Thoughts on Homelessness in Birmingham

During the winter break, I spent a lot of time in Birmingham, staying with my sister and with friends, far away from my farm and home in Columbiana. Our farm is more like an animal rescue or sanctuary that does not generate much income but enough to accommodate. Besides hundreds of animals being surrendered or abandoned, we have even had strays walk up our driveway. Our goat, Fred, was the first I remember as we were in disbelief that a goat was just walking the streets and checking out the very sparse neighborhood, curiously coming up to us with some twine wrapped around his neck. For Fred and everyone to follow, my parents and family members have never refused taking in, rehabilitating, or rehoming an animal in need, so maybe that’s why it was so much more obvious of how much worse the picture I have seen in Birmingham is, or what this article is about. In Birmingham, it is people living in the streets witnessed by a city full of people. Walking through five points and down 20th, there is so much evidence and example of homelessness.  Passerby witness but rarely realize that they are seeing many at their most vulnerable or the harsh, daily routine.

Responsibility of the State

People experiencing homelessness face violations of many human rights, such as inaccessibility to safe and secure housing, an inadequate standard of living, education, liberty and security of the person, privacy, social security, freedom from discrimination, voting, and more which are interconnected.  These human rights are protected by several international human rights treaties. The International Covenant on Civil and Political Rights (ICCPR), the International Covenant on Economic, Social and Cultural Rights (ICESCR), and the Convention on the Rights of the Child (CRC), which bind the state to legal and moral obligations in realizing and protecting the rights of all people. Also, the right to housing recognized by international human rights law doesn’t just mean a right to shelter. It must be adequate and accessible. Battling and overcoming homelessness is not a task of charity as much as an act of justice. Our Public policy and structures should facilitate or lead to a dignified life in the United States. As one of the wealthiest nations in the world, we should figure out how to shelter or house those who are homeless.

More recently, I saw many cops parked in the middle of five points as they held up traffic to address some of the people I have seen more statically living there, which brought up the thought of criminalization of homelessness and left me wondering if those cops offer rides to shelters before the ride to a cell.

A look at more vulnerable populations

The most visible type of homelessness is what we see when we walk through Birmingham: people living on the streets or sleeping in the parks or street tunnels. However, more move between shelters and temporary homing maybe with their friends or relatives and more long-term shelter where their experience may not be included in the conversation of homeless persons.

Within 2018 records reported by Continuums of Care to the U.S. Department of Housing and Urban Development, there were almost 3,500 people homeless on a given night (280 were family households, 339 were Veterans, 158 were unaccompanied young adults (aged 18-24), and 540 were individuals experiencing chronic homelessness). Over 900 of those were concentrated in the Birmingham area. Over the year, there were 14,112 students who faced homelessness in Alabama.

A large portion of the homeless population is affected by mental illness. People with mental illness or other disabilities may face social isolation and may face chronic homelessness. Such individuals may require special types of accommodation or support that may be an obstacle to rehabilitation.  Health issues may cause a person’s homelessness as well as they may be intensified by the experience where poverty and lack of access to care contribute to disparities in health. Another thing to think about is when someone handicapped by a disability loses their parents or caretaker, who will take care of them or will they find tools to live? They could become homeless.

Through the lingering effects of systematic denial of equal rights and opportunities, African American are particularly overrepresented in this system facing a higher risk of poverty, housing discrimination, and incarceration than White Americans

Indigenous people face greater social and economic disadvantage such as lower levels of education or higher levels of unemployment which contribute to higher levels of homelessness in their communities

Women may make up a big portion of those forced to leave their homes fleeing domestic violence or sexual assault. Homeless women may become more isolated for fear of violence, rape, or other abuse. Further, a woman may be separated from her children if she is unable to care for them which challenges her parental rights.

Children and young people are disproportionately affected by homelessness. I have known many classmates and friends who have been homeless as they pursue their education at UAB. Also, Covenant House proclaims that every year, more than 2 million kids in America will face a period of homelessness (The link provides more enlightening and harder-to-swallow statistics). Youth like those emancipated from the foster care system may not have another option. In addition to general human rights laws, children are protected under special rights, like those afforded in the Covenant on the Rights of a Child which describes a higher standard of living and right to protection against neglect, cruelty, exploitation, etc.

Untreated depression and mental illness, self-medication and addiction, childhood trauma and chronic PTSD, abuse and any circumstance that may lead one to homelessness may also create a loop to imprison them. For example, where abstinence is a prerequisite or requirement for homelessness assistance programs, one may not receive help unless they quit, but one cannot quit without relief.

A veteran should not have to stand on the asphalt with a cardboard sign begging for a living in a nation they helped secure and people should not be in the position to be turned down asking for food that was about to be thrown out. In fact, everyone has made contributions and continues to contribute to their society. Homelessness includes people who have paid or pay taxes and those who are paid less than a living wage. It includes people of all labels fleeing abusive conditions or facing escalating housing and living costs. It includes parents and it includes their children who have not had a chance. It also includes all students who are trying to pursue an education to hopefully get a job that will afford them housing. Besides all these achievements, many, including those facing chronic homelessness have endured full lives and have witnessed different forms of trauma. Still, they have survived the circumstances of homelessness, maintaining their humanity and resilience and- intentionally or unintentionally- being that example for others.

Also, keep in mind that going from place to place and not knowing what to do or where you will end up could understandably create a lot of pain and anger. Desperation or frustration may be harder to deal with. Being homeless could even make you apprehensive of ownership or pursuing certain routes that could be encouraged. However, everyone should be afforded options and certain securities.

More immediate examples for anyone to help everyday

If it’s raining or about to, offer the warmth and privacy of an umbrella.

Offer to pay for an uber ride to a nearby shelter as some cannot walk to or have no means of transportation to one.

If you are not comfortable lending cash, you may offer supplies. You could keep these care bags of everyday products, essentials (maybe small shower things you could find in the travel section, gloves, hats, etc), or resources to offer or pass out at crowded shelters.

