The Right to Protest: Black Lives Matter and the Anti-Lockdown Protests

Throughout the summer of 2020, the cries of “Black Lives Matter!” and “I can’t breathe!” echoed across the United States. These cries took the form of protests that occurred in many cities around the country and even around the world. The increase of Black Lives Matter protests has been occurring in the months following the murder of George Floyd by police officers in May of 2020. Frustration over the lack of action by local and national authorities as well as community members themselves, led to some protestors to resort to violent tactics. It is important to keep in mind that while Mr. Floyd’s death was a catalyst that sparked the increase in protests, police brutality and the discrimination of black populations within many United States systems has existed since the times of slavery. These disparities within the system have been left unaddressed for too long, and many agree that peaceful protest will not incite the necessary action and change. However, while some of the protests have resulted in property damage and other violent acts, the majority of the protests have been very peaceful.

In response, President Trump has repeatedly called for a “crackdown” and continues to characterize protestors as violent and dangerous, despite the fact that over 90 percent of the thousands of nationwide protests have been peaceful. He declared New York City, New York, Portland, Oregon and Seattle, Washington, cities that have hosted several Black Lives Matter protests, to be “anarchist cities,” which in turn could make them ineligible for important federal funds during the Covid-19 pandemic. President Trump has also refused to address the very valid concerns of protestors, instead vowing to defend the police as opposed to answering the call to pursue reforms to the policing structure. He has taken an authoritarian approach to the Black Lives Matter protests, sending in federal agents to “take care of the situation” in cities where very large Black Lives Matter protests have been held. His response is in stark contrast to the response of protests held earlier in the summer, protesting state lockdowns and mask ordinances in response to the onset of the Covid-19 pandemic.

In Portland, Oregon, federal agents dressed in camouflage and tactical gear were called in to handle the local Black Lives Matter protests. They were part of ‘rapid deployment teams’ created by the Department of Homeland Security. Such agents were also deployed within Washington, D.C., San Diego, California, Buffalo, New York, and Las Vegas, Nevada. In D.C., federal agents utilized “chemical agents” to disperse a crowd. Also in D.C., military helicopters flew over protestors below roof level, causing panic and leaving protestors to run for cover. Some protestors described experiences of being grabbed off the street by plainclothes policemen and agents, thrown in a van, and being taken to a location where they were held for multiple hours without being told a reason for their apparent arrest. Lawsuits have been opened due to increased injuries experienced by protestors and accusations of the agents engaging in ‘unlawful tactics.’ The deployment of these federal agents into Portland and other cities is an extremely unnecessary show of force. The federal government labeled the protection of government property and the discouragement of unrest as the excuse for the presence of the agents. This excuse angered local authorities, with the governor of Oregon, Gov. Kate Brown, declaring the influx of federal agents a “blatant abuse of power.”

A few weeks before George Floyd’s death, in late April 2020, protestors gathered outside of Michigan’s state capital chanting, “Let us in! Let us in!” The protestors, many of them armed and carrying semiautomatic rifles, forcibly attempted to enter the Michigan capitol building. They were protesting the new state lockdown and restrictions that were put in place by Michigan’s governor in response to an increase of Covid-19 cases within the state. The protestors were tightly packed and very few were wearing masks. Some protestors shouted anti-government slogans and some compared Michigan’s governor, Gretchen Whitmer, to Hitler. One protest sign threatened to hang state officials and read, “Tyrants get the rope.” The horde of protestors was blocked only by state police and a few capitol staff members. Some of the protestors managed to get into the gallery above the main legislative floor and stood menacingly above lawmakers, waving semiautomatic rifles and shouting down at the lawmakers below. It became so bad that the few lawmakers who did own bullet proof vests began wearing them. Other similar protests occurred within Michigan and the sentiment was carried across the country.

President Trump’s response to these increasingly intimidating and violent protests? He encouraged them. In a series of tweets in mid-April, the president called on citizens to “LIBERATE MICHIGAN!”, “LIBERATE MINNESOTA!”, and “LIBERATE VIRGINIA…” At this time, the pressure to reopen the economy was extremely high and President Trump seceded any leadership during the pandemic to the state governors, while criticizing the ones who quickly invoked strict lockdown procedures and mask ordinances. He encouraged protestors and stoked an angry fire among his conservative supporters.

Within the United Nation’s Universal Declaration of Human Rights, several articles protect the right to protest. Article 7 declares equal protection under the law without any discrimination. Article 20 protects the freedom of peaceful assembly. Article 19 protects the freedom of expression. These are declared as universal human rights and the constitution of the United States echoes this important sentiment. Included within the First Amendment is the freedom of protest, or more specifically “the right of the people peaceably to assemble and to petition the Government for a redress of grievances…” Protesting has long been an acceptable way to make grievances known in the United States. So why were President Trump’s responses to these two protests so drastically different?

An argument has been made that the Black Lives Matter protests are so violent that they require a similar level of violence to be contained. The Armed Conflict Location and Event Data Project (ACLED) took information from over 7,750 Black Lives Matter protests and demonstrations across the United States. The organization found fewer than 220 of these protests violent. This means that more than 93% of Black Lives Matter protests have been peaceful. The definition of violence, as determined by ACLED, includes fighting against police, vandalism, property destruction, looting, blocking roads, and burning of items. They also included the toppling and destruction of Confederate and slave owner statues. Despite this evidence, many people still believe the Black Lives Matter protests to be largely violent. A poll resulted in 42% of respondents stating that they believe the majority of Black Lives Matter protestors to be oriented towards violence. ACLED believes that this misconception is perpetuated by biased and disproportionate media coverage of the protests and demonstrations.

Many studies have shown that police and federal agents have disproportionately interfered in the Black Lives Matter protests as opposed to other protests, like the mask ordinance protest in Michigan. President Trump’s actions have showcased a true bias against Black Lives Matter protestors as he actively works to impede upon their right to protest. It can very simply come down to the racism President Trump uses to dictate many of his actions and that his supporters continue to encourage. America was never a great nation to many groups of people and the presidency of Donald Trump has pushed the United States even further from greatness.

Inclusivity in Education: Cooperative Learning with Special Education

In 1954, the United States Supreme Court overruled the “separate but equal” clause of Plessy v. Ferguson with the case of Brown v. Board of Education of Topeka, declaring that “separate” educational facilities are inherently unequal. While Brown v. Board was aimed at addressing racial segregation, it is worth noting the implications of this view of separate educations because students with learning disabilities are often educated separately from their peers.  Our current education system divides students into different categories and programs based on their perceived levels of academic ability under the assumption that this is the best way to help students reach their fullest potential.  This is problematic and leads to students’ missing the benefits of an inclusive classroom.  Though it would not be a simple task, students who have learning disabilities should be educated alongside students who do not, using cooperative classwork, where students work together to complete an assignment or task, whenever possible.

The Americans with Disabilities Act defines a person with a disability as “a person who has a physical or mental impairment that substantially limits one or more major life activity.” For this blog, I will be focusing on learning disabilities, particularly those that do not completely inhibit functions that are vital in a traditional classroom, such as communication. However, I do recognize that the line that I am drawing between which disabilities/experiences of disabilities my proposal would apply to and those it would not is not completely clear, as no two people with the same disability have the same experience. The degree to which a person is able to participate in inclusive and cooperative learning would have to be determined on a case by case basis.

Article 26 of the United Nations’ Universal Declaration of Human Rights (UDHR) states that everyone has a right to an education.  Article 24 of the UN’s Convention on the Rights of Persons with Disabilities (CRPD) states that all people with disabilities have the right to “an inclusive education system at all levels and lifelong learning.”  The use of cooperative classwork among students with and without disabilities would hopefully help more effectively access these rights for both parties.  Additionally, by helping the members of each group become more accustomed to interacting and being part of a common social group, this can also help individuals with the types of disabilities that are focused on in this blog to access their right to employment (which is given in article 23 of the UDHR and article 27 of the CRPD) and their right to participation/inclusion in their communities (article 27 of the UDHR and article 19 of the CRPD).

