to a limited presence or total absenteeism on vacations. He concludes that men, aware of misplaced values in the past, desire to spend more time with their children–making significant changes to create a more egalitarian home environment or staying home full-time while wives work outside the home. This decision is countercultural and sometimes detrimental to a career.

The acknowledgement of values should remain a priority of an employee, and at minimum, recognized by an employer. Sanghamitra Buddhapriya introduces three key concepts in her essay, “Balancing Work and Life: Implications for Business”: work-family, the guilt complex, and time sovereignty. She argues that work-life balance is not just a reduction in working hours. It is flexibility that allows for the removal of the guilt complex because the control of time has been entrusted to capable, motivated employees, seeking to dedicate themselves to work and family. First, work-family balance seeks out the space achieved when an employer sets, creates, and promotes an environment for an effective balance. The tension of work and family is complicated by typical business culture which emphasizes long hours means more devotion, scheduling conflicts and absenteeism are evidence of noncommitment, and time constraints implies time mismanagement or “role ambiguity”.

Second, the guilt complex magnifies the tension of work and family since domesticity is often attributed to women. Buddhapriya points out that within male dominated organizations and societies like India, women “face a dual burden” of having career aspirations and family goals. “Working women and their spouses continue to regard breadwinning as essentially a man’s job and home management as a woman’s job… women continue to bear the burden of household responsibilities regardless of their employment status.” Due to the weight of the burden, women, especially mothers, may be forced to ‘trade-down’ to part-time jobs, taking jobs for which they are overqualified, or make their career subordinate to that of their husband (Budig 2001, Correll 2007, Gash 2009).

Lastly, time sovereignty places responsibility to organizational commitment in the hands of the employee, citing an ability to manage life stressors and job stressors more effectively, improving work performance and satisfaction. Time sovereignty is not unaccounted time; it is a flexible work arrangement. Using Marriott International, Aetna, UPS, Hewlett-Packard as examples of companies utilizing time sovereignty, Buddhapriya reaffirms that the best employers have cultures and policies which promote a meaningful and supportive workplace, company productivity, movement towards gender equality, and organizational mobility and retention.

Leisure is defined as free time. It is an opportunity afforded by free time to do something that renews, refreshes, and destress you. Leisure is unhurried ease. It is sleeping until 10am or gardening or reading your favorite novel. Taking a trip to a foreign country or to Wyoming or learning to play an instrument. It is about binge-watching a television show and stopping to smell the gardenias by yourself, with a friend, or with family. It is your time and right so do what you want with it.

Continuity and Change on the Korean Peninsula

**As Kim Jong-un and Donald Trump prepare for the North Korean Summit in Singapore on Tuesday, this repost from last Spring sheds light on the complexity and seriousness of this summit.

A lot has been said recently about the seemingly worsening relationship between the US and Democratic People’s Republic of North Korea (DPRK). Unsurprisingly, much of the commentary revolves around the Trump Administration at a time where the new President seems confronted by numerous international “situations.” The dropping of a MOAB in Afghanistan and missile strikes against Syria, when taken together with heightened tensions between the US and the DPRK, paint a broader picture of the direction the Trump Presidency is taking. While this may be helpful to Americans as they try to understand their President’s decisions, putting Trump as the centerpiece of analysis has the dangerous potential to obscure other important factors, namely the continuity and change that has marked the US-DPRK relationship. Only by including both in our analysis can we begin to understand the events unfolding on the Korean Peninsula.

Change

Like any relationship, that of the US and DPRK does not exist in a vacuum. Their bilateral relations are well known. Diplomatic efforts have failed to yield real progress towards a resolution of the tensions on the Korean Peninsula, much less move towards a sustainable arrangement between the parties involved there. Border incidents that have claimed the lives of South Koreans, North Koreans and Americans have been ongoing for as long as the current border has existed. These incidents have, of course, been the cause of heightened tensions at different times between the US and DPRK.

The relationship is also subject to changes in the international environment. Authoritarian practices in South Korea following the end of the Korean War forced the US to consider what exactly the South Korean people had inherited from the devastating conflict. The terrorist attacks of September 11th 2001 raised concerns of nuclear terrorism and therefore nuclear proliferation more generally. The growing power of China in military and economic terms continues to raise the significance of the steps they are or are not willing to take in trying to tackle the issues at hand on the Korean Peninsula. These and other global trends influence the measure of significance which the US attaches to the Korean Peninsula at any given time; and the way by which they choose to engage with the DPRK.

There is no doubt that the election of Donald Trump could be, or cause, another significant change in the US–DPRK relationship. Of central importance is Trump’s demonstrated impulsive and inconsistent behaviour, especially when it comes to how he communicates with others. He differs from other Presidents because not only are the policies towards adversaries and allies in question, but as an international community, we find ourselves wondering how he will behave on a more basic level. Will he put aside basic and long-standing diplomatic decorum, aggravating other world leaders with hostile rhetoric akin to what he employed during his campaign for the Presidency?

The same countries and their leaders that Trump dealt out insults to as 2016 ticked by are the same countries and leaders that he must deal with in 2017.

Of more concern is whether Trump will be able to communicate a clear message to adversaries at all. It remains to be seen whether Trump can frame the many public announcements he has to make in a way that appeals to his domestic support base (something all politicians do) but also conveys the US’ position on important matters to other world leaders, adversary and ally. Doing this requires consistency and coherency across the many mediums through which the President now communicates: social media, informal television interviews and formal White House events and statements. The outlook is not good so far.

It has been widely reported that the Trump Administration’s statements regarding the DPRK have been hostile and inflammatory. This is undoubtedly true. An important aspect to note is that through deliberate decision-making or gaffe, much of the communication by the Trump Administration has created confusion among the parties invested in the Korean Peninsula.

I will explain this point using two examples. First, the vague statement released by Secretary of State, Rex Tillerson, following a recent missile test by the DPRK and Trump’s refusal to answer questions on the matter on American television. Trump has long promoted the idea that not to reveal his next move is, in and of itself, a smart move. The issue is that when states do not want to fight over an issue, they seek information about how far they can push their luck, making as large a gain as possible (whether this be in terms of prestige or something more material) while avoiding direct conflict. In other words, they attempt to discern when to yield. To do this, a state must have some idea of what their adversary is willing and/or capable of doing to resolve a dispute in their own favour.