Invite others to the restaurant you are on your way to and share a meal if they are up for it. The conversation may also allow you to understand, accept, or appreciate their life and vice-versa. Once, a man I invited to eat with me on campus (in an environment where I felt safe enough to) proclaimed his version of Islamophobia (as that was the summation of a popular sentiment in America, especially during those Trump Campaign days) as he explicitly said he didn’t like Muslims when I revealed that of my identity. But it turns out, I was the first Muslim he had personally interacted with and realized he liked before the word “Muslim” exited my mouth. That could happen with anyone of course and homeless (or only hungry in this case) people are not to be “enlightened” and should not be expected to praise our deed, but the conversation and gesture can open this opportunity

This Decade in Human Rights

As we approach 2020 and the end of this decade, we come across several lists of important happenings, milestones, and statistics in various disciplines across the world. As for human rights, it is important to reflect where we stand on the provision and fight for human rights and highlight the important issues that emerged during this decade.

Internet Equality: A Human Rights Issue?

I had decided to spend this past Thanksgiving by myself at home with my computer. While waiting for my episode to load, I wondered to myself, “Why is the Internet so slow? Doesn’t my Internet plan guarantee high speed and unlimited data?” These few questions directed me to some episodes from Last Week Tonight with John Oliver and Patriot Act with Hasan Minhaj that addressed Net Neutrality (Net Neutrality I YouTube and Net Neutrality II YouTube) and “Why Your Internet Sucks,” respectively. Although I still had to wait about five minutes or so for the video to constantly stop buffering, that dissatisfaction paled in comparison to everything I was about to learn, particularly how companies will slow connection speeds so people would have to pay more for faster access.

So, before you continue reading, let’s define some of the basic terms used in this article:

  • Net Neutrality – The principle that ISPs should provide internet access to all people regardless of source or the type of website being accessed.
  • ISPs – Internet Service Providers. These are the people you pay to give you access to the internet.
  • VPNs – Virtual Private Networks. These are private networks that will give you privacy and anonymity when using a public network. They “mask your IP address so that your online actions are virtually untraceable.”
  • FCC – The Federal Communications Commission. They “regulate interstate and international communications by radio, television, wire, satellite and cable in all 50 states.”

History of Net Neutrality

Coined by Tim Wu, a Columbia University law professor, Net Neutrality called for all ISPs to treat all content equally. Wu had the concern that “broadband providers’ tendency to restrict new technologies would hurt innovation in the long term, and called for anti-discrimination rules.” He reasoned this because if providers were able to choose which content will be available for users, then newer companies would never have the chance to break out and grow. Had this happened in the mid-2000s with video streaming, then sites like Netflix, YouTube, Vimeo, etc. would have never gotten the light of day and be prevalent sources of information throughout our daily lives.

In the early 2000s, ISPs started to ban people from using VPNs and letting them set up their own Wi-Fi routers. Subsequently, the “FCC fined Madison River, a service provider, for blocking phone calls over the internet, ordered Comcast to stop slowing down connections, and caught Apple for blocking Skype calls at the request of AT&T.”

In 2015, after much deliberation, the FCC approved Net Neutrality by a 3-2 vote, replacing a ruling in 2014 by the U.S. Court of Appeals for the D.C. Circuit finding that found the FCC did not have enough regulatory power over broadband. After the resulting vote, Gabe Rottman, the ACLU’s legislative counsel, praised how “this [was] a victory for free speech, plain and simple. The Internet, the primary place where Americans exercise their right to free expression, remains open to all voices and points of view.”

However, when power changes hands, so does previous rulings. With a Republican-controlled FCC, Chairman Ajit Pai effectively repealed Net Neutrality. They removed the Title II designation, which classified the Internet as a Public Utility, preventing the FCC from putting rules in its place if desired. Now, without these rules in place, ISPs can effectively prioritize specific content and block others, with the only caveat being that ISPs must publicly state that they will do so.

The Case for Net Neutrality

On Last Week Tonight, John Oliver opens his segment briefing his audience on the foundation of Net Neutrality while also talking about the impact his first Net Neutrality episode had on the FCC’s ability to regulate the open Internet. He then pans to the then-new and now current chairman of the FCC, Trump appointee Ajit Pai. While he presented himself as fun with his oversized coffee mug, Oliver notes how Pai was a “former lawyer for Verizon” and how he believes that due to Title II, companies can no longer invest further into broadband networks. Oliver then responds to that claim by stating that “Title II is the most solid legal foundation we have right now for a strong enforceable net neutrality protections.” While also roasting Pai with his own larger coffee mug, Oliver calls upon the people watching his episode to go to the FCC website and write comments under the heading “Restoring Internet Freedom.” Created in April of 2017, this docket had a current filing of 23,952,756 comments, with people still commenting more than 2 years after the fact. He then concludes with his call to action below:

John Oliver: “I’m calling upon all of you, the internet’s time-wasters and trouble-makers, to join me once more in just five to ten minutes of none effort, I need you to do this once more under the breach my friends, simply go to this URL and tell the FCC to preserve net neutrality and Title II. Once again commenters, America needs you to rise, or more accurately, remain seated in front of your computer screen to this occasion. So please, fly my pretties, fly once more! Fly away!”

Net Neutrality, Internet Equality, and Human Rights

So how exactly does Net Neutrality and internet equality relate to human rights? Are they even remotely related?

With the repealing of net neutrality, you risk losing your first amendment rights guaranteed by the Constitution, being the right to freedom of expression, while also losing your right to access information. The United Nations Human Rights Council also had passed a resolution for the “promotion, protection, and enjoyment of human rights on the internet” while also condemning a country that disrupts internet access for its civilians. ISPs, such as Comcast, AT&T, Spectrum, and more, would limit websites that cannot pay to prioritize their content, allowing big companies to have more content allowed. This eventually would lead to a restriction in the amount of information accessed and have the internet, as Human Rights Watch phrases it, “reduced to social media giants and shopping websites, and we could lose equal access to all the little random, odd corner that make the internet the magical (and weird) place it is today.”

Imagine that. There might be a time soon where all you could access are big-named websites like Apple or Microsoft for technology, Facebook and Twitter and Tik Tok for social media, and Amazon and Walmart for shopping. If you think about it, Tim Wu was right. Limiting other companies’ chance to make a splash to a larger audience just because they did not have enough money to be put in the fast lane, to have their content prioritized.