Our Current System

When discussing whether students who have disabilities should be educated separately from students who do not, it is helpful if we begin by considering why we use the system we currently have.  A literature review titled “Implicit Assumptions in Special Education Policy: Promoting Full Inclusion for Students with Learning Disabilities” was published by Moira Kirby in the Child Youth Care Forum in 2016.  In the review, Kirby aimed to find special education trends relating to “inclusive practices, Response to Intervention (RTI), and student achievement.”  She argues that the educational system currently used in the United States, while meant to increase access to education, perpetuates certain students’ isolation from others, as it is based on problematic assumptions about disabilities.  The first assumption is that disabilities are deviant conditions that should be “eradicated.”  The second is that “all special services should be delivered in a separate environment.”  These assumptions inform the implicit biases about degrees of educational ability.  Kirby also argues that these assumptions must be changed in order to “promote access and equality for students with learning disabilities.”   In her article, she states, “The question is not, how can we fix a disability, but how can we make our classroom environments a place where all students can learn, regardless of their need.”

The educational system that is currently in place in the US involves separating students with learning disabilities, “low-performing” students, students who meet “average” expectations, and “high-performing” students.  This system is well-intentioned, theoretically giving each group of students the unique resources they need to reach the height of their personal capabilities.  In practice, however, this system is quite flawed.  It is a system based on expectations (typically informed by assumptions and implicit bias), which become harmful to many students, especially those with learning disabilities, due to stereotype threat.  Stereotype threat is “the risk of confirming negative stereotypes about an individual’s racial, ethnic, gender, or cultural group” and the effect that that risk can have on the individual’s performance.  Many people assume that students with disabilities will do poorly in school, and when students with disabilities know this, they often adopt those same expectations for themselves.  If academic success seems unlikely or even impossible, this can become a barrier to the motivation and access to resources that can lead to it.  Stereotype threat also leads students with learning disabilities to underestimate the quality of their academic performance overall, even at times when they are doing well.  They can start to assume that they simply cannot do well in school.

This sort of negative self-evaluation can also be damaging to a person’s mental health and well-being.  If one consistently sees themselves as not good enough, smart enough, or strong enough to do things well, it can be easy for them to fall into depression, anxiety, or another struggle with mental health.

Another problem that comes with stereotype threat is that it takes up precious cognitive resources.  Students spend part of their cognitive resources thinking about the expectations they are held to, distracting them from the work they are trying to do, and preventing them from using all of their resources to their advantage, which contributes to a decreased ability to perform well.

In her research, Kirby found that teachers who had been asked about inclusion in the classroom tended to attribute the success of attempts at inclusion to the students’ physiological traits rather than the value of inclusive practices.  She points to this belief as one that could potentially lead a teacher to believe that students with disabilities could be taught only separately from others.  They were also often found to lack confidence in their abilities to teach students with disabilities.  Parents also either had negative or neutral views on the impact of inclusive education.

In 2015, “68.2% of students with learning disabilities spend 80% or more of their day in the general education classroom, while 24.1% spend 40-70% of their day in the general education classroom.”  This in no way aligns with the idea that students with learning disabilities need to be educated separately from other students, and it highlights a point of concern.  If many general education teachers do not feel like they are able to teach students with disabilities, and most students with disabilities spend a large part of their day in general education classrooms, what implications do these things have regarding those students’ education?  Ideally, students would be educated by someone who felt they were qualified to teach them rather than someone who is uncertain about it.  If students with different educational needs were consistently taught in the same classroom, teachers would all need to go through the training necessary to teach students with special educational needs, allowing them to better support their students.

An Inclusive Educational Environment Can Be Beneficial For All Students

The negative impact that a segregated educational system can have on students with disabilities is not the only reason to move towards a more inclusive system.  Evidence that suggests that inclusive classrooms can lead to positive outcomes for all of the students involved.

In their article “The challenges of implementing group work in primary school classrooms and including pupils with special educational needs,” Ed Baines, Peter Blatchford, and Rob Webster review the results of two research projects: the SPRing (Social Pedagogic Research into Group-work) project and the MAST (Making a Statement) project.  Realizing that most studies regarding collaborative work in education that had previously been performed had been on a small-scale and short-term basis, the authors reviewed the results of these two projects to come to a better, more reliable understanding of the challenges of inclusive group-work in primary schools.

The SPRing project was a five-year-long project that aimed to “develop and implement with teachers a programme of principles and activities that incorporated group work  into curriculum and everyday school activities” and “to evaluate this programme relative to a control group in terms of academic progress, behavioral interaction and dialogue, and attitudes and motivation towards learning.”  The developed program included a handbook and six training sessions where teachers could develop the skills that they need to incorporate group work into their lessons.  The four main areas covered by the program included “preparing the classroom and group context for group work,” “preparing lessons and group-work activities,” “preparing adults to support pupils and groups,” and “preparing pupils for group work.”

The results of the SPRing project show that, relative to the control group, the students that participated in the program made more progress in general science tests, “were more actively engaged in task interactions,” had more sustained interactions, and “engaged in more high-level reasoning talk.”

The MAST project “involved systematic observation and case studies” of students with known special educational needs that were being taught in general education classrooms. This project’s results provided Baines and his co-authors with information about the interactions between students with special educational needs and adults/peers.  The project found that students with special educational needs “were half as likely to work with or alongside peers” as other students.  It was also found they were often isolated from the other students.  Some of the reasons for this isolation included a student with special educational needs choosing to sit away from the others, and other students being afraid of or nervous about working with them.  One factor that may contribute to each of these reasons could be that the students with special educational needs that were a part of the study may have had poor social and communicational skills.  While difficulties with communication are an aspect of many learning disabilities, inclusive group work may give these students an opportunity and a safe environment in which they can develop these skills (though a student should never be pushed to do group work if it causes them an amount of stress that is genuinely detrimental to their well-being).

This isolation of students with special educational needs may also result from traditional students and school faculty viewing people with disabilities as “the other” as being outside of normal.  This would help to explain why traditional students may be hesitant to associate with students who have disabilities.  It could also explain why students with special educational needs isolate themselves from other students, as they may have internalized their peers’ view of them.  They may feel like they are on the outside looking in, unable to be a part of the rest of the group.

In her literature review, Moira Kirby also addresses some of the benefits of inclusive educational settings, as suggested in different case studies.  In one study, elementary school students scored higher in reading and writing when taught in a general education classroom rather than a separate special education classroom.  Another study found that eighth-graders with learning disabilities had “significantly higher scores in math academic achievement tasks and self-concept” when taught in an inclusive classroom. Students from another study scored higher in math, science, social studies, and language arts.

Students without learning disabilities may also benefit from inclusive educational environments.  Students who perform well could potentially benefit from working with students with disabilities and helping them understand the topics they are learning about and the group work they might do.  Re-wording and explaining a concept to another person can

help cement one’s understanding of it.  Additionally, if all teachers have to teach classes with children with different educational needs, they would have to be prepared to work with students with disabilities, which would improve the support that those students receive and broaden teachers’ perspectives.  This could allow teachers to develop skills that would be beneficial in teaching all students, with or without disabilities.

 Concerns and Challenges

Though there are many advantages to adopting a more inclusive educational system, there are still concerns and challenges that also come with it.  One concern is that students with learning disabilities may face social rejection from their peers.   For their article “The Social and Emotional Situation of First Graders with Classroom Behavior Problems and Classroom Learning Difficulties in Inclusive Classes,” Johanna Krull, Jürgen Wilbert, and Thomas Hennemann surveyed 2,839 first graders and found that students with “classroom learning difficulties” (CLD) and “classroom behavioral problems” (CBP) were at a greater risk for social rejection than their peers.  However, the authors found several outliers in their data, where students with CLD or CBP had higher rates of social acceptance, and they interpret this to mean that, under the right circumstances, an inclusive education system is possible.  In their article, Baines and his co-authors suggest that social rejection in this context can decrease over time when students are involved in inclusive group-work (if the students remain in the same groups throughout that time). Group work allows students with disabilities who struggle with social skills to develop those skills. It will enable other students to better understand people’s experiences who are different from them, which may lead them to be more willing (and happier) to be inclusive and build friendships with other students.  If a student has no/little prior experience with students with learning disabilities, it would not be surprising to find that they are nervous or uncomfortable interacting with them.