For all the absurdities of the North Korean regime, it is highly unlikely that they want to ever see a direct confrontation with the US. Vagueness on the part of the Trump Administration keeps the DPRK in the dark as to where the line is and increases the chance that they will trip right over it. The DPRK wants to make gains in the form of developing its missile capability. Trump needs to find a way of communicating to their leadership when, where and how the US is willing to act; therefore, talks with DPRK are far from being complete.

The second example is the mistake made by Trump and other officials when an “armada” heading towards Australia was said to be heading in the direction of North Korea. Inaccurate information compounds all the issues related to ambiguity mentioned above. What is more, this error unsettled South Korea with politicians and media outlets questioning Trump’s will and ability to deal with the DPRK. This response should, perhaps, not be unexpected. Given their common border, the DPRK could inflict massive damage on South Korea through conventional weapons alone. Similarly, Japan feels threatens due to their proximity and the 50,000 US troops stationed there. Experts vary in their predictions of by which date the DPRK could develop a missile capable of reaching the US.

Taking these two examples together, while it is clear the rhetoric emanating from the White House is inflammatory, it is less clear whether it is effectively conveying information to the parties involved regarding America’s stance and intentions.

It is important to say that this is not simply a matter of finding Trump to be a distasteful person. His public performance in dealing with this issue is of real significance. While academics debate whether rhetoric utilised by politicians has any influence over the course of events in foreign affairs, policy makers themselves seem to place great importance on the public pronouncements made by state officials. In reading the autobiographies of former US Presidents, one quickly realises that they believe their words are important in directing the course of events; therefore, we should not be surprised that politicians place a lot of value in their own words! The South Korean response to Trump’s mistake in stating that the US was sending an armada towards the Korean Peninsula is an indicator of the importance that other world leaders place in the statements of their colleagues. Trump’s statements can heighten tensions with adversaries and offend allies whom he claims he would persuade to take more of the financial burden of dealing with said adversaries.

Regarding the DPRK, few governments, if any, are so committed to the “performance” of governance. Large portions of the DPRK’s state structure are committed to promoting the party line to both the domestic population of North Korea and the international community. Strict media and Internet control by the state demonstrates the significance attached to the control of public information.

DPRK officials do this precisely because they know that other state leaders and intelligence agencies monitor speeches by regime officials, television broadcasts, and internet traffic, to read between the lines and get a better picture of what happens in their secretive society. Similarly, they would remain committed to trying to glean information from the televised interviews, public speeches and, yes, even tweets of Donald Trump’s Administration. To think otherwise is naïve.

Continuity

It is easy to allow our focus to drift too quickly to new developments in this unfolding situation. Some elements of the continued tension between the US and DPRK, while not as exciting or topical as Trump’s Presidency, are equally as important in explaining the current state of affairs. One such element is the presence of nuclear weapons. Three parties involved in the dispute, the DPRK, US and China, are nuclear capable to one degree or another.

In an indictment of nuclear deterrence theory, the very manoeuvres–diplomatic, military and otherwise–that both the US and DPRK make due to the significance they attribute to a dispute in which nuclear weapons are involved, may be the very thing that, deliberately or otherwise, spark the use of military force on the Peninsula. Even if it were true that, as proponents of nuclear deterrence advocate, weapons of mass destruction make the cost of entering and engaging in conflict so high that no reasonable state leader would consider doing so, the constant need to balance armaments leads to an arms race that only serves to heighten the tensions one wishes to avoid, increasing the risk of unplanned escalation. It should not be lost on us that this current round of tensions was triggered, in large part, by exactly this: the DPRK undertaking missile tests. Moreover, as explained below, not only could state leaders consider using nuclear weapons despite knowing the consequences, they have!

It is simply a convenient out to equate the problems generated by nuclear weapons with the current occupant of the White House. Throughout his presidential campaign, the question of whether (Trump) was the “type of person” that we would want having control of the US nuclear arsenal was often raised. While this question is reasonable at face value, it suggests that the threat of nuclear weapons does not have so much to do with the weapons themselves as the person empowered to use them or the state that possesses them.

As to the last point, having to ask this question of US electoral candidates belies the idea that certain types of states can be trusted to possess nuclear weapons. One could argue that democratically elected leaders must consider domestic support for a decision to use nuclear weapons, whereas dictators do not. However, of all the situations in which we can imagine decision-makers considering the use of nuclear weapons, cases in which contemplation could be given to domestic support for the idea make up only a small portion. It is likely that such a situation would be characterised by small time-horizons and partial information. If nothing else, it is perfectly consistent with democratic systems that a person we would not want in charge of nuclear weapons can be elected.

Here we are back to the notion of whom. If there are types of people we cannot trust to be in charge of nuclear weapons then perhaps there are types of people that we can trust too?

In the well-known documentary, The Fog of War, in which Robert McNamara imparts lessons from his life, he describes the parties involved (and the world) as having “lucked out” in avoiding nuclear confrontation during the Cold War and the Cuban Missile Crisis. Regardless of what one thinks of John F. Kennedy, perhaps it is not too strong to say that he was a more experienced political operator than Donald Trump. Yet, even JFK and the leaders of the Soviet Union and Cuba–all rational people, per McNamara, came exceptionally close to making decisions that could end their societies, as they knew them. McNamara concludes the combination of human fallibility and nuclear weapons will destroy nations. This is not due to the character of one particular person but the inescapably imperfect process of human decision-making.

The failure to understand both the current events and long-term processes at work in this situation has consequences beyond a lacking analysis. Trump and the members of his administration need to be included in any understanding of US-DPRK relations. On one hand, the Trump Administration undoubtedly plays a role in determining the course of events regarding the Korean Peninsula, so attempts to downplay the administration’s significance is to remove their accountability for the dispute’s trajectory. On the other hand, to ignore ongoing issues, such as the presence of nuclear weapons in this dispute, suggests a fatalistic perspective where the resolution of all international affairs rests on the shoulders of one person – the US President. There are a multitude of drivers of this conflict and thus a multitude of levers that can be pulled in trying to steer the course of events towards a peaceful resolution. Groups of concerned people tackling the issue of continued nuclear stockpiling are only one example. While we rightly continue to understand our political leaders’ decisions, holding them to account for the consequences thereof, it is important to remember that they are not the sole causes or agents of social change.