While watching Patriot Act with Hasan Minhaj, I noticed how Minhaj begins by admitting to the fact that the internet is addictive, rolling through a series of clips of news commentators claiming that it is the digital heroin of our age. He then calls out how the internet is something that we take for granted, despite there being millions of Americans with no access to it.

Minhaj then pans over to a news story about Coachella Valley in California, where routers were placed on buses and parked in spots with no connectivity. Due to that, the graduation rate went up by 8%, helping more students get “on the road to success.” This comes with the fact that about 3,000,000 (three million) students, about 17 percent of all U.S. students, don’t have access to the internet at home.

The United Nations also declared internet access as a human right back in 2011, by the United Nations Special Rapporteur on the Promotion and Protection of the Right to Freedom of Opinion and Expression. With 2/3 of Syria’s internet being cut at the time, the United Nations also declared that disconnecting people from the internet is also a violation of international law, which just goes to show how important internet access is in the world in this day and age. And as of October of 2019, there were about 4.48 billion active internet users in the world, about 58 percent of the global population.

Overall, with the restriction of internet access in the world, and more specifically in the United States, we must understand the implications restricted internet access has on the amount and type of information available. Although we might take our internet access for granted, we must be aware that allowing these companies to have limited regulations on what content to prioritize, restricting access to other sites would prevent equal access to information, a violation of our human rights. Therefore, while it may be that the future seems bleak, we have a responsibility to petition and encourage our elected officials to expand broadband access and to regulate the companies that provide users with that internet.

The Power of Animations through Pixar

The beginning

Many of you have grown up watching animated films. They have a special place in our hearts and often cause us to reminisce on our childhood. Animated films have been around for hundreds of years, dating back to 1877 when the praxinoscope was invented. This device would allow you to see an animation by having pictures in a moving wheel. Thus, it would seem as if the pictures are moving due to a slightly different frame. Animations are not necessarily a genre, but instead a film technique. It becomes complicated when trying to determine when the first color animation came out since many films have been lost, although people presume it was around the 1920s. Shortly after, in 1928, Disney developed Mortimer Mouse, which turned into the iconic Mickey Mouse we all know.

Pixar

Pixar is a well-known company that produces numerous animations and is a branch of the Walt Disney Company. Pixar creates an environment where individuals can work together creatively. In fact, they have a meeting every couple of months called Braintrust, which is where employees can discuss ideas, progress, and struggles with their movies, stressing the importance of honesty. This ensures an environment where people can be flexible in their creativity.

The first short film that Pixar Animation Studios produced was in 1986 and was called Luxo Jr. Due to the use of computer-generated imagery (CGI), it was ahead of its time. What took people by surprise was how the objects could shed light and shadows on themselves, depicting three-dimensional imagery as more alive and realistic. Furthermore, this short film was able to connect to the audience through “emotional realism”, which is where animated characters portray feelings and emotions that resemble human experiences, so we the audience can relate. It was innovative, not just for Pixar but the entire industry. Luxo Jr. went on to win Academy Award for Best Animated Short Film and inspired the creation of many other films such as Toy Story and Cars. As a result, Luxo Jr. was chosen to be preserved at the National Film Registry due to its “cultural, historical and aesthetical significance”. Without this film, who knows where the animation industry would be today.

Pixar Addresses Diversity

Becoming a director, in general, can be difficult. It becomes more complicated when you are a woman or person of color, especially in animation. During the span of seven years, only one major animation, across several companies such as Disney and Dreamworks, was directed by a woman (Jennifer Yuh Nelson directed Kung Fu Panda in 2011). In fact, Women in Animation found that “60% of all animation and art-school students are women, yet only 20% of creative jobs in the industry are currently held by women”. In order to address the inequality towards women and people of color, Pixar decided to launch a new program called SparkShorts.

This new program encompasses a series of short animated films that are meant to create more leadership opportunities for women and people of color.

Three of SparkShort’s films were released in February through YouTube with two of the directors being women:

  • The first SparkShort was called Purl and focuses on a pink ball of yarn who feels out of place amidst the humans. The film shows what it feels like for a woman, Purl, to be working in a predominantly male office. The reviews were stellar. Instead of focusing on the quality of the animation (which was excellent in its own right), compared to previous films, people are focusing on the narrative of the story.
  • The second film, Kitbull, sets the scene for an abused Pitbull becoming friends with a stray kitten, hence the name of the film. It sends a powerful message of love, corruption, and friendship. It brings about the controversial topic, the No Kill Movement that advocates for stopping the killing of healthy and treatable animals due to convenience.
  • The third released film, Smash and Grab, tells the story of two robots by the same names who are best friends. Smash’s job is to break rocks and to pass them to Grab who throws it into a furnace. Their routine is the same every day, with an occasional break for playing catch with the rocks. However, the robots cannot leave because they are restrained by a long cable but Smash notices that there is a world where robots could be free and together they decide to escape. This film is unique in that it does not contain any dialogue. However, the theme of friendship is clear.

What Lies Ahead

The films do not end there. In the upcoming year, three more are expected to be released. The first film, Wind, will be directed by a Korean American director, Edwin Chang. The genre is magical realism film about a grandmother and her grandson. The second film will be the first of its kind to have Pinoy characters. Bobby Rubio is the director of Float, a story about a father protecting his son. The third film, Loop, will be directed by Erica Milsom, which will portray a non-verbal autistic girl. These films pave the way for future films by creating narratives that touch on the representation of all people and is not afraid to shed light on stigmatized topics. Furthermore, it creates discussions on the characters and their representation, fatherhood and masculinity, and people with disabilities. The films are not afraid to portray the difficult issues that affect people worldwide. This is just the beginning; these short films can change the industry and people’s perspectives on important topics.

Why it matters

In reference to the Universal Declaration of Human Rights, all humans have equal rights. It is not dependent on one’s gender, race, or religion. People have the right to work without experiencing discrimination and the film industry has a past at doing this. When underrepresented people see themselves in film it creates a chain reaction. Films have the power to shape how audiences perceive the world and it has the potential to instill empathy by breaking through barriers such as race, geography, and gender. Pixar is breaking the typical standards of the animation industry. In fact, their ideas are breaking the mold for people; it has the ability to normalize commonly stigmatized topics. It can lead us to the idea of inclusivity. I leave you with one final message, “To infinity … and beyond.”