When discussing the possibility of an integrated classroom, people are also concerned with the impact of having children with severe behavioral issues in general education classrooms, as they may become distracting or disruptive to the point of preventing any productivity in the class. This may be a factor that needs to be considered on a case-by-case basis. Some children that are deemed as being too disruptive have the potential to become less disruptive with exposure to a traditional classroom setting.  There are likely situations where students truly are too disruptive to allow for a productive classroom, but that is certainly not always the case.  It is important that, if a student is found to behave in a distracting way, that they are not immediately moved into another classroom after a single incident (although consideration should be given to the severity and the nature of the interruption). They should be given the opportunity to try and adjust to the traditional classroom environment before they are placed in a different one.

Another concern is that educating students at such a range of degrees of ability in the same classroom might prevent both students with learning disabilities and students that are currently in advanced programs from reaching their fullest academic potential. This concern is largely connected to the assumption that being in the classroom means that students would all be learning from the exact same curriculum, but that is not necessarily true.

In her article, Kirby suggests that a completely inclusive classroom might not involve basing lesson plans on the categories that students have been assigned to.  Instead, each student would have an Individualized Education Plan (IEP). In our current public education system, children in special education programs must have an IEP, a “map that lays out the program of special education instruction, supports, and services kids need to make progress and thrive in school.” Each child has an IEP team, including their parents, at least one general education teacher (unless the child does not work with any), at least one special education teacher, a school district representative, a school psychologist/specialist, and the child.  After the IEP is developed, the team regularly meets to discuss progress and possible changes for the plan.  If every student, whether they have general or special educational needs, has an IEP, then (in theory), each student could have their personal needs recognized and met in the classroom.  Kirby also suggests that making IEPs standard for all students could reduce the impact that the stigmatization of learning disabilities has on students, as school faculty would be less reliant on separating students into different/broad categories to teach them.

Of course, creating an IEP for every student in the public school system is much easier said than done and is a much more attractive idea in theory than in practice.  It would require a significant shift in the allocation of resources in education, which may not be practical with the financial resources we currently have access to.  It would also be asking many teachers, as they would no longer be able to teach with a singular lesson plan. It is unrealistic to expect teachers to carry this burden themselves, as they are already spread too thin, given more responsibilities than they can reasonably handle.  Having IEPs for every student would likely require a serious increase in the number of teachers at each school or at least an increased/reinforced support system for school faculty. Perhaps a more feasible solution could be developing IEPs for students with a clear need for increased educational support that involves their being more present in the traditional classroom than in a separate one.  While this is still likely to feed into the stigmatization and othering of students with disabilities, there do not seem to be any strong alternatives that are both practical and successful in avoiding stigmatization altogether.

Conclusion

In short, we should aim to educate students with and without learning disabilities together whenever possible, even though it will take a lot of time and effort to do so.  We currently separate students based on expectations of their academic abilities, and these expectations are informed by and reaffirm problematic assumptions about people with learning disabilities.  This can be harmful to people with learning disabilities and prevent students with all degrees of educational needs from accessing the benefits that can come from an inclusive classroom.  However, it is important  that we recognize and genuinely consider the concerns and challenges that arise when we look to put inclusive education ideals into practice.  It is also important to recognize that the conclusions that can be drawn based on the resources used to support this argument are limited, as many gather data from anecdotal situations and small samples sizes.  These factors prevent the results of sources from being reliably representative of experiences with inclusion and students with learning disabilities on a larger scale.  The application of my argument is also limited, as I have focused on students with learning disabilities that do not completely prevent them from effectively learning or functioning in a general education classroom.  While an integrated school system is generally optimal, there are some students for which that kind of system genuinely would not work.  We cannot treat all students with disabilities as if their experiences are the same by assuming that all would do poorly in an inclusive classroom or that all would be unquestionably better off in an inclusive classroom.  Overall, even though it will not be easy, even if we can never achieve a perfectly integrated educational system, it is an important goal which we should work towards for the benefit of all students and their educational rights.

“Eat the Rich!”: A Rallying Cry Against Income Inequality

Throughout the pandemic, I have found my social media use rise exponentially. I think it is a way to find human connection, when my primary form of social interaction is with my roommates. Apps like Instagram, Facebook, YouTube, and more recently, TikTok, allow me to check in on my friends and family across the world but they also allow for a version of political discourse to take place. From sharing news articles to posting pictures with informative captions, rallying cries have spread across the internet urging users to participate in social change as much as possible.

One of these rallying cries brought back a centuries old phrase. Jean-Jacques Rousseau said in the context of the French Revolution and its aftermath, “When the people shall have nothing more to eat, they will eat the rich.” This sentiment has returned in 2019 and 2020 in the United States, especially as class divides become even more apparent in the wake of the Covid-19 pandemic. The phrase “Eat the Rich!” can be seen in captions, videos, and even as a spoken phrase. Rallies and protests have seen signs with the words “eat the rich” written upon them and cities have heard the ring of those words in the form of chants. It is important to understand that in the 21st century, “Eat the Rich!” is referring to the top 1 percent, the companies, corporations, and government officials who have profited off the suffering of others. This phrase is not geared towards upper middle class families, a common misconception that has created a backlash. Instead, it is geared toward the city of New York for installing new, high tech security measures to ensure payment for the subway and toward huge companies who directly contribute to climate change as we watch an entire state burn. These are just a few examples, but the class resentment is very apparent and perhaps rightly so.

In 2016 and 2019, American families were able to save substantially, according to the Federal Reserve data. Despite that, the wealth inequality did not shift much, and this was all before the onset of the coronavirus pandemic. The facts and figures of the Federal Reserve and the Survey of Consumer Finances of the past few years show a higher median income. Though these depict an improvement, the savings most Americans have do not even compare to the rates of savings before the 2008 recession and the amount of wealth the 1 percent has is nearing a three-decade high. To put this in perspective, in 1989 the top 1 percent held almost 30 percent of the United States wealth. In 2016, this number about 40 percent, and it has not shifted lower since. Stocks and other assets are starkly concentrated within the wealthiest 10 percent of Americans, with the median family within this 10 percent holding about $780,000 worth of stocks. For the bottom 25 percent of Americans, this number barely reaches over $2,000. This comparison disproves the performance of the stock market as a sign of success for Americans in general, a claim President Trump often makes.

This income gap is much starker when racial disparities are taken into account. The median wealth of a black family is less than 15 percent that of a white family’s net worth. For black families, this is $24,100 in comparison to white families’ $188,200 in 2019. The median wealth for Hispanic families reached $36,100. It is becoming increasingly clear that the gap is widening due to black and Hispanic families being disproportionately affected by the coronavirus outbreak. With the impact of coronavirus comes a sharp increase in unemployment for low skill worker and high interaction jobs, jobs primarily offered to Hispanic and black workers due to the rampant discrimination in the American job market.

The top of the top 1 percent in the United States is Jeff Bezos, founder and CEO of Amazon. In August of 2020, Bezos became the first person to ever be worth over $200 billion dollars. Without a doubt, he is the world’s richest person at 56 years old. The third richest person in the world, LVMH chair Bernard Arnault, is $90 billion dollars poorer than Jeff Bezos. Amazon is one of world’s wealthiest companies and has profited greatly from the pandemic, much at the expense of its workers. The workers at Amazon have been providing essential supplies in a quick and secure fashion to quarantined individuals all across the world. While Bezos and the company of Amazon profit, these workers feel as if their own health and safety are being exchanged for Bezos’ next billion dollars. Amazon responded to the outbreak with the bear minimum: a temporary increase in wages by $2 an hour and implementing measures like temperature checks. In April, hundreds of Amazon workers protested the way Amazon had been handling the coronavirus outbreak by calling in sick to work. Groups like Amnesty International very quickly issued public responses in support of the workers and demanding Bezos respond to his workers requests. The manipulation and abuse of influence by Jeff Bezos has not been a new phenomenon.