A Peculiar Request: The Right to Life

This is the first school shooting I remember. All these years later, I still remember what I thought once I saw the photos: “How did this happen? Surely this is a random tragedy that will never happen again.” The writing of this blog comes just over five weeks on the memory side of the Marjory Stoneman Douglas High School shooting in Parkland, Florida and on the same day as the Great Mills High School shooting in southern Maryland. The shooting at Heath High School is a distance memory, eclipsed by Columbine High School in Littleton, Colorado, Sandy Hook Elementary in Newton, Connecticut, and Huffman High School in Birmingham, Alabama.

Many conversations and references, in recent weeks, center on the complicated nature of the gun control debate in the United States (US) due to the Parkland shooting and uncharacteristic demands of the teenage survivors. This blog does not directly address those conversations or references. There are many sides to the issue and other blog writers this week gave voice to some of those issues. Therefore, this blog explores the peculiar request of the teenage survivors, which is, seemingly lost among the defense of the Second Amendment.

The right to life.

It seems peculiar that children are demanding adults to protect their lives, to look out for their best interest, specifically when many in the US pride themselves on their pro-life stance. They champion every bill, legislative act, or protest which positions them as the protector of the “rights of the unborn”. As protectors of the unborn, they label women who choose to have abortions and the medical practitioners who perform the abortions as murderers. Some pro-life advocates stand outside Planned Parenthood centers, shouting vile, hurtful words and phrases at patrons and workers. They object to numerous women’s rights issues. All this occurs because of their belief in protecting the innocent, unborn baby who deserves the right to live.

Where are the pro-life advocates joining the protests initiated by the Parkland students who are demanding the protection of their right to life? These children lost their innocence when their classmate murdered their friends and teachers in hallways and classrooms on Valentine’s Day. Many pro-life advocates are standing on the sidelines, protecting their Second Amendment constitutional right to bear arms. Yet, at what point did adults abdicate their responsibility to protect the lives of children to protect their rights to own weapons? Does the “pro-life” label still apply when there is a willful and complicit allegiance to a hobby and lobbying group than to children?

Perhaps a reclassification needs to occur wherein we label pro-birth rather than pro-life.

The Convention on the Rights of the Child (CRC), in accordance with the Universal Declaration of Human Rights (UDHR) asserts, “A child means every human being below the age of eighteen years… [and] in all actions concerning children, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities or legislative bodies, the best interests of the child shall be a primary consideration.” When the best interest of the child is the primary consideration, how has the brutal transformation of schools and universities continued? It seems implausible that for the last 20 years, parents across the US have sent their children to school with hopes and dreams for the future, only to have to bury their 5-18-year-old days later. The Children’s Defense Fund (CDF) reports “children are learning there is no safe place in America.”

When No Place is Safe and Those Who Can/Should Help, Don’t

The US is the ONLY member of the United Nations to not ratified the CRC.

The cliché ‘no parent should have to bury their child’ seems redundant considering needless tragedies of gun violence. Its redundancy comes from the very real reality that pictures and videos from schools, universities, and playgrounds, as well as the rhetorical thoughts and prayers of government officials has yielded minimal results. Unlike natural disasters like tornados and earthquakes, controlling the impacts of gun violence is possible as evidenced in Australia, Great Britain, and Switzerland. Therefore, it is the normalization of violence in the US which continually isolates us from the rest of the world. Data reveals the hypocrisy of the ill-spoken narrative that children are the future of this country. CDF reveals

  • Children are forced to witness tragic mass shootings that occur with regularity in public spaces including schools, churches, concert venues, community centers, nightclubs and movie theaters.
  • Since 1963, the number of children and teens killed with guns on American soil was more than three times higher than the number of U.S. soldiers killed by hostiles in wars abroad. Nearly 180,000 children and teens died from guns in the U.S. between 1963 and 2015.

With less than 5% of the global population, American civilians own 310 million guns (35-50%) of the global civilian gun-ownership, whereas the US military and law enforcement possess nearly 4 million. The US spends considerably more on defense than on early childhood and education, than every other country with smaller federal budgets.

Children are not a priority in the US.

 Who’s doing the shooting?

Brown et al. analyzed two cases, identified four characteristics, and concluded “school violence is a somewhat distinct form of aggression that should not be viewed through standard lens.” The typical mass shooter is a white male who exacts revenge on those he deems dishonored him in some way. Research identifies this cultural phenomenon as “culture of honor”. In a culture of honor, people favor the death penalty, more tolerant of expressions of aggression as a response to threats/insults, and conflate a high degree of connection with status or reputation. This culture fuels the overall feeling of slight through a lack of interpersonal conflict resolution skills. The culture of honor creates a cultural standard wherein brutality becomes the recommended response to a perceived affront to one’s dignity or reputation; thus, a misguided sense of justice.

This misguided sense of justice positions whites as unapologetic for the behavior of shooters. Mingus and Zopf studied four mass shootings: two with white shooters (Columbine High School and Northern Illinois) and two with non-white shooters (VA Tech and Fort Hood). Using “Racial Formations” by Omi and Winant as a key text on racial projections, Mingus and Zopf assert, “The historical significance of race is important in understanding the way in which race affects any interpretation of shooting rampages.” They find that white privilege allows for the addition of race as a factor when identifying the “abhorrent behavior of non-whites” and the subtraction of race when redirecting “focus away from whites as a distinct population by pathologizing their aberrant behavior”. They conclude that non-whites groups often advocate for themselves as a means of not facing retaliation, even offering an apology in the VA Tech tragedy, whereas being white means never having to say you are sorry.