 

The Power of Technology

Movies such as Blade Runner, IRobot, or the Matrix portray a futuristic ambiance in regard to artificial intelligence overpowering humanity. At first glance, these movies can seem unrealistic and a bit absurd. However, in recent years, it appears to be less ridiculous as it hints at a bit of truth. There is no doubt that technology has advanced at a rapid speed in the last ten years. As each year passes, it seems there is a new device or software that can somehow make your life easier. Technology is used in every aspect of our life – from our homes to our work to the stores we visit. Often times, it can seem inescapable. If you turn your attention to your surroundings, you are likely to see people on their phones or computers – whether they are searching the Internet, looking through Instagram, or sending a text.

It is alarming to consider how technology affects every aspect of our lives. It even influences human rights such as the right to privacy or freedom of expression. There are numerous concerns that people have about the role and impact of artificial intelligence. People are concerned about the rise of “machine autonomy” and how gradually it can diminish “the status of humans”. Furthermore, there are concerns on the use of artificial intelligence in terms of “unjust and unequal political, military, economic and social contexts.”

For example, the U.S. seems to be moving towards an artificial arms race by using, killer robots, or lethal autonomous weapons systems (LAWS). People concerned about giving these killer robots the power to decide whether someone lives or dies with little to no human control. Google created a military program called Project Maven, where a machine is used to analyze the drone surveillance footage which can be used for extrajudicial killings, meaning people could be killed without any legal processing. There have been aimed at Google urging them to reconsider what the data is used for. Google has since then declined to renew their contract.

Google is not the only company that has dealt with controversy in terms of technology and how it affects people’s human rights. A data firm by the name of Cambridge Analytica was caught using data from Facebook in order to build voter profiles. Employees acquired private Facebook data of millions of users, then they sold the information to political campaigns.

Another rising controversy with technology is how artificial intelligence (AI) systems have fostered “discriminatory practices”. The University of Cambridge published a study on the Malicious Use of Artificial Intelligence which details how “terrorists, criminals, and rogue states could potentially use AI’s with an intent to harm people. It foreshadows an increase in cybercrime, misuse of drones and manipulation of elections. While the report is seen as a warning, it provides a series of recommendations: policy-makers and technical researchers working together, being mindful and proactive about the possibility of AI misuse, and expanding the stakeholders in regards to preventing and reducing the risk of malicious use of AI. The goal of their report was to grab the attention of governments, organizations, and individuals. However, we need more than a call-to-action such as effective and enforceable legislative control. We cannot deny the entanglement between our everyday lives and technology and must confront the difficulty in deciding where to draw the line between beneficial and malicious use of technology.

A  Rwanda’s Minister for Justice and Attorney General, Johnston Busingye about the country-wide DNA database. In order to make this proposal work, scientists will collect DNA samples from all 12 million citizens in Rwanda, giving them access to personal medical and genetic information. Their reasoning for implementing this program is to decrease the number of crimes. There has been backlash from human rights campaigners because they believe the data could be misused by the government and violate international human rights laws. However, Busingye made a statement assuring the people that their end goal, using the data to determine who is responsible for the crimes, is genuine. The proposal has still not officially been approved but are waiting for the budget and the proper legislation to be passed in order to make it legal.

Rwanda is not alone in attempting to create a mandated DNA program whereas countries, such as China and Kuwait, have already set this program in motion.. People are concerned about how  Muslim Uighur minority. Researchers believe the Uighur minority is “systematical detained in re-education camps”. In response, China denies all these claims. Similarly, four years ago, Kuwait passed a law that required their citizens and visitors to give their DNA samples; however, the law was revoked because it violated articles 30 and 31 of Kuwait’s Constitution in regards to personal liberty and privacy.

As the debate for technology and AI continues, the Human Rights Watch aims to ban developing and using these killer robots. However this technology is nothing new – the focus is on how, when, and why individuals should or should not use them. Furthermore, the question of human intervention arises. While using DNA collection in certain circumstances, such as finding criminals, can be beneficial, there poses a question of how people use the date and if it infringes on our human rights. The numerous databases worldwide have no common structure among themselves. Thus, there are concerns on how countries obtain the data and whom they share the information with. The DNA database can trace anyone through “biological tagging”, even those who innocent or have no relation in regards to the crime in question. Other possible challenges could include how the information is kept and used. For example, when determining whether or not an individual is a good fit for a job the hiring company could access the data and that affects the individual’s rights. Furthermore, the data could be used by criminal organizations. Both killer robots and DNA collection have benefits such as solving more crimes and military advances; however, it ultimately challenges the principle of privacy.

The ongoing debate about climate change never seems to become resolved because there are certain people who believe in it and others who refuse to believe it. However, both sides often forget about climate refugees, a fairly new term that has no formal definition or protection under international law. As of 2008, millions of people lose their homes to weather disasters. Other aspects such as desert expansion and sea levels rising also affect people in terms of where and how they live. Scientists say the three most endangered regions are sub-Saharan Africa, South Asia, and Latin America while a World Bank report estimates that by 2050, those three endangered regions will consist of 143 million people who are displaced.

Climate Change and its effects

According to scientists, climate refugees consist of “people who must leave their homes and communities because of the effects of climate change and global warming.” Climate change pertains to the change of a climate in a region, while global warming is how the average temperature of the Earth is rising. As a result, global warming is leading to climate change. Rising temperatures due to global warming can cause glaciers to melt which can lead to flooding and the rising of sea levels. Furthermore, it can lead to droughts and desertification. These results of global warming can make the land people live on uninhabitable and make it difficult for people to survive.

In Bangladesh, thousands of people are affected by flooding each year, especially in Dhaka. In West Africa, Lake Chad is almost completely gone due to desertification. These problems are not just limited to the developing world. In the United States, approximately 2,300 Puerto Rican families who were displaced due to Hurricane Maria are looking for permanent housing. Additionally, small coastal communities in areas like Alaska and Louisiana are fading into oblivion due to rising sea levels.