In 2017, Bezos was awarded the National Equality Award by the Human Rights Campaign for his work in support of LGBTQ+ rights. He had pledged over $2 million in 2012 for the fight for same-sex marriage. A year after being honored by this award, Bezos and his wife each wrote checks for $5,400 to Colorado Senator Cory Gardner’s campaign, a Republican senator known for his anti-LGBTQ agenda. $5,400 is the maximum amount of money an individual can give to anyone seeking office, and eight other Amazon representatives followed Bezos example by donating the same amount of money to Gardner’s campaign. While Senator Gardner’s anti-LGBTQ+ sentiments may not be the sole reasoning behind the large Amazon support, it is incredibly hypocritical that in 2017 Bezos graciously accepted a human rights award for his work for the LGBTQ+ community.

In 2018, Amazon employees sent a letter to Bezos requesting that he stop selling the Amazon face surveillance product to law enforcement. They stated that it was a tool used to direct violate human rights. The letter came just a few days after the ACLU and other community partners delivered petition signatures, a coalition letter, and a shareholder letter to Amazon regarding the same subject of the dangers of the face surveillance product.

These are just a few examples of how a member of the top 1 percent is able to push their own agenda and further the widening income inequality gap to line their own pockets. Jeff Bezos is the richest person in the world and is a primary contributor of the income gap in the United States. The rallying cry “Eat the Rich!” is aimed in the direction of Bezos and those like him including Facebook’s Mark Zuckerberg and Walmart’s Walton family. This is not a call to cannibalism but is instead a call to action. The income inequality in America is devastating and tax holes and other mechanisms designed to keep the rich, rich and the poor, poor must be held accountable. The Covid-19 pandemic made the system inequity even more apparent and people are ready to fight to make the United States a more equitable place.

The Most Disrespected: What does no Justice for Breonna Taylor say about the Treatment of Black Women in America?

On May 22, 1962, Civil Rights Leader Malcom X spoke in front of a crowd of Black Americans in Los Angeles. Malcolm X was a fiery and passionate orator, and his words have become an inspiration for a new generation of social justice advocates and human rights workers (Yahoo!). On that fateful day, Malcolm X said something that I believe is more poignant now than ever before.

              The most neglected person in America is the Black woman.”

Breonna Taylor was a twenty-six-year-old EMT from Louisville, Kentucky. In March of 2020, three officers from the Louisville Police Department botched a raid on her apartment. After Taylor’s boyfriend responded to the no-knock warrant with a defensive shot, the officers shot more than thirty rounds into the unit, killing Breonna Taylor while she was sleeping in her bed (The New Yorker). Protests broke out across the nation over the spring and summer following the death of Breonna Taylor. The pressure from the nationwide protests did lead to the adoption of Breonna’s Law by the Louisville Metro Council, outlawing the use of no-knock warrants (Stanford Law School). For many protestors, this was one step forward in achieving the types of reform that would help prevent senseless violence from occurring in police-citizen interactions. The protestors held their breath across the nation as Kentucky’s attorney general Daniel Cameron delivered the verdict on a grand jury’s indictment of the three officers involved in the death of Breonna Taylor.

September 23, 2020: An Outpouring of Anger and Grief

On Wednesday, September 23, 2020, Attorney General Daniel Cameron delivered the decision of the grand jury. No indictments would be made specifically related to Breonna Taylor’s death. Officer Brett Hankison of the Louisville Police Department was indicted for “wanton endangerment” because of his firing his weapon without any clear target, leading to reckless damage to neighboring apartments in the complex (New York Times). Just minutes after the indictment was read, the news became the number one trend on Twitter. Protestors and activists grieved that justice was never served for the death of a young medical worker. Protests broke out across the nation once again. Celebrities and politicians shared their outrage for how the case was handled by the grand jury and the attorney general. A viral image of a protest sign that read “A cop shot a Black woman and was only charged for the shots missed” was shared by international pop star Rihanna, and the post has garnered over 400,000 likes (Twitter).

Black Women Deserve Dignity

As a junior in college studying anthropology and political science, I was deeply disturbed by the senseless deaths of Black Americans at the hands of unnecessary police violence, and spent a large part of my summer protesting with and researching the Black Lives Matter movement. At the very core of the movement is an idea that I have found to also be the core of human rights work and advocacy – the concept of human dignity. According to The Center of Bioethics and Human Dignity, human dignity can be defined as “the recognition that human beings possess a special value intrinsic to their humanity and as such are worthy of respect simply because they are human beings” (CBHD). This concept has been extremely influential in shaping the human rights movement and the way our current political and justice systems work in theory. The concept of human dignity was used by Enlightenment thinkers to quantify the idea of “inalienable rights”, an idea that was essential to the foundation of the United States.

All human beings inherently deserve dignity. This is the basis for our legal systems, our ideas about morality, and the way we conduct ourselves day to day. For the vibrant activist community in the United States, it’s clear that Breonna was deprived of her dignity, and is one of many Black women who face institutional violence day to day.

Even activists had trouble keeping the news of Breonna Taylor from turning into entertainment. According to Mashable, Breonna Taylor’s death had much of its significance taken away as social media users on Twitter “repeated the phrase in hopes of spreading awareness and gaining visibility”, but ultimately “Taylor’s death became an insensitive meme” as “Arrest the cops who killed Breonna Taylor” turned into a way for content creators to gain relevance and attention, similarly to “Jeffrey Epstein didn’t kill himself” was a buzz phrase earlier in the year (Mashable). This type of faux-activism did nothing to bring Breonna Taylor justice, and instead reminded countless black activists of the violence people of color face in America on a day to day basis. Twitter user @daniellecanyell said it perhaps better than anyone else, writing on June 23 that “breonna taylor’s death being commodified into a meme is really enough to tell me that y’all do not actually value the personhood of black women” (Mashable). The commercialization of the suffering of Black women and people of color in general is a clear symptom of the denial of human dignity that Black women face.

Where Do We Go from Here?

For Breonna Taylor, the truth may still come out. On September 28, 2020, news broke that an anonymous member of the grand jury involved in Breonna Taylor’s case was suing for the release of the secret footage of the proceedings, and Kentucky’s attorney general agreed (AL.com). Uncovering the truth about this case will not bring Breonna Taylor back, but it may provide healing for her family and allow her to rest in more dignity and peace than she was given alive.

For many activists nationwide, the grand jury’s decision reignited passion in fighting the systemic injustice Black people face in America. The response to the deaths of George Floyd, Breonna Taylor, and many others was labelled by the Harvard Carr Center as perhaps “the largest movement in US history” (Harvard). Research done by the Crowd Sourcing Consortium revealed in July that anywhere from fifteen million and twenty-six million Americans have participated in protests nationwide (Harvard). This number has absolutely increased in the months that have followed, as protests picked up again after the grand jury’s decision was read on September 23. The Black Lives Matter movement is a movement that will define Generation Z, and it’s push for positive reforms in our institutions will be heard, even if it is a long and uphill battle.

Human Rights in the Appalachian Region of the United States of America: an introduction

People living in the Appalachian region of the United States have been victims of a number of failures to protect their basic human rights since at least the nineteenth century. As a result, in nearly every measurable socioeconomic category, the Appalachian region lags behind the rest of the United States in development, or even shows signs of decline. This, in combination with their remoteness and social isolation, has led to a remarkably divided society evidenced over the last hundred or so years. Outdated and incorrect perceptions of the Appalachian people have led to antagonism and a struggle to implement democratic institutions that protect some of America’s most vulnerable populations.

The Appalachian mountains in the Eastern United States extend across thirteen states and are home to over twenty-five million people. Appalachia struggles with problems typical of rural poverty: social stratification, unemployment, lack of social services, poor education, and poorly developed infrastructure. The Appalachian region, and its perceived separateness from the rest of the Eastern and Southern United States, is especially relevant in contemporary times of remarkable social division. Healthcare disparities, income inequality, and extensive exploitation of Appalachian communities by outside corporations have all contributed to distrust and frustration among their inhabitants. In the late 19th and early 20th centuries, a large number of Appalachians sold their rights to land and minerals, leading to a massive disparity in ownership and control of the land. Ninety-nine percent of the residents of Appalachia control less than half of the land — despite the area’s vast natural resources, inhabitants remain poor (Hurst).