“If they’re old enough to be shot, they’re old enough to have an opinion about being shot”

Reports occur daily of the ‘perceived threat of children’ when confronted by white people who feel a threat to their power or status. These reports extend beyond the scope of school shootings, and the requests to “stop killing us” commenced long before the Parkland shooting. The #NeverAgain movement includes the voices of the seemingly voiceless by including students from Chicago, Newtown, and 11-year-old Naomi Walder of Alexandria, VA. Walder, who highlights the deaths of Black girls forgotten by the media, organized her classmates during the National Walkout Day.

Political satirist and late-show comedy host Trevor Noah challenged the notion leveled by Fox News talking head Tucker Carlson after last week’s student walkout campaign. During a segment, Carlson questioned the validity of students making demands of lawmakers regarding guns by stating, “They’re not citizens; they’re children.” What’s interesting is that children are too young to make demands for gun control but not to find themselves in adult prison or forced into child marriage. Noah responded brilliantly stating, “…if kids are old enough to be shot, they’re old enough to have an opinion about being shot.” When processing the numbers provided by the CDF, it is time someone said something.

  • 7,768 children and teens were killed in the US to gun violence during 2013-2015
  • 113 children under five (5) died from guns in 2016, compared to 65 law enforcement officers killed by guns in the line of duty. Guns were used in criminal acts to kill 62 law enforcement officers while three (3) were killed in gun accidents.
  • In 2016, 43% of gun deaths were among Black children and teens, although they made up only 14% of all children and teens.
  • 1,335 Black children and teens were killed by guns in 2016, one every 6 hours and 34 minutes.
  • The gun death rate for Black children and teens was nearly 4x that of White children and teens and more than 8x that of Asian and Pacific Islander children and teens.
  • Most gun deaths among Black children and teens were by homicide. Most deaths by White children and teens were by suicide.
  • Guns are more often used to cause harm than in self-protection. A gun in the home makes the likelihood of homicide 3x higher, suicide 3-5x higher, and accidental death 4x higher. For each time a gun in the home injures or kills in self-defense, there are 11 completed and attempted gun suicides, seven criminal assaults and homicides with a gun, and four unintentional shooting deaths or injuries.
  • More than half of youth who committed suicide with a gun obtained the gun from their home, usually a parent’s gun.

Given the fact adults consistently prove children are not a priority in this country, children have made an opportunity to make themselves a priority.

Today, millions of children and adults domestically and internationally, participated in the #NeverAgain movement by joining the March for Our Lives protest. The campaign is not to initiate a disarmament; however, it is to reinstate the ban on assault rifles like AR-15 used in several mass shootings, including Las Vegas and Orlando. Additional demands include an expansion of background checks and a rise of the minimum age to purchase. At the core of the demands and the purpose of the protest lies a peculiar request for the most important human right: the right to live.

A right to a life without fear and terror.

A right to a life where adults apologize for hurting, neglecting, and not prioritizing children who are reliant upon them.

A right to a life without the trauma of relieving the horrors of running to save myself.

A right to a life that does not include witnessing my friends and teachers die before my eyes.

A right to a life by enjoying the full scope of childhood and adolescence which includes mistakes that should not end life because of a perceived threat

A right to a life because adults believe that I and my future are worth fighting for… just as they do for the unborn.

Child marriage and the human rights of girls

Delaware, on May 9, 2018, became the first US state to prohibit child marriage, removing loopholes and exceptions that currently exists in marriage laws in every other state. This historic legislation–the first of its kind in the US–champions and protects the rights of children, especially girls. **This blog is a repost from 2016.

Imagine for a moment that you are a 13-year-old girl. Your parents are no longer as cool as they were when you were in elementary school but life on the whole is pretty chill. With the exception of awkward junior high encounters with people of the opposite sex, the occasional bully, unbearable PE class, and dreadful puberty, being a kid isn’t awful. Personally, you’ve graduated from earning coins for your chores to actual dollar bills and from having a pink room filled with stuffed animals to one with posters of your favorite boy band and magazine cutouts of women you want to dress like when you turn 18. At 18, real life happens. At 18, you’re an adult and the whole world knows it! Everything about your 13-year-old life is moving towards adulthood until your parents let you know that one of their friends is interested in marrying you. He is a nice man who is at least 10, 20, 30 years older than you so he will be able to take care of you, just like you were his own child. Except that you would not be his child, you’d be his wife. In all the ways a wife takes care of a husband…

 

Children are not small adults. They are molded by socialization as a result of the physical and cultural contexts of their lives (Boothby, 2006; Goodhart, 2013). They are vulnerably presented and completely dependent upon adults, typically parents, for the purpose of nurturing potential and protecting innocence (Garbarino, 1991). Garbarino asserts, “childhood is a special period in the life course when we shield the individual from the direct demands of the economic, sexual, and political forces of the adult world” (p. 10). Childhood is the loci for growth and development.  

The United Nations International Convention on the Rights of the Child (CRC), signed in 1989, defines who qualifies as a child and outlines ideas on how to care for those most vulnerable among us. For the purpose of this blog post, I will appropriate the definition of a child as defined by the CRC:

The Convention defines a ‘child’ as a person below the age of 18, unless the laws of a particular country set the legal age for adulthood younger. The Committee on the Rights of the Child, the monitoring body for the Convention, has encouraged States to review the age of majority if it is set below 18 and to increase the level of protection for all children under 18.

The notion of childhood was recognized as law by the international community with the passage of the CRC (Garbarino, 1991; Goodhart, 2013). The childhood experiences of the female differ so dramatically from the male. In 2013, Malala Yousafzai’s speech to the UN leadership, reintroduced the female experience into the global narrative as she requested improvement for and protection of the rights of women and girls. There is a significant disparity and cultural bias when attempting to define the daily lives of children, particularly girls, living in the global South and developing nations as compared to those in the global North and developed nations (Boothby, 2006). The United States of America is the only country in the world that has not ratified the CRC.

Child marriage is legal in the United States. In Massachusetts between 2010 and 2014, 200 children were married. The state does not have a “minimum age to get married, as long as minors receive judicial approval. Minors don’t need a lawyer, and the petition is only half a page. Parental approval is required, although with several exceptions.”