In regard to droughts and desertification, individuals are not able to grow crops where they live. Thus, with no food, they are forced to move elsewhere. In China, the Gobi Desert is expanding more than 1,390 square miles every year. Farmers and merchants who live near the Gobi Desert migrate to more urban areas because the grasslands are turning into deserts. Droughts and desertification are a global problem. Also, in Morocco, Tunisia, and Libya more than 386 square miles of productive land are lost to desertification.

Climate Change and its ambiguity

In Europe, a journal estimated that if global temperature trends continue, applications for asylum to the European Union would increase by 28% by the year 2100. Additionally, many climate refugees live in rural or coastal communities and are forced to migrate to urban areas. Their skills, such as farming, are not beneficial in urban areas. Thus, finding a job can be difficult. Climate refugees who leave their country can face struggles when adjusting to new laws, languages, or cultures.

According to the development expert at the Center for Strategic and International Studies, Yayboke, the biggest problem that arises is there are millions of people who are considered a climate refugee, but there is no consensus as to what we can do about them. There are currently no international laws that protect climate refugees and they can be sent back to their homelands or forced into refugee camps. The reason that the term climate change is ambiguous is due to “the effectiveness of rights and legal certainty”. Since it is not covered by the law, there are no guaranteed international protections. Another source of ambiguity arises when you need to determine why those individuals were displaced. Was it actually due to climate change or was it because of another reason? For example, say there is a drought and a farmer moves to another area in order to find other work. Did the farmer move due to climate change or because the economy has no alternatives for employment? The term “climate refugee” tends to be associated with a variety of factors and not simply just climate change. Thus, an absolute definition is hard to define.

In 2016, the UN General assembly introduced the New York Declaration for Refugees and Migrants. In this declaration, it discussed the development of two global compacts: In 2018, climate refugees became recognized in the Global Compact on Safe, Orderly, and Regular Migration. The purpose of this compact is to protect the rights of those who displaced and to determine the economic, environmental, and social factors that individuals who are forced to leave their homes face. Unfortunately, the compact does not focus on trying to control the man-made forces behind global mass migration.

Another major problem is how climate refugees are not covered by the 1951 Convention in regard to the Global Compact of Refugees. Their definition of refugees has nothing to do with individuals who are displaced due to environmental factors. Thus, the term ‘climate refugee’ does not fall under the score of the 1951 Refugee Convention and their protocol. Therefore, individuals who are displaced cannot be classified as refugees and cannot appeal for resettlement and are “trapped in worsening environmental conditions”. However, a counterargument is that those who are displaced due to the environment could rely on the protection of their national government, whereas the traditional refugee cannot rely on the national government because they tend to be the source of persecution.

Hope for the future

In 2009, the EU decided to place a greater focus on climate change as a cause of migratory flows, in terms of security. From 2011-2013, a strategy paper was created for a European Commission project whose goal included working with developing countries in regard to migration and asylum. Additionally, the paper states focusing on climate change and migration. In 2013, the Commission published a paper on internal displacement. In 2015, Jean-Claude Juncker, the European Commission President stated “Climate change is one of the root causes of a new migration phenomenon. Climate refugees will become a new challenge – if we do not act swiftly”. However, EU Member States still have not created a category for climate refugees.

Climate refugees is a vague term that is hard to define. However, the economic, social, and political consequences are apparent and need to be addressed. Based on the global compact on migration and the international climate, one of the most salient ways to address this burgeoning human rights issue is for there to be numerous regional agreements that influence the creation of international law for climate refugees.

Book Review: White Fragility by Robin Diangelo

I recently read White Fragility by Robin Diangelo. Diangelo is an academic, lecturer, and author and has been a consultant and trainer on issues of racial and social justice for more than twenty years.  She formerly served as a tenured professor of multicultural education at Westfield State University.” I picked up the book because I am trying to understand and eradicate any micro-aggressions directed toward people of color on my part and to woman up to my own racism.  Identifying as both white and fragile puts the onus for my education and change on friends and acquaintances of color, and I wanted to take responsibility for my own rehabilitation.

DiAngelo conceived of white fragility from years of facilitating diversity training where “good” white people became incensed when faced with any suggestion of racist identity in their own lives. How does it connect to racism? Racism, the oppression of a dominant group by a targeted group based on skin color, is a complex, multi-layered structure—not an event. “Racism hurts (even kills) people of color 24-7.  Interrupting it is more important than my feelings, ego, or self-image,” writes Diangelo.  She also maintains that, when it comes to racism in the U.S., no choir exists to whom we can preach.  Regardless of our upbringing as white people, we all are indoctrinated by a potent combination of entitlement, individualism, comfort, safety, normalcy, and supremacy that other races cannot access.  Diangelo suggests that a person of color may refuse to wait on me in a store, but I still have the power, as a white person, to manipulate which neighborhood she can choose and, therefore, the caliber of schools her child attends, hence debunking the existence in our society of reverse racism.

*Failure to understand that we bring our group’s history with us, that history matters

*Assuming everyone is having or can have our experience

*Lack of racial humility, and unwillingness to listen

*Wanting to jump over the hard, personal work and get to “solutions”

*Confusing disagreement with not understanding

*Need to maintain white solidarity, to save face, to look good

*Guilt that paralyzes or allows inaction

*Defensiveness about any suggestion that we are connected to racism

*A focus on intentions over the impact

Aversive racism allows us white people to remain racist and still feel good about ourselves by rationalizing segregation in schools as the need for “good schools,” and the overabundance of whites in the workplace “because they [people of color] don’t apply.” White folks get away with the use of coded language such as urban, underprivileged, diverse, sketchy, and good/bad neighborhoods to belie their racist underpinnings.  The author relays a story of a white friend who called to say they had a mutual friend who bought a ridiculously cheap house in a New Orleans neighborhood, but her friend felt the need to buy a gun. When Diangelo responded, “I assume it’s a black neighborhood,” her friend said, “Yes, you get what you pay for.  I’d rather pay $500,000 and live somewhere where I wasn’t afraid.” The woman never used the word “black,” but the implication was crystal clear.  Toni Morrison alludes to “race talk,” designed to denigrate people of color, elevate white people, and keep in place the “us and “them” dichotomy.