The Appalachian region has had a higher poverty rate and a higher percentage of working poor than the rest of the nation since at least the 1960s, in addition to low wages, low employment rates, and low-quality education. To address this, the Appalachian Regional Commission (ARC) was established in 1965, as a joint effort of ten governors of Appalachian states seeking federal government assistance. Still, by 1999, nearly twenty-five percent of the four-hundred twenty counties in the region qualified as “distressed”, the ARC’s lowest status ranking. Fifty-seven percent of adults in central Appalachia did not graduate high school, compared to less than twenty-percent for the rest of the United States. According to ARC, thirty-three percent of Appalachians suffer from poverty and their income was twenty-three percent lower on average than the level of American per capita income. There has been some improvement, however, with levels of economic distress reaching lows not seen since before the recession in 2007 (ARC.gov).

In addition to economic inequalities, political inequalities are present in Appalachia. Racial divisions have often been stoked to divide workers and pit races against each other. During Reconstruction, the period after the American Civil War in which Southern states were radically reformed, coal corporations discouraged education and civic action, forcing workers to become indebted to company stores, live in company housing, and generally become vulnerable to their employers. Community members regularly experienced punishment as a reprisal for speaking out against their employers. In his study of culture and poverty in Appalachia, Dwight Billings suggests that this has resulted in a fatalistic attitude in the Appalachian people, based on a history of political corruption and disenfranchisement, leading to a sense of powerlessness.

The plight of the Appalachian people is deeply ingrained in me and will remain always of academic and personal interest. My own paternal kin originally settled in the Appalachian Mountains in North Carolina after arriving in America. As far as we can tell, my ancestors passed through the Cumberland Gap in the mid-eighteen-hundreds or earlier, finally homesteading in the foothills of the Appalachian Mountains on Sand Mountain, in northeast Alabama. On the other side of my family, my maternal ancestors shared many of the same challenges living as sharecroppers and later as miners in north-central Alabama. Eventually, both sides of my family came to work in blue-collar industrial jobs in mining and steel-work, industries that would become encumbered by the same failures, oppression, and corruption that were endemic in their Appalachian cousins.  My great-grandfathers and my paternal grandfather were heavily involved in the labor movement in the American South and leaders of rights-protecting unions, such as the United Mine Workers of America and United Steelworkers, even as those same unions fell into disorder and ineffectiveness.

My research has indicated that one of the best ways we could better protect workers and their human rights would be to focus on the renewal of unions in the Southern and Appalachian Regions of the United States. Unions have been shown to raise wages, reduce wage inequality, and protect rights for workers. Higher rates of unionization and collective action generally tends to be an indicator for greater respect of human rights in industry. After declining membership from its peak in 1954, a once-thriving union movement had shrunk to nearly a third of its size by the turn of the 21st century.

Corresponding with this drop in membership, middle class incomes shrank accordingly. The Labor Department did report the first increase in union memberships in twenty-five years in 2007, which was also the largest increase since 1979, but it appears that this was a short-term gain in the larger scheme of things. Taking a broader look shows that from 1983, union membership has been on a steady decline.

One silver lining is that there seems to be a slight turning of the tide among women and Black people, whose membership in unions is stabilizing at least, if not increasing slightly. If unions are meant to preserve and protect the rights of workers, it should inspire some optimism that some of the most vulnerable workers, BIPOC and women, are seemingly joining unions at higher rates than other demographics.

In a series of blog posts for the Institute for Human Rights, I will explore some of these challenges with which the Appalachian region are faced — workers’ rights challenges and the possibility of renewal for unions, socioeconomic disparity and the ensuing human rights failures in the region, and the political inequalities that are especially present in the region. In my next post, I will tell the story of the Battle of Blair Mountain, and describe the ways corporations have exploited workers and prevented unionization in the past. We will analyze how these barriers affect workers’ rights in some of the most vulnerable populations in America.

High School Student Perspectives on the Duel Pandemics Facing Our Country

Over the summer, I had the opportunity to talk to Breakthrough Birmingham students about human rights. Breakthrough Birmingham is an affiliate of the Breakthrough Collaborative, an educational program in which college students from across the U.S. teach high school students in traditionally underrepresented communities in an effort to reverse educational inequity and help students achieve post-secondary success. This summer, Breakthrough went fully virtual, and although this had its challenges, I was amazed at how successfully the leadership pivoted and stayed committed to providing quality education for the students. During our time together, the students and I talked about what human rights are and different examples of human rights violations, particularly those related to the COVID-19 pandemic and anti-Black police brutality and injustice. As part of our class, I invited students to write for the IHR blog, to reflect on how the duel pandemics of Covid and racial injustice are impacting their lives and what they hope to see happen in the future. While the conversation rages over how to resolve these crises, the voices of our nation’s young people are often lost in the noise. But they are certainly an important part of this conversation, as they will inherit the world that we leave them and be left with either a huge mess to clean up or a legacy of progress to carry forward. I wanted to share two essays from Breakthrough students Jeremy and Charles. 

Jeremy*

One day I was in school learning like normal, then bam! The world suddenly changed. I am going to be talking about Covid-19, aka coronavirus. It is very important to talk about this because people are dying daily and more and more families are suffering from the recovery of their losses. It is impacting how stores handle things and how we make money. Personally, I am uncomfortable with this situation going on, and I do not like it at all. It is really bad for me and everyone else on this planet. It is boring having to stay inside my home for an extended amount of time. When Covid first arrived I was actually excited that I was able to stay home. After a while though it started getting really boring, now I want to go back to school to see my friends.

I have mixed emotions about this. Like I said earlier staying home was great! I was all happy and joyful that I was able to stay home and sleep in as much as I wanted. Now I am just waiting until I can escape and go to school like normal!

In the world today, there are a lot of changes I want to happen. First of all, there is a lot going on while in quarantine. All the violence, Kanye West running for president, the “Karens,” aka the people who refuse to wear masks because of their president’s orders, and the other stuff that shouldn’t be allowed to happen. I think there are a lot of ways we can make this change. For example, the Black Lives Matter protests are attempting to make positive change.

The schools are already helping us students make that change, by sending quizzes on if we should go back to school, rotate days, or just do virtual learning. I think I could have my family go out more to make the experience more normal.

After all this mess going on I would like to just say this, don’t worry! I know a lot is going on right now, and it is just messy all around, but we will get through this! It will definitely be over soon, but it will still feel like it is lasting forever. If you know what I mean. Staying positive during this pandemic is key. I always like to stay as positive as possible. Just like any other person, I have experienced things that shouldn’t be happening on a daily basis! On the bright side, this whole situation does make me feel thankful and alive because I am able to spend more quality time with my family.

The pandemic has made me feel like I can handle that anything comes my way. This is not always the case though. Everyone in the world may feel strong, prepared, ready, but who can tell us what’s coming? This really tells us how anything can happen with just a snap of the finger! From sunny skies to dark clouds and thunder. From daily life to Covid-19.

Charles**

Many people are affected by anti-Black police brutality. Many people are killed due to this, particularly, George Floyd’s death, which was recently in the spotlight. Anti-Black police brutality does not just stop there. Celebrities, such as Jay Pharaoh, have faced police brutality because of the color of their skin. This topic is important because this is an ongoing problem that needs to be stopped. I understand what it is like to have friends and family who are police officers, but we still need to hold them accountable.

I feel distraught every time that I think about police brutality. I have to face the thought of being a victim of police brutality. It makes it harder now because everywhere I go I’m scared that I might be beaten by the police. It does not get any easier. Now the thought of driving is becoming a reality, and that idea fills me with fear. My mom for instance constantly talks about how to approach an officer if I were ever stopped. This is a thing that most African American parents talk about or should talk about with their kids.This is important to me because I cannot predict if I will or will not be one of those victims of police brutality.

My experience with this topic is hearing about people being beaten by the cops.  Also, I have recently seen these things in the media. I’ve had experiences in which I, personally, was scared to call the police because I thought I would be the next victim of police brutality. I never had an encounter in which I was beaten by the police, but seeing events like this occur on the news and social media platforms impacts how I see the police force in the United States.