There were 4,500 children married over the course of 2004-2013 in the state of Virginia, and more than 200 of them were under the age of 15. On July 1, 2016, the state of Virginia passed a law that only adults could marry in the state. This new law replaced portions of the marriage law that had allowed for girls “13 or younger to marry if she had parental consent and was pregnant.” The new law has set the minimum marriage age at 18 but it also allows for emancipated minors of 16 to enter into marriage if a judge decides to overrule the law. Judges have the power to overturn this newly implemented law on the basis of four ideas:

  1. If the minor is not being compelled to marry
  2. If the parties are mature enough to get married
  3. If the marriage will not endanger the minor
  4. If marriage is in the best interest of the minor

Child marriage is illegal in some parts of the world, although it is common. Guatemala has recently increased the age of marriage to 18, while acknowledging there will need to be a cultural paradigm as to the relevant implication of “recognizing the full potential of girls and reframing how girls should be treated in society”. In Nigeria, child marriage is illegal; however, in the Northern, predominantly Muslim region of the country, the law is implied rather than enforced. Fifteen year-old Nigerian Wasila Tasi’u is a murderer. She poisoned her 35-year-old husband and three other men. For ten months, Tasi’u awaited trial in a Nigerian jail where she faced the death penalty. She was acquitted and will live with a foster family. Maryam Uwais believes this to be “an entirely avoidable tragedy, leaving in its wake four dead men and a thoroughly traumatised little girl. Poison – the only feasible escape to freedom – devised from the wild imagination of a naive, depressed little girl caught up in a painful forced marriage to a much older man. A tough lesson for families, communities and a government that is still ambivalent about sanctioning the perpetrators of child marriage.” The social justice organization, Girls Not Brides, has ranked Nigeria 13th in countries with the highest rates of child marriage, despite a governmental declaration entitled, Child Rights Act of 2003–which was created to make every action concerning a child and his/her best interest, a paramount consideration.

Child marriage impacts the female child more than the male child. Childhood creates the revelation of identity.

Young females in the West and developing nations should capitalize on their girlhood, embracing it as a time to discover themselves—their identity, their relationships with men, what boundaries or rules they can break without consequence, and to receive an education.

For child brides, the whimsy of girlhood is non-existent because they enter womanhood before they fully grasp puberty. The US has relegated the creation and implementation of marriage laws to the state level. The age of majority is 18 in the US. Although the state law of Virginia or Alabama [AL code 30-1-4] allows for a 16-year-old to marry, majority of Americans as well as the international world, she is still a minor who cannot vote, buy alcohol, work after 8pm, and possibly carries a high school identification card. For the thousands of children—90% of whom are girls—this change comes too late.

Child marriage does not take place solely in poor communities. In Virginia, the new law arose when Sen. Jill Holtzman Vogel learned that a high school student in an affluent Northern Virginia district dropped out of school when she married a man in his fifties. The marriage, granted by the parents, halted all child-protection services. It is illegal to engage in sexual activities with a minor yet marriage laws make allowances and create caveats for offenders to marry their victims, rather than facing justice for their illegal behavior. Jeanne Smoot of Tahirih Justice Center states that the “laws can facilitate forced marriages of children.”  It is to be understood that not all marriages are forced; however, who is standing up for the rights of the child to remain a child? The laws may not facilitate forced marriage of children, but they are failing to protect children from the threat of human trafficking, statutory rape, divorce, child abuse, domestic violence, poverty, mental health issues, premature death, and becoming a murderer.

Child marriage makes children targets because the authorities given agency to ensure their best interest aren’t always acting on the behalf of the child. Fraidy Reiss declares that children are not equipped to live and play in an adult world, considering the imbalance of power when married to an adult and lacking adequate resources to acquire help and freedom. Gerison Lansdown, Tony Waterson, and David Baum acknowledge that governments are failing to honor the four principles of the CRC as they relate to the world’s children, but also argue that lack of knowledge within civil society is not a valid excuse. “Ultimately the government is responsible for the full implementation of the convention” and everyone working with children need to do their part in helping to protect their rights (1565-6). Diana Francis identifies it as “people power.” People power is the decision to act at “any level…ensuring that those who have been the subjects of structures of domination discover and develop the power to participate in what affects them” (Francis, 2002). In other words, it is the voice of the collective speaking up for those who cannot speak for themselves, in order to arrive at justice and democracy for all.

Ending child marriage around the world is an essential target in achieving gender equality and the empowerment of women and girls as a Sustainable Development Goal of the UN. The UN is responsible for global governance. It offers suggestions that may be refused if the country deems it is not in their best interest. Joel Oestreich says that despite being considered a Western ideal, countries have signed the CRC, recognizing it as a model of international consensus building and allowing UNICEF to work intra-nationally as well as internationally in order to provide the implantation of CRC standards as a way of life for the children (184). African nations have identified the necessity of bringing an end to child marriage; there needs to be long-term strategies, governmental infrastructure, and a responsible civil society working together to see an advancement. The same can be said of the United States. As a result of the Virginia legislation, bills are set to pass in California, New York, Maryland, and New Jersey. Nelson Mandela concluded that each of us as citizens, has a role to play in creating a better world for our children.

When You Are Ready for the Baby Carriage: Black Maternal Health and Disparities

I did something very interesting in my mid-twenties. I asked a few of my family members if they would be willing to be a surrogate if I could not have children. Now, let me preface this by saying I never had any kind of health issues and most women in my family conceived with no problem. My OB/GYN never mentioned irregularities, fibroids, or cysts. My graduate school research had nothing to do with women’s health so I was not inundated with facts and figures. Yet, here I was already concerned and worried (with no discussion of even a long-term future with my partner at the time might I add). My wonderful family, including my mother, tentatively agreed but I am sure were thinking “she has to be joking”. I had never been more serious; I wanted to have options. I did not know what would happen when my womanhood was called out on stage. As women, that is how so many of us define ourselves, right? This is what famed Developmental Psychologist Erik Erikson called generativity: deciding how we will contribute to future generations. In his theory, however, he felt that people usually did not start worrying about this legacy until middle age (or at the very least until a partner was on board), but here I was already thinking about my grandchildren.