While facilitating a workshop, the author questioned an African American man about what he would think if white people risked upsetting their white racial equilibrium to graciously receive feedback, reflect, and work to change their behavior. His immediate answer, “It would be revolutionary.”  “However, we aren’t likely to get there if we are operating from the dominant worldview that only intentionally mean people can participate in racism.” Color blindness (“I don’t see color.”) and color celebration (“I have a good friend who’s black.”) often exempt white people from examining the racism impacting them daily.  Most of us are taught to be kind, but “unless that kindness is combined with clarity and the courage to name and challenge racism, this approach protects white fragility and needs to be challenged.”  “An honest accounting of our racist patterns is no small task given the power of white fragility and white solidarity, but it is necessary.”

According to Diangelo, studies show that white children develop a sense of white superiority as early as preschool. Although many millennials profess to living in a postracial society, when 626 white college students at 28 colleges across the U.S. were asked to keep journals of racial images, racial issues, or what they understood to be racist behavior for 6 to 8 weeks, over 7500 blatantly racist comments and actions committed by family, friends, acquaintances, and strangers were recorded.

White fragility can translate as bullying when a racial point is made by a person of color, and a white woman cries needing comfort or all of the energy goes to soothe or assuage the guilt of the white people in the room.  The salient point is lost to white fragility, and nothing is learned.

Diangelo states that, in the U.S., anti-blackness is particularly prevalent, and white people’s history, as well as their present, is tied to abuse and devaluation of black bodies.  Slavery, lynchings, police shootings of unarmed black men, the school to prison pipeline, even the dissing of a black man who “takes a knee,” reflect a White disdain for African Americans in this nation.   Diangelo poses that it is a very different narrative to hail Jackie Robinson the first black man allowed by white people to play in the majors, rather than the first black man to have the skill to play in the majors.

Cover-to-cover, White Fragility is full of messages that are difficult for us white people to hear. I am indicted as a racist just by virtue of the society in which we live. We, White people, have the responsibility to transform our guilt into action.  We must move past defensiveness, discomfort, the conscious unawareness of our role in overt or often covert racism, and the way we look to others.  We must guard against allying with fellow racists in solidarity, forgetting that we are unconsciously invested in racism, refusing feedback from or not listening to people of color, and staying insulated in our cocoon of white equilibrium.  If we find ourselves open to shoving our white fragility aside, we may accomplish the following:

*Minimize our defensiveness.

*Demonstrate our vulnerability.

*Demonstrate our curiosity and humility.

*Allow for growth.

*Stretch our worldview.

*Ensure action.

*Demonstrate that we practice what we profess to value.

*Build authentic relationships and trust.

*Interrupt privilege-protecting comfort.

*Interrupt internalized superiority.  

Robin Diangelo offers us white folks the insights and the tools to explore and, with hard work, to overcome our white fragility in favor of transformation and enlightenment.

Africa – Not a Country but a Continent

One of the most famous blunders made by former U.S. President George W. Bush was, “Africa is a nation that suffers from terrible disease.” President Bush, like many others, misconstrued the fact that Africa is not a country, but a continent.

Africa consists of 54 different countries with a vast array of cultures, languages, religions, politics, agriculture, and cuisine. Many people assume that in Africa, people speak “African” or do not understand other languages; however, this is quite incorrect. In Africa, there are over 2,000 languages such as Arabic, English, French, Portuguese, and Swahili. Surprisingly the most spoken language is Arabic, with over 170 million speakers. Furthermore, English is the official language in 24 of the nations. “About 25 percent of the languages spoken in African countries aren’t recognized anywhere else in the world, which is a testament to its diversity and fullness.

There are approximately 200 independent countries in the world and a quarter of them are in Africa. In fact, Africa has a population of over one billion people and is the second largest continent in the world. To demonstrate the immensity of Africa, the USA, China, India, Europe, and Japan could all fit inside its geographic border.

People often view the countries in Africa as poor. While 218 million individuals live in extreme poverty, 1 in 3 Africans are considered middle class. Additionally, not all people in Africa live in “huts”. About 43% of individuals in Africa live in urban areas. In fact, there are more than 50 cities with a population of over a million people. Also, approximately 70% of Africa’s population is under the age of 30. So, when you combine this young demographic with diversified urban centers, you generate the possibility of innovation throughout the continent. Furthermore, their economy is expanding – out of the 10 fastest growing economies, 6 are in Africa. It is not possible to apply one concept to the entirety of Africa. Yes, some countries are poor, especially in sub-Saharan Africa; however, there are countries such as Nigeria, South Africa, and Egypt that are fairly wealthy. Nigeria exports the majority of the world’s oil, has a GDP of over $594 billion, and is projected to be one of the world’s largest economies in just a couple of years. While South Africa is a well-known tourist location, it also has the 18th largest stock exchange in the world. Egypt is one of the wealthiest countries in Africa.

In terms of landscape, Africa is quite diversified. While the Saharan desert covers one-third of the continent, there are also rainforests, mountains, and lakes. Africa’s largest vegetation zones do not comprise of deserts or rainforests, but, in fact, savannas which are tropical grasslands. There is a myriad of ecosystems in Africa. For example, the Sahara desert is the world’s largest hot desert and has over 300 species of wildlife such as the cheetah, ostrich, and hyrax. On the flip side, the Congo and the Nile are the world’s deepest and longest rivers, respectively. Africa is also home to numerous wetlands, specifically in the Botswana which includes saline lakes, freshwater forests, and massive floodplains. There are also tropical forests in Central and West Africa such as the Congo rainforest.