I know that no matter how many protests we assemble, the act of police brutality will never end. As human beings, sometimes we have to make compromises. I think we can solve this problem by making sure police officers swear to not brutalize innocent people based on race. This should be a part of the oath they swear by, and there should be punishments for not complying with this oath. According to a New York Times article, in 2019, 59% of Police-reported uses of force in Minneapolis were used on African Americans. This statistic shows that African Americans are most likely to face police brutality. A DoSomething.org article shows that in New York City in 2018, 88% of police stops involved Black and Latinx people. The article also states that 70% of those who were stopped were completely innocent. I do think that police officers should be held culpable for their actions. These statistics are examples of African Americans being more likely to face police brutality or harassment.

I think that instead of being more accepting of different races and cultures white Americans are being more hateful towards minorities, especially Black people.  The ongoing anti-Black police brutality has made me grow more furious each and every day. Systemic racism and politicians lead white people to misinterpret the reality of life as Black people in America. White Americans should use their privilege to educate themselves and use their voices to advocate with Black people instead of using their voices for ignorance. Rather than learning new Tik Tok dances or trying to go viral, people should utilize their voice and the endless resources available to educate themselves and their followers on the history and present state of our nation.

COVID-19 Pandemic Has Drastically Worsened Worker Protections for America’s Journalists

Throughout the past three decades, newspapers, magazines and online sources of news and analysis have faced deepening challenges. As I explained in a blog post last year, “the labor crisis in journalism [is] a human rights concern unto itself.” In particular, consolidation of media outlets into fewer holding companies restrains the “viewpoint diversity” in coverage, an essential quality for citizens of democratic societies to stay informed and to hold leaders to account.

Just over a year later, these concerns have only escalated with the twin public health and economic crises brought on by the novel coronavirus pandemic.

The Poynter Institute has maintained a regularly updated list of all closures, pay cuts, furloughs, layoffs and other employment changes at American outlets, here. One cumulative figure for media-sector impacts? Over 36,000 to date in 2020, according to the New York Times.

Granted, media and journalism job losses are a small fraction of total job losses. According to another New York Times report on unemployment claims since the start of the pandemic, estimated at 36 million jobs vanished throughout the United States through mid-May; by May 21, NPR added in an update, the total climbed to 38.6 million unemployed, with America’s poorer families and minority communities facing job loss rates double the national average.

Because of the advertising revenue-based funding model for most media organizations today, however, proportional financial losses in the field have been extreme, far offsetting increased readership and subscription rates. At Boston Globe Media—publisher of the storied daily paper, The Boston Globe—subscriptions surged by more than a third between March and May, but ads plunged by 30%, according to Digiday. Per CNBC, meanwhile, the New York Times might see ad revenue drop by a staggering 50 percent in the second quarter of 2020.

The same pattern is everywhere, from global conglomerates like Disney and major city papers like the Dallas Morning News to countless smaller, local outlets nationwide. At the extremes are cases like Cleveland’s 178-year-old daily, The Plain-Dealer, which cut almost its entire unionized staff by April 2020, leaving only some “60 to 65 journalists” at Cleveland.com, “a sister non-union company,” reports Poynter.

A subject covered less comprehensively amid drastic shifts is the combined effect of remote work, lockdowns and mass layoffs on labor organizing and activism—to say nothing of daily individual hardships—throughout this industry. In brief, it’s been a bloodbath. VICE Media offers an instructive example.

In mid-April, the Wall Street Journal initially reported that some “300 Vice employees in its digital operations unit” were set to be laid off, per an internal document obtained by the Journal. In response, as The Hill reported, Vice pushed back, claiming “that the plan [had] not been ‘vetted or endorsed’ by Vice Media Group and that no decisions at the company [had] been made.” Just a few weeks later, VICE ultimately went ahead with layoffs, though fewer than the Journal had suggested: cutting 155 workers as of May 15, on top of roughly 250 just a year earlier.

CNBC’s accounting of VICE’s latest cuts noted that the latter company’s CEO Nancy Dubuc blamed “not only…coronavirus, but [also] Big Tech companies taking the lion’s share of digital advertising growth.” Dubuc’s comment is an understatement: As of 2019, just three firms—Google, Facebook and Amazon—collected “68.1% of all digital ad spending,” including 69% of mobile ads.

At the same time, the extraordinary financial stratification of digital media companies has not gone unnoticed. Kim Kelly, a freelance journalist who has been published in Teen Vogue and contributed to The New Republic and others, in addition to VICE, said on Twitter that this “annual bloodletting ritual” left her “sad and furious.”

Kelly pointed to Dubuc as one example of many sky-high “executive salaries,” despite the precarity of rank-and-file journalists: While Dubuc’s VICE CEO salary has not been published, the New York Post in 2016 published details about her sale of a 4,200-square-foot Upper West Side townhouse for $9.4 million.

It’s part of an indelible pattern at media firms. Poynter noted early last year that even companies with “revenues down, posting a loss and stock price sliding” still pay out millions in top-level corporate compensation – more than “$5.2 million for [Gannett’s] Bob Dickey and [$2.8 million] for Craig Forman at McClatchy.” Coronavirus-related layoffs at McClatchy have hit roughly 4.4% of all staff; Gannett has laid off an unknown number of workers at its 261 newspapers throughout the country, though dozens of smaller-scale losses have been reported individually.

(As a structural concern, these patterns map onto the trajectory of TV broadcasters a generation ago. As Halliwell and Morley explained in American Thought and Culture in the 21st Century, deregulatory actions from the 1980s through the 1996 Communications Act “loosened restrictions on station ownership [and] allowed media conglomerates…to amass greater numbers of [TV] and radio stations” (p. 278). Many of the same conglomerates own significant stakes in digital and print media firms today, replicating their TV models at newspapers and magazines.)

Back at VICE, the company’s WGAE-represented union was blindsided by the cuts, condemning the company’s leaders for “repeatedly failing to discuss workshare programs…used to avoid layoffs” at other outlets, according to a union statement posted on Twitter. Moreover, the statement continued, VICE “did not agree to make further cuts to executive compensation” to avoid layoffs “in the middle of a global pandemic.”

Between the more than 30 million unemployment claims and tens of thousands of media-sector layoffs since the start of the pandemic, though, a large number of freelance workers have been excluded from most tallies. Especially in media, where delays in paychecks and low “kill fees” for scrubbed articles routinely put freelancers in a bind, the data are undercounting and effectively excluding many who already struggled.

As early as mid-March, long before many major cities followed New York and Seattle into lockdowns, freelancers saw their lined-up interviews, previously accepted pitches, speaking engagements and editing opportunities suddenly canceled.

Taylor Crumpton, an Oakland-based freelance cultural journalist who has written for Paper Magazine, Pitchfork and many other outlets, was one of few to give a precise dollar amount: $2,000 in lost commissions through March 2020. As Crumpton explained further to Girls United, an Essence Magazine project providing mentoring and community for young Black women in digital spaces, simultaneously working as a social worker on the “front line…with homeless youth” was simply “frightening.”

She added: “The disheartening part of this is witnessing my counterparts lose 50–80% of their yearly income, so I’ve been uplifting their links to purchase products, or donate to PayPal, CashApp, and Venmo. Because of this pandemic, I lost a cover story with an artist who I’ve been working towards interviewing for years.”

Through early May, Crumpton added in a Twitter update, other opportunities evaporated, from co-hosting a podcast to multiple staff writer positions.

As Crumpton and others have pointed out as well, the disproportionate effects of COVID-19 on racial and ethnic minority groups in CDC data and in employment figures appear to be reflected in media-layoff patterns. Bianca Gracie, who left Billboard in April, frankly summarized the layoffs in her network on Twitter: “Woman, woman, Black person, woman, Latinx person, Black person, woman, another POC, Black person, Latinx person…the pattern is either coincidental or deliberate.”

Crumpton, Gracie, and their colleagues’ experiences speak to society’s digital superstructure, especially amid a global pandemic that precludes most in-person interaction. As E. Gabriella Coleman explained a decade ago in her survey of digital media ethnographies, the totality of our “digital age remains a powerful structuring emblem with material and cultural consequences” (490), including both its capacity to give voice to or further “marginalize groups,” in academia and in practice.