About 5 years later, while I was teaching Public Health and Medical Issues in African American Communities, I discovered the documentary series, “Unnatural Causes.” Unnatural Causes delves into the relationship between social conditions and population health. When it came time to discuss health disparities as related to women’s issues, the episode “When the Bough Breaks” was perfect. One statement in the video astounded me: Black women with advanced degrees have worse birth outcomes than White women without a high school diploma. I nearly cried in front of my class. It not only took me back to my concerns in my 20s, but I had just found out I was pregnant with my first child. Would I, a Black woman with a PhD in her early 30s, not be able to carry full-term? Infertility issues, low birthweight babies, and high-risk pregnancies can absolutely influence any woman and family. However, research has uncovered unique circumstances that impact the maternal health of Black women.

Physical Factors

The 2006-2010 National Survey on Family Growth interviewed over 20,000 men and women about family life, pregnancy, infertility, general health, and reproductive health. Chandra and colleagues found non-Hispanic Black women were 1.8 times more likely to report fertility issues compared to non-Hispanic White women. This finding was true among married women as well.  It is possible that uterine fibroids, benign tumors in the uterus, affect fertility. Reproductive Science is a relatively young field (compared to Obstetrics and Gynecology which date back to the 19th century), therefore the relationship between uterine fibroids and infertility is far from definitive. However, race/ethnicity is a well-established risk factor for uterine fibroids with Black women developing uterine fibroids at an earlier age than White women. A recent analysis of couples in a reproductive medicine clinical trial found that Black women with uterine fibroids were more likely to miscarry before 12 weeks compared to White women with uterine fibroids. Researchers are trying to identify genetic causes but that will not help the thousands of Black women trying to conceive now.

Psycho-social Factors

Were you ever told babies do not grow in a hostile womb? I heard that at some point in life. During my first trimester, I learned this new information about health disparities in pregnancy outcomes and I was going through a career transition. I was stressed out. Stressors cause the body to release cortisol, which is a necessary hormone when you need to react during intense situations. However, long term exposure to cortisol weakens your immune system and puts you at risk for disease. There is a significant amount of data to support that high levels of cortisol (from continual exposure to stressors) throughout pregnancy can impact the development of your baby. At the same time stress, as a psychological and emotional reaction, is at the center of two of the most common psychological disorders: anxiety and mood.

Anxiety disorders often include fear, tension, nervousness, and dizziness whereas mood disorders often include a sense of hopelessness, fatigue, depression, and an inability to concentrate. Although pregnancy does not increase the likelihood that you will develop either disorder, whether stressed or not, undiagnosed psychological disorders prior to pregnancy can advance further because the symptoms go undetected due to similarities with the normal experience of pregnancy. Dealing with the stigma of mental health issues in the Black community will have to be for another time, different blog! What should a Black woman dealing with certain psychological and emotional symptoms, particularly as stressors, do? Best solutions to deal with stress: walk, yoga, cut out unnecessary activities, watch TV, journal, eat well, and countless other suggestions from books and websites about de-stressing your life. I will admit that I failed miserably in completely de-stressing but I did manage to incorporate a few suggestions over my pregnancy.

How can Black women deal with cultural, historical, and intergenerational stress…the kind of cumulative stress that comes from 400 years of slavery, racism, and discrimination? The pervasive stress that has entrenched itself in the Black psyche? Yes, it is absolutely in there, but it has not just remained in our minds as simple negative thoughts. If that were the case, we could have some sessions of cognitive therapy, learn to counteract those aversive thoughts, and stop perceiving the world as a threat. When one examines racial differences in health outcomes with all things being equal across the racial groups, for example money, education, health care access, and family life, health disparities are still present. Scholars have offered the historical trauma of Blacks throughout the course of US history as an explanation. Could racism not be another explanation for infertility? According to Prather and colleagues, it is the perfect explanation for the social conditions endured by Black women that ultimately influence sexual and reproductive health outcomes.

This is just the tip of the iceberg. There is additional research on the impact of lack of quality healthcare for Black women experiencing fertility issues. Differences in healthcare options affect the recommended treatment and patient understanding of alternatives. There are also observed racial differences in In Vitro Fertilization usage, with money most often the biggest deterrent.  Low-income families are very likely unaware that there are grants available to assist with infertility treatment. These are macro-level factors that require changes in resource distribution, medical training, and public policy. And I ask again, how does it help the Black woman trying to conceive now?

As it turns out, I worried for no reason as I thankfully have two healthy and beautiful little girls. I want to ensure that my outcome continues to be the norm rather than the exception going forward. In my opinion, increased awareness of this problem in the Black community will cause a push for more research on racial disparities in fertility issues. Only then will we begin to see changes that will eventually trickle down to support for another young girl in her 20s wondering “can I conceive?”

Talks surrounding disarmament and nuclear weapons, including threats by North Korea against Japan, South Korea, Guam, and the US, are in abundance of late. However, the decision of the Nobel Peace Prize community to award this year’s prize to the International Campaign to Abolish Nuclear Weapons (ICAN), a key development in the disarmament conversation, seems to have fallen by the wayside. Gene Sharp, a nonviolence theorist, demands, “A reexamination of the problem of war and the possible means for its solution must begin with a recognition of the failure of past movements and the proposals for the abolition of war.” In laymen’s term: the repetition inherent in the conversations of the status quo surrounding war, defense, and the military prove little in their manifestation of peace and its maintenance on a national and global level. To this end, he argues for a redefinition and reconceptualization of the true nature of war as it relates defense, deterrence, and peace. This blog briefly explains disarmament while celebrating the achievement of the organization and the treaty.

Disarmament consists of the reduction of and/or total elimination of military force and weapons of mass destruction, including nuclear weapons. International disarmament is an essential component in the creation of “global norms…vital to the sustainable development, quality of life, and ultimately the survival of the planet.” ICAN is a grassroots, cross-cultural, and international NGO movement taking the lead in “reshap(ing) the debate on nuclear weapons” by working with survivors of US atomic bombs in Hiroshima and Nagasaki, dignitaries and actors, and the United Nations. On July 7, 2017, the UN General Assembly convened and negotiated a legally binding treaty calling for “multilateral disarmament negotiations… and establish general prohibitions and obligations as well as a political commitment to achieve and maintain a nuclear-weapon-free world.” Ambassadors from at least eight of the nuclear powerhouse countries were not in attendance.