Western media tends to only portray the negative aspects of Africa – violence, revolution, and wars. However, there is so much more to Africa than the negatives because it is not all danger and violence. For example, Zambia is quite peaceful and has had six presidents since becoming independent in 1964. Furthermore, it has never had a civil war. In Liberia, the former President was named by Time as “one of the top 10 female leaders in the world”. Additionally, she earned a Nobel Peace Prize for her work in women’s rights. Western countries tend to show Africans as powerless and reliant on Western aid to survive. In fact, many ads in the West embody this stereotype by depicting Africans as sad, lonely, and dirty children that need money. However, this is nothing further from the truth. It is thought that Western countries are the ones who help out Africans and are responsible for their well-being. But the truth is that African people who live outside of Africa send more money to their families than all of the aid combined from the Western countries. That is not to say that Western countries should not offer assistance when it is needed, but they must change their minds about what it means to live in Africa. Africa is not helpless, there are many projects created by African people. A Somalian woman, Hawa Abdi, implemented a health clinic, which has now developed into a “school, refugee camp, and hospital for over 90,000 women and children made homeless in the war”. Another example would be the Akon Lighting Africa project, which provides electricity the usage of solar energy to those in Africa.

There are also many assumptions about Africa being a place that is technologically backward. They see it as a place without phones, social media, internet, etc. However, Africa is quite the contrary by becoming “the world’s second most connected region by mobile subscriptions with over 754 million connections”. Interestingly enough, people in Kenya are 4 times more likely to have a cell phone than have access to a toilet. Moreover, at least 80% of African people have access to a mobile device. There are also many innovative advances for renewable energy such as hydroelectric power and solar panels. A lot of African countries are ahead of Western countries when it comes to sustainable energy. Kenya alone gets 50% of their energy from hydroelectricity, while in the UK and US, only 11% of their energy comes from renewable sources. In terms of creativity, Africa has numerous resourceful inventions such as traffic-regulating robots, a biomedical smart jacket that can diagnose pneumonia, and a device that fuses live neurons into a silicon chip.

There is no way to identify Africa as simply one thing. Africa is diverse in areas such as people, language, economy, landscape, technology, and innovations.

George Kimble captivated these sentiments best when he said, “The darkest thing about Africa has always been our ignorance of it.

Forgotten Countries and their Real Story: Middle East

The Middle East is a transcontinental region. When people think of the term “Middle East”, a host of thoughts come to mind such as deserts, burkas and Saudi Arabia. However, whether they are accurate is a completely different story. Most countries in the Middle East are often forgotten about, ignored, or misconstrued.

Location

One of the most interesting questions to ask people is: Where is the Middle East located? Most people don’t even know what countries consist of the Middle East. One of the reasons why is, in the United States, geography is a dying subject. In fact, about three-fourths of the eighth graders in the United States test below average in geography. Furthermore, in most schools, geography is not required in middle school or high school. Out of the fifty states, only seventeen actually require geography in middle school and only ten in high school. The Middle East consists of fourteen countries shown in the picture below. What surprised me was how I found numerous websites that differed on what countries they thought were actually in the Middle East.

Arab vs Muslim

What does it mean to be an Arab? An Arab is defined as someone who identifies as being an Arab and whose native language is Arabic. On the other hand, someone who is Muslim practices the religion of Islam. Being an Arab and being a Muslim are not synonymous. For example, you could be an Arab who is not Muslim or you could be a Muslim but not an Arab. Furthermore, about 60% of people living in the Middle East are considered Arab. There are other ethnicities such as Persians, Turks, Kurds, and Jews.

What most people don’t realize is that there are over one billion Muslims in the world, the second largest religion in the world, and the majority are not in the Middle East. In fact, the country with the largest Muslim population is Indonesia. Also, the majority of Muslims live in Asia. While the majority of the Middle East does practice Islam, there are other religions practiced such as Judaism, Christianity, Baha’i, and Zoroastrians. Furthermore, there are different sects of Islam such as Sunni and Shiite.

Another misconception is that all the countries in the Middle East are considered Arab countries. However, that is not the case. For example, Saudi Arabia is predominantly Arab. This misconception may stem from the fact that much of the Islamic faith is written in Arabic. So regardless of which country you reside in, you would have some knowledge of Arabic.

Diverse Societies

There’s a certain stereotype in regards to the Middle East called orientalism that generalizes the region as deserts with roaming camels with olive-skinned people wearing robes, turbans, and garments that completely cover women from head to toe. The fact of the matter is that the style and environment depends on the area of the Middle East. We must also consider other factors such as education, socioeconomic status, and individual preference.  The veil is looked at as a form of modesty. The concept of modesty is meant to be applied to both genders and not just on women, and how each person interprets its meaning is different. Some countries such as Iran and Yemen do require veiling to go out in public; however, most people who wear a veil add their own twist to it. When considering the environment, the Middle East is geographically diverse. The Middle East seems to be defined by its deserts but there are also mountains ranges and rivers. One section of the world should not be defined as one thing. Many people see the Middle East as a backward “country” when it is, indeed, the contrary. Some of their cities rival those in the United States such as Lebanon, Iran, and Turkey. Demographic trends show that the Middle East has the “youngest population and it has the second highest urbanization rate in the world”.

One dimensional portrayal of women

A common misconception is that Middle Eastern women are oppressed and denied their basic rights because of their religion. Also, it is assumed, they must cover themselves with a veil because they are weak and passive. However, the concept of the veil actually came from Christian Byzantium, not Islam. Surprisingly, Islam gave women more rights than Western women, until the 19th century. In England, women were considered the property of their husband until 1882. However, Muslim women have always been able to keep their own assets. A more current example is when Muslim women are married they tend to keep their last name, while most Western women do not. Notably, in the Quran, Islam’s sacred book, it “states that men and women are equal in the eyes of God.” As you can see, Islam is not the determining factor behind women being oppressed. While religion can affect women’s rights, culture is the main factor driving the question of gender roles. As a result, you cannot assume all of the Middle East is the same and deem it as such. Depending on the region, women have different statuses and rights. While it is true that in Saudi Arabia women cannot drive cars, that is not true in other Middle Eastern countries. Women do have political and social rights in the Middle East, they just vary depending on the country. In fact, women have served as ministers in Iraq, Syria, and Jordan and as Vice President in Iran. That is not to say that the Middle Eastern women do not have problems, just that it is not as extreme as Western countries seem to think.

The Middle East deserves to be seen as diverse. By discussing location, religion, society, and gender people can gain a more open outlook on the Middle East. It is easy to let fear, ignorance, or the media dictate one’s perception; however, to change the cycle conversations must be created.