In other words—just like the wrenching, cyclical losses across America’s broader economy—the social, economic, and other costs of media’s implosion are not evenly distributed, but are weighted heavily against those already long excluded.

But what are the implications of these far-reaching changes for organizing efforts in media? And what particular, heightened challenges do they pose, especially now?

At unionized outlets, bargaining with executives over protections for fired, furloughed or otherwise affected workers continues. Both the BuzzFeed News and VICE Media unions, for example, have been engaged in discussions, while Wired, part of Conde Nast’s portfolio of outlets, is seeking union recognition. All three, among many others, have centered robust severance packages in their demands – vital financial safeguards for suddenly unemployed former colleagues, often living in some of the nation’s most-expensive cities.

At BuzzFeed News, the union’s overriding goal has been making any crisis-response decisions collectively and, most importantly, preventing any job losses, union members or not. One potential model for distributing costs while preserving employment sought by the BuzzFeed News Union is the modified “Work Sharing Program” at the recently recognized Los Angeles Times’ own newsroom guild. The Program, adopted at the start of May, implemented across-the-board pay cuts and hour reductions, but with a minimum 12-week ban on layoffs.

Crucially, the Program—whose name derives from the “Work Sharing Program” under California Unemployment Insurance laws, established in 1978—“allows eligible employees to receive unemployment benefits” while working reduced hours, subject to state approval. Although the Program’s legal requirements and applicability restrictions are extensive, it helps fill income gaps for individual workers while allowing the company to absorb lost advertising revenue.

Though union-led efforts are in flux, they offer some promise to their members and other workers at those outlets. For others working at non-union outlets and for freelancers, in particular, the challenges are even greater.

Some media freelancers may have access to membership in the IWW Freelance Journalists Union, from “journalists, writers, [and] editors” to “researchers, programmers and printers.” But IWW-FJU’s New York City membership criteria, for example, are limited to current industry workers. For those already laid off or who have worked more than a month in other sectors to make ends meet, may be ineligible to join, or, if they are already a member, “must transfer” their union membership, where possible.

Regardless of union affiliations or publishing platforms, freelancers face compounded frustrations that are all-too-familiar, but worse than before. These include challenged or reneged invoices, late payments, slashed budgets, and the logistical difficulties of simply doing their jobs—when they can—entirely remotely, without any meaningful separation from their commitments to family or roommates at home.

Nor are billionaire philanthropists and “impact” investors, like the high-profile owners of the Washington Post or L.A. Times, likely to save the day. Another billionaire-backed publication, the Atlantic, was reported to be joining the vast ranks of hobbled legacy media outlets. In total, 20% of all staff are being laid off at the magazine.

It would almost seem remarkable—except for its familiarity—that just last year, billionaire Laurene Powell Jobs, “the California-based widow of Apple founder Steve Jobs,” further consolidated financial ownership and control of the magazine through Emerson Collective, an “impact investing” LLC founded by Powell Jobs, POLITICO reported at the time. Powell Jobs herself wrote in the Atlantic about the values of journalism—a lifeblood of democracy—as well, aligning herself with journalists’ “struggle for the soul of this nation,” the “side of those who are fighting for the truth.” (Forbes estimates current Powell Jobs’ net worth is $19.5 billion.)

What’s left for solutions? Crowdfunding, like any number of fundraisers for furloughed and freelance workers or for state-specific media sectors, is heartening proof of media camaraderie and commitments to mutual support, but a limited source of relief given the extremity of losses.

For similar reasons, expanding subscription-based funding is unavailing at best in times of Great Depression-level unemployment – such individualized, voluntary forms of support simply lack necessary scale. Such “subscription-powered” media have been extended with some success to individual journalists and writers through newsletter-styled Substack, on Patreon, or other platforms. Unfortunately, as Forbes magazine recently explained, subscriber models, whether for media outlets or solo writers, “need a lot of name recognition” to work.

Given the enormous losses accelerated by the pandemic and less-than-promising options above, public efforts, coordinated and funded through the state, are likely necessary. This alternative is favored by the NewsGuild-CWA, America’s largest journalist union, which announced their Save The News initiative and related efforts “calling for federal, state, provincial, and local governments to provide public funds to sustain news operations.” As the NewsGuild explained, such efforts are “quite possibly the only way to ensure long-term viability for…news-gathering operations.”

Many individual outlets’ unions have signed on and Save The News has channeled petitions, letter campaigns, and social media support into generating public support and congressional action. In a promising sign, Congress seems to be heeding the call: multiple bills have been introduced to extend some forms of emergency assistance, especially for struggling local media.

Prospects for passing remain uncertain and, even if passed, myriad structural and financial challenges predating the pandemic will not be resolved. Much, much more will be necessary.

But there’s a start.

Black and Blue: What’s Causing America’s Bruise?

Discussions of police in everyday life have triggered strong reactions from citizens as long as we have had the concept of police. Arguments over whether they should wear uniforms, whether they should be paid, and whether they should carry weapons have all persisted throughout time and across multiple countries. The concept of the police in America was borrowed from the British system of having “beat cops” or officers who patrolled at the local level. In England, still today, these community officers do not carry weapons. The British police force was established in 1829 and employs the concept of police by consent, not by force. As a result, the general opinion is that arming the police sends the wrong message to citizens and creates more problems than it solves. Yet, in the US, officers cannot envision a police force that is not armed with firearms. Policing in America has evolved over time and developed into a punitive system of “enforcement” that has pushed the entire system away from community problem solvers and toward a militaristic mind set of reactions to certain situations, often without rational analysis of what is actually occurring. Thus, policing has evolved more toward fighting a war– the war on drugs, the war on poverty – in which police are the soldiers and citizens are the subjects. However, the evidence is clear that overuse of police as a form of social control has devastating consequences for the health of communities (Public Health Behind Bars, Robert Greifinger, 2007). Such over-policing leads directly and indirectly to destabilized communities and overall social injustice. Further, it creates a system in which activities of the poor and minorities are more highly policed and punished than activities of the wealthy or white majority. Communities that suffer the most from over-policing generally suffer from a host of other deprivations and become tangled in a web of instability. Once that occurs, perceptions of destabilized communities begin to shape the ways that people outside the community view persons who live in those communities. Persons from those communities are often portrayed as more violent, more aggressive, and less likely to respond to reason. These labels apply to everyone from that particular community, including children, and often follow those children as they enter school. Children from these communities are labeled trouble makers at very young ages (as young as 3 or 4) and are often pushed out of mainstream educational facilities. Because of interaction with the criminal justice systems, adults have trouble finding jobs and/or stable housing, and family dynamics are disrupted. A cycle of negative police/citizen interaction begins to occur because of overuse of punitive approaches to address social problems, and police officers are tasked with providing interventions across a wide array of social services more appropriate to social workers, school and marriage counselors, substance abuse counselors, soup kitchens and homeless shelters, and general mechanic and car maintenance.

When police are the first responders to social problems, punishment is the response most often handed down. Punishment, enforcement, and restraint are the skills for which police receive most of their training. Examples of this problem can be noted across the life span, but are perhaps most easily demonstrated in adolescents. For example, white youth and minority youth participate in delinquency such as recreational drug use, underage drinking, skipping school, fighting, and other types of delinquency at similar rates. Self-report studies indicate that delinquency is almost universal as a part of adolescent development. However, black and brown youth are held in juvenile detention centers at 3 to 4 times the rate of their white counterparts. Their numbers continue to increase even when juvenile crime statistics drop. Part of the reason for the disproportionate numbers of youth in juvenile detention stems from the presence of police officers in schools. Because these youth are identified as more dangerous and less amenable to treatment, school-based police officers respond with punitive practices that work to remove them from school. Once removed from school, the only real intervention at the community level is the juvenile court. Most black and brown youth live in urban areas with larger public schools. More police officers are assigned to these schools; therefore, more poor children and children of color are victims of overusing police and courts for behaviors more appropriately handled by schools and parents. Overuse of punitive practices creates a school to prison pipeline that suspends and expels more minority youth from school than their white counterparts. Even when youth are “caught” for the same activity, the minority youth is more likely to be arrested, petitioned to juvenile court, and detained in a detention center which sets off an array of negative interactions and social stigma that is almost impossible to overcome. The school to prison pipeline creates generational disenfranchisement, poverty, and systematic oppression of entire communities.