The Global Peace Index (GPI) identifies China, France, India, Israel, North Korea, Pakistan, Russia, the UK, and the US as the least peaceful when accounting for the combined nuclear threat to international peace and security over the last seven years. “There has been a decline in militarization over the past three decades. Globally, the economic impact of violence…is enormous. Current peacebuilding spending on building peace is well below the optimal level”. GPI reveals an increase of resources utilized for the creation and containment of violence but few on the cultivation and maintenance of peace. Peacebuilding, whether domestically or internationally, does not appear as a priority of the current administration.

The majority of humanity understands the power of words; there are studies and reports confirming the power of positive confession and the purposeful use of written and spoken words. The word ‘peace’ appears in the US Government budget three times, whereas ‘defense’ appears 70. According to A New Foundation for American Greatness: Fiscal Year 2018 Budget for the US Government, the administration lays out the eight pillars of American reform and outlines a reprioritization of federal spending “to unleash the power of American work and creativity—and drive opportunity and faster economic growth… so that it advances the safety and security of the American people.” In other words, American creativity, work, opportunity, and growth is tied to the $639 billion US Defense budget with discretionary overview of $574.5 billion dollars–more than the combined proposed discretionary overview for the remaining cabinet departments, including education and labor. It is important to remember: discretionary allows a consumer to spend money on wants rather than on needs. The Defense budget sends a message to the world about the resolve and strength of America as a fulfillment of a Trump promise to focus on the safety of Americans from terrorists and other violent offenders.

America, in the past as an international leader, bore much of the financial responsibility for multilateral cooperation. However, with the steady withdraw of financial support and non-appearances at UN agency meetings, the US government reaffirms its value for national defense over participating in creation of international peace and security for all. In their article, “A World Free of Nuclear Weapons”, Schultz, Perry, Kissinger, and Nunn argue the US has a unique opportunity to lead the way in reversing the global reliance on nuclear weapons. Written in 2007, they suggests nuclear weapons “were essential to maintaining national security during the Cold War…but reliance on for this purpose is becoming increasingly hazardous and decreasingly ineffective.” Highlighting the words of former US Presidents Eisenhower and Kennedy, they posit a bipartisan presidential agreement since Nixon regarding the Non-Proliferation Treaty, and remind how the Reagan-Gobachev agreement turned the conversation of arms race on its head. They conclude that a world without nuclear weapons because of multilateral cooperation aligns with the moral heritage of America.

Societies often equate defense with military; however, Sharp questions whether a redefinition of the function of the military in terms of deterrence or defense, can assist in the creation and acceptance of nonviolent solutions. Defense is employed as a function of “internal domination or is used to disguise for the home population what is in fact an attack on another country.” He establishes a need for the military while suggesting reliance on the military is the international symbol of an independent state unable to recognize: the provision of massive death and destruction, the inability of others to defend themselves against the impending destruction and death, and nonmilitary forms of resistance are possible as national defense. Unfortunately, the application of negative descriptions for alternatives to war render them passive, soft, submissive, and interdependent. In other words, the characterization of war and military power is masculine, and nonviolence and cooperation is feminine.

The unintended consequences of war heavily burden women and girls who “have responsibility and no power” due of the gendered division of labor, placing men in the public sphere and women in the private sphere. Antrobus postulates the intersectionality of the female life offers a unique perspective on the interplay of war and gender; the UN agrees. The Treaty on the Prohibition of Nuclear Weapons notes the disproportionate impact on women and girls, and indigenous people when considering the “catastrophic humanitarian consequences” of using nuclear weapons. Additionally, it reaffirms the principles of humanity as a public conscience, and recognizes the need for female participation in the peace process by supporting and strengthening the input of women as equal to men.

“Recognizing that the equal, full and effective participation of both women and men is an essential factor for the promotion and attainment of sustainable peace and security, and committed to supporting and strengthening the effective participation of women in nuclear disarmament.”

Boulding points out understanding and valuing the feminine perspective in a ‘male-dominated’ area requires men “in tune with the feminist redefinition of political goals and processes.” Collaboration can yield results, which extend beyond the short term through the identification of alternatives while working within the standardized international relations model. In short, the nature of peacemaking, peacebuilding, and peacekeeping requires an egalitarian and gender equal value based partnership stance, capable of visualizing and verbalizing the long-term ramifications of short-term solutions on global humanity, rather than one nation and her citizens.

 

From Memory to Action: “Never Again” Begins with You

This month the United States Holocaust Memorial Museum marks its 25th anniversary. This offers a chance to reflect on the mission and work of the Museum, and also an opportunity to look forward at how we will ensure the permanent relevance of Holocaust history for new generations, reach global audiences, and create more agents of change who will work to make the future better than the past. Working with partners like the Institute for Human Rights at the University of Alabama at Birmingham is vital in achieving this mission.

In the fall of 1978, President Jimmy Carter established the President’s Commission on the Holocaust, which was charged with the responsibility to submit a report “with respect to the establishment and maintenance of an appropriate memorial to those who perished in the Holocaust.” One year later, the Commission concluded that the memorial could not be a static monument. Instead, it should be a “living memorial” with a strong educational component. The result was the United States Holocaust Memorial Museum, an institution that is both a memorial to Holocaust victims and a museum that educates visitors, collects and preserves evidence, and produces leading research and scholarship. The Commission also issued a call to action, concluding that “A memorial unresponsive to the future would also violate the memory of the past.” As such, in addition to honoring the memory of Holocaust victims, the mission of the Museum is to inspire leaders and citizens worldwide to confront hatred, prevent genocide, and promote human dignity.

When the Museum was dedicated and opened to the public on April 22, 1993, its founding chairman Elie Wiesel told the crowd, “This Museum is not an answer. It is a question.” For the past 25 years, this is how the institution has approached its work: relentlessly exploring complex questions about history and human nature. We have designed programs and resources that not only ask what the Holocaust was, but delve deep into explorations of how and why it happened. Moreover, we aim to prompt people to recognize the importance of this history’s lessons about humankind and societies, and to take an active role in confronting divisions that threaten social cohesion.