 

The Importance of Art in Human Rights

How does art affect humanity and human rights? Does it play an important role in human rights advocacy? Throughout history, people have used the arts as a form of self-expression by reflecting on their lives and what they observe. Art and design are constantly changing, and growing, with history. It is constantly being influenced while influencing societal events. As an artist and graphic designer, I believe that use of imagery influences societies, helping raise awareness of social and political issues. In the vast world of social and political arts, there are a few examples of work that stood out to me because of their contribution to society, namely: “The Hand That Will Rule the World” by Ralph Chaplin, “All Power to the People” by Emory Douglas, “The Anatomically Correct Oscar” by The Guerilla Girls, “Red Sand Project” by Molly Gochman, “The Blue Bra” by Bahia Shehab, and “America” by Touba Alipour. These are a few good examples of how art and design can impact human rights with solidarity, awareness, and protest.

The symbol of the clinched fist has been a symbol of solidarity as early as 1917. “The Hand That Will Rule the World” by Ralph Chaplin is an illustration referring to the IWW (Industrial Workers of The World). Industrial unionism began when skilled workers were displaced by modern machinery and the monopolization of industries. It was a union that believed industries should be controlled by the workers, benefiting the many instead of enriching the few, and create better working conditions. In this image, the workers are uniting their arms and creating one giant fist, which represents solidarity and unity, while holding tools, representing manuallabor, while factories in the backdrop symbolize the machinery displacing the workers.

The Black Panther Party was an African-American organization founded October 15, 1966 in Oakland, CA. One of their greatest successes was using imagery to reach people across the country about their movement. According to The New York Times, even though the Black Panther Party was associated with armed resistance, their most powerful weapon was reaching out to African-American communities through works of art. Emory Douglass, the artist behind many these images, has a background in printmaking and activism, pushing him to create images that show the injustice toward communities of color in the United States. His illustration “All Power to the People” is another example of the solidarity symbolism employed by the raised fist. The raised fist and the words “All Power to The People” brings a sense of unity to the viewer. Also, the person’s expression speaks on an emotional level, as if they’re shouting these words, making it a very powerful piece of artwork.

The Guerilla Girls are feminist activist group comprised of more than 55 artists. They describe themselves by saying: “We wear gorilla masks in public and use facts, humor and outrageous visuals to expose gender and ethnic bias as well as corruption in politics, art, film, and pop culture. We undermine the idea of a mainstream narrative by revealing the understory, the subtext, the overlooked, and the downright unfair.” This group of activist artists started in 1985 and, by the early-21st century, have expanded their awareness into the media world, namely the film industry. “The Anatomically Correct Oscar” brings awareness to the racism and sexism in the film industry by portraying a white male holding his genitals with text boxes demonstrating the percentage of people of color that have won Oscars in the past 86 years. The Guerilla Girls displayed this billboard in Hollywood a few months leading up to 2016 Oscars, noting, “the people we want to reach will see it…There is so much positive press around the Oscars – the gowns, the stars – that we decided it was time for another point of view.

“Red Sand Project” by Molly Gochman

Molly Gochman’s “Red Sand Project” is a worldwide instillation that takes a hands-on approach of bringing awareness to human trafficking. This project encourages all communities to pour red sand into cracks on sidewalks to recognize the overlooked populations (refugees, immigrants, girls, and others) that are at risk of slavery and exploitation. “These interventions remind us that we can’t merely walk over the most marginalized people in our communities — those who fall through the metaphoric cracks”, explains Molly Gochman. This informative, and largely interactive, work of art takes simple, yet powerful, gestures and to bring worldwide awareness through photography and social media. It is an ongoing project, raising action for those who are overlooked and vulnerable to human trafficking.

“The Blue Bra” by Bahia Shehab, 2011

In 2011, various outbursts of popular protests swept the Middle East and North Africa, causing a revolutionary wave called the Arab Spring. Staring from Tunisia and later spreading to Egypt, Yemen, Bahrain, Libya, and Syria, people were rising against their oppressive leaders. As the protests grew larger they were met with violent responses from authorities. One of the striking things that came out of this short period was the growth in street art, graffiti, and calligraphy. “The Blue Bra” by Bahia Shehab, located in Cairo, Egypt, is a great example of protest of oppression. This graffiti is part of an instillation called “Thousand Times No” which Shehab explains, “represents a rejection of both the conformity and the repression that often stifle the Arabic speaking region and Islamic cultures.” The text above the Blue Bra is saying “no stripping the people” and the sole of the military boot reads “long live a peaceful revolution”, calling the incident of a veiled girl who was stripped and beaten by police on December 18, 2011, and happened to be wearing a blue bra. In another location, Sheab installed a calligraphic graffiti which is an Arabic translation of Pablo Neruda’s quote, “you may crush the flowers, but you cannot delay the spring”.

“America” by Touba Alipour, 2017

Touba Alipour’s “America” is a mixed media artwork, curated by gallery director and artist Indria Cesarine, placed in The Untitled Space gallery’s “ONE YEAR OF RESISTANCE” exhibition in January 2017, shortly after the election of U.S. President Donald Trump. This exhibition, which included over 80 artists, addressed and protested policies that challenged human rights in our society such as immigration rights, health care, reproductive rights, climate change, transgender rights, white supremacy, gender equality, gun control, sexual harassment and many others. Among these artists, Touba Alipour addressed the travel bans placed by Trump which prevented people from six Muslim countries to enter the United States. “Being from Iran, it definitely affected me in different ways”, mentions Alipour, “I’ve seen families being torn apart, and they had green cards, they were living here, they just went to travel, and when they came back they were told they can no longer enter the country”.

Art is a way for people to express themselves, whether for the sake of imagination or to express ideas. It has been used effectively today, and throughout history, to send public messages about social and political issues. Human rights and the arts go together because of the expressive nature of both subjects. As people, we can stand up for our rights through expression. Due to their ability to create visual interest and to promote solidarity, awareness, and protest, artists and designers play a pivotal role in society by promoting human rights advocacy. Especially in the modern age, where people rely heavily on technology and media, it is important to send messages that work toward creating a society that respects human rights for themselves as well as others.