It is a sad reality that in the near future, we will live in a time when there are no more eyewitnesses to the Holocaust alive to share their stories. It is more important than ever, therefore, to teach the next generation of emerging adults about the Holocaust as a way to ensure the lasting memory of the victims. As Wiesel says, “I believe firmly and profoundly that anyone who listens to a Witness becomes a Witness, so those who hear us, those who read us must continue to bear witness for us. Until now, they’re doing it with us. At a certain point in time, they will do it for all of us.”

In that spirit, the Museum works with diverse audiences to demonstrate the importance of honoring the memory and exploring the universal lessons of the Holocaust, even if one doesn’t have a direct connection to the history. These audiences include judges, the military, law enforcement, youth, and faith communities.

As the next generation of thought-leaders and changemakers, college students have been an important audience for the Museum. To date, through a wide range of resources, traveling exhibits, seminars, lectures, conferences, and other programs, the Museum has engaged more than 630,000 college students, faculty, and local community members on 545 college and university campuses in 49 states across the United States.

American college students’ interests with the history of the Holocaust are different across the country. Their own background, upbringing, and educational experiences shape how they approach and understand the history of the Holocaust and its relevance to their own lives. As such, the Museum recently launched an initiative to put the history of the Holocaust into conversation with local or regional histories in the United States. This initiative enriches campus dialogue by provoking critical thinking about the history of antisemitism, racism, extrajudicial and state-sanctioned violence, and the power and limits of human agency in different historical contexts. By examining themes through the lens of multiple histories, the Museum connects with new audiences and works with partner campuses to educate students about the history of the Holocaust, model how to responsibly research and talk about different historical contexts, and facilitate informed dialogue about the lessons and contemporary relevance of those histories.

Over the past year, the Museum has been working with faculty and students at universities across the Southeast region on a series of programs that explore the histories of race and society in Nazi Germany and the Jim Crow South. These programs are neither an equation of suffering nor meant to gloss over the uniqueness of each historical period. Instead, they bring communities together to explore what can be learned from studying the similarities, differences, and gray zones of these two histories.

In February 2018, the Museum, with the UAB Institute for Human Rights, organized a capstone event of this regional program: a two-day interdisciplinary symposium entitled Bystanders and Complicity in Nazi Germany and the Jim Crow South. In total, 401 people from 10 states — including 203 college students, 20 high school students, 47 faculty, staff, and teachers, and 131 local community members — gathered together to explore the complexity of these histories.

Through this symposium, history became a way to build common understandings, bring diverse communities together, and foster a sense of human solidarity. Although — or perhaps because — participants came from many different backgrounds, we understood that we were discussing more than just past events. Our conversations posed timeless questions: about relevance to our lives today, about the vulnerability of societies, about democratic values and human nature.

Attendees and presenters discussed how, when, and why ordinary people supported, complied with, ignored, or resisted racist policies in two very different systems of targeted oppression and racial violence. It takes a critical minority of determined leaders with the support of an acquiescent general population to introduce and establish state-sanctioned racism, antisemitism, and violence. The extreme examples of Nazi Germany and the Jim Crow South show that the majority of the population in these two worlds witnessed the widespread persecution against a targeted minority and either actively or passively tolerated what they saw, thus enabling the continuation of persecution and raising pressing questions about the role of onlookers and the nature of complicity. Examining the role of ordinary people, therefore, provides us with a better understanding of how and why such atrocities like the Holocaust could happen. This focus also helps us to make a more intimate connection to the history since we often each think of ourselves as an “ordinary person,” rather than as a victim, perpetrator, or bystander.

Dr. Beverly Eileen Mitchell, Professor of Historical Theology at Wesley Theological Seminary, delivered the symposium keynote address: “Racism and Antisemitism: Sibling Threats.” She argued that we cannot understand antisemitism and racism as separate prejudices that each affect only one particular group of people. History reveals that while the two may manifest uniquely, racism and antisemitism are children of the same father: white supremacy. “Lessons from history can shed light on what is happening in our own time, if we pay attention,” she says. A key lesson, Prof. Mitchell concluded, is that we all must actively confront discrimination, even when it does not affect us or our community directly, because hate against one group ultimately grows to affect us all. “We must remain vigilant. … There are no innocent bystanders where white supremacy is concerned.”

A highlight of the symposium was “Keeping the Memory Alive,” a session that featured a conversation between Riva Hirsch, a Holocaust survivor, and Josephine Bolling McCall, whose father was lynched in Alabama in 1947. These two women shared their powerful stories about the dangers and personal impact of racial violence and genocide. Their testimony ensured that their memories would be carried on by others. “Don’t ever stop learning about the Holocaust,” Hirsch told the crowd. “Don’t ever stop talking about it. There are people who say that it never happened, but I’m here to tell you all that it happened to me. To you youngsters out there: our memory is in your hands.” But the women also issued a challenge, urging everyone to speak up when they see discrimination. “You can’t wait for someone else to do something,” McCall said. “All it takes is one person to change someone’s mind for the good. Be that one person.”

The women’s parting words reflect a guiding principle of our Museum’s work: when you learn about how and why the Holocaust happened, you now have a moral obligation to act on that knowledge and to confront hatred and promote human dignity.

As we honor the memory of Holocaust victims during the Museum’s 25th anniversary, we recommit our affirmation that the exploration of this dark history must illuminate lessons that can guide us in our mission. One important lesson is that, as individuals in a pluralistic society, we have a responsibility to each other, to defend against threats to social cohesion, and to protect democratic institutions. Second, the confluence of motivations, pressures, fears, and concerns of daily life means that moral choices are not always clear or easy, yet we must commit to making the moral choice. Our (in)actions have unintended consequences and reverberate further than we may realize. What you do matters.

And finally, one of the most important lessons is that the Holocaust was preventable. “That’s not just a statement of fact,” says Museum Director Sara J. Bloomfield. “It is a challenge to all of us.” After the Holocaust, the world promised “Never Again.” But this promise cannot only apply to mass atrocities or genocide. It is up to each of us to make sure that “Never Again” is a challenge to combat discrimination, prejudice, and hatred before it evolves into violence. Never Again begins with you.