But problems in school are not the only contributor to the overuse of police in society. Lack of adequate health care also works to ensure that poor people and people of color will go to prison instead of to mental health clinics or rehabilitation centers for substance abuse and mental health issues. Instead of having diagnoses that are recognized and treated, even at very young ages, people without adequate health insurance or preventative health care are labeled by the symptoms of their illnesses. As services shrink in the community, law enforcement is used as the social service delivery system for this group. Instead of citizens receiving counseling and accurate mental health diagnosis that could treat their health issues, they are arrested, incarcerated, and offered very few if any services. For a drug charge, a person with insurance will likely go to a rehab facility. A person without insurance will likely go to prison. Studies indicate that 20% of jail inmates and 15% of prison inmates suffer from major depression or psychosis and as many as 87% of those have comorbid substance abuse issues. Citizens without insurance in our society are more likely to have unresolved trauma, which is often exacerbated by interaction with poorly trained police officers. Those same individuals are more likely to be perceived as dangerous, more aggressive, and not amenable to treatment. As a result, they are more likely to be arrested, more likely to be detained prior to trial, and more likely to be incarcerated. When they are eventually released (95% will return to communities) they are sent back to communities with little to no continuity care plan which almost insures that they will encounter the criminal justice system again.

So, what alternative police practices and systematic strategies could we envision that would work to dismantle this perpetual cycle of violence, trauma, and overall injustice that is levied disproportionately on poor and minority communities? First, I would propose that police agencies examine the role of police in everyday life and create policies that actually reflect those defined roles. The role of the police is “to protect and serve.” Let’s unpack that statement – to protect and serve – not to arrest, apprehend, serve as judge and juror, intimidate, harass, incarcerate, shoot, bully, or kill – protect and serve. Yet most of our emphasis in police departments across the US revolves around tactical weaponry, restraint techniques, defensive driving, and legal procedures of arrest that will lead to convictions. Perhaps refocusing training on de-escalation strategies, trauma informed care, and implicit bias could provide better understanding and more opportunities for officers to assist in resolving conflicts peacefully. Do police officers really need full armored SWAT gear? And military grade weaponry? When police posture defensively as if their role is to protect themselves against dangerous citizens (again as if they are soldiers and citizens are the subjects) the response from citizens is likely also to be defensive and reactionary. Beyond new recruits at the police academy, officers who have been on the force for long periods of time and serve as field training officers need the same training as new recruits on the above-mentioned issues. Many times, they work to undermine positive training received in police academies. If these more seasoned officers resist training, or refuse to comply with new protocols, they should be reassigned to departmental activities that do not require citizen interaction. We can no longer afford to have business as usual and rely on statements like, “that’s the way it has always been.” Agencies must be proactive in removing old ways of thinking and performing and replace them with more educated and better-informed practices that work to restore police-community relations. A merit system could be implemented that rewards positive behavior with pay incentives or merit toward promotions. Police should be treated as professionals, paid as professionals, and held accountable as professionals.

Secondly, I would propose that we examine the services for which police are being used in place of other, more appropriate social service delivery specialists. For example, commissioned law enforcement officers are not the proper authority to handle adolescents in schools – especially when dollars spent to employ the police could be redirected to employ social workers and counselors to address the underlying causes of much adolescent behavior. The experiment with School Resource Officers (SROs) was intended to create trust among students and police where police would function in a counselor/educator role. However, the reality has been that schools have turned over general disciplinary actions as well as drug/alcohol enforcement provisions to SROs. They do not work as much in an education/counselor capacity as they do as the enforcer for a host of school-based rule infractions that lead to more kids being suspended, expelled, or processed in juvenile court. Instead of fostering healthy relationships with police and students, students do not trust them and try to avoid them. A better alternative seems to be to employ a school based social worker at each school instead of an SRO. One argument for SROs has been the prevalence of school shootings and the need for student safety. However, school shootings were not the original intent of SROs, and school shootings remain very rare occurrences. When these tragedies do occur, it is rarely an SRO who protects students or who intervenes during these instances, which makes school safety concerns an inadequate argument for placing police officers in schools. Their presence adds to the school to prison pipeline and works to create hostility between youth and police very early in life.  Zero tolerance policies should be replaced with restorative community policies within schools to teach negotiation strategies that students could actually use in future interactions. Dialogue about complex issues should be encouraged among students and opportunities should be seized to provide education around community health, community harm, and community restoration.

This conversation would not be complete without recognizing that the work of policing a community is stressful. Rarely do police officers receive adequate training for the job. Even more rarely do they receive counseling and support for their own trauma that they experience on the job. For example, one of the most stressful parts of law enforcement jobs is not the hostage negotiation that ends in a shoot-out; instead, it is responding to traffic accidents. Officers might retire from the police force without ever using their firearm, but the chances of them viewing a dead child in an overturned car after a crash are high. When officers’ trauma is not addressed, that trauma becomes the lens through which everything else is viewed. A normal response is to have a heightened sense of self-preservation – and every possible encounter with a citizen presents the possibility of a negative outcome. Some of the resources within police departments should be reinvested in the officers to provide training, support, and counseling that they need to be healthy community members both on and off the job. To complement these resources, the culture within the department must also change to promote positive mental health among officers. Currently the stigma of mental health issues as signs of weakness permeate police culture. Changing those views will take time, but the culture of health that is discussed in communities must also apply to police agencies throughout the US.

Finally, and probably the most inflammatory part of this post, we must have honest conversations about the systematic racial oppression in the US and the role that all systems of government have played in developing and keeping it in place. Minority groups are presented as more dangerous, more violent, more in need of police, and only responsive to force. Such portrayals are not accidental, but work specifically to detract from empathy that might otherwise be shown to them as fellow human beings. The scourge of racism is so deeply engrained in our justice systems in the US that even minority officers do not know how to discuss it, react to it, or work to dismantle it. The militarized hierarchy within police agencies causes a veil of silence among officers who fear reprimand if they are perceived as trouble makers, liberals, or sympathizers. Citizens have so little trust in the police, or the system of justice, that they are often victims without a voice. These are not characteristics of a free society, and they must be replaced with conversation, understanding, and a shared vision for what citizens want the police to do in their communities and how that will be accomplished. In the end, police officers are public servants, and their role is to protect and serve the community and every member of the community. A Human Rights Perspective on Solutions to the Opioid Crisis in America

My most recent article described an overview of the opioid addiction crisis from a human rights perspective. You can view it here. In this article, I attempt to explain the different solutions from medical professionals regarding opioid addiction and the racial and economic disparities that have arisen amongst the most successful solution.

There are two forms of treatment that most clinics can decide between: traditional counseling therapy with a focus on mental strength or using medication, such as buprenorphine and methadone, to combat addiction. Research has proven that without medication, people are twice as likely to die from an overdose. However, the traditional counseling methods have persisted across treatment centers. The Journal of Substance Abuse conducted a study that showed that between 2003 and 2010, of 50,000 opioid addiction patients on Medicaid, patients who had received counseling therapies were six times more likely to relapse than those who received methadone as treatment and four times more likely than those who received buprenorphine. The risk of overdoses is increased during the period of detoxification utilized by abstinence based programs because of a lack of tolerance.

Opioid substitution has proven to reduce mortality. To avoid a misuse of buprenorphine and methadone, the two medications are tightly controlled by doctors. Buprenorphine is a drug that reduces the craving for opioids and reduces the chances of a fatal overdose overall. Suboxone, a compound of buprenorphine, is engineered to reduce the possibility of an overdose. However, using medication as treatment for addiction has only truly been utilized at a small number of walk-in clinics and has not been fully incorporated into the nation-wide health care system. In 2015, in the United States, 8-10% of treatment programs offered buprenorphine and methadone as substitution therapy. Even in this small number of programs, the method was often unsuccessful as the medicine was offered for too short of a period to be effective. The treatment is only provided in very regulated clinics and prescribers are limited to a maximum of 275 patients.

Between 2012 and 2015, the number of doctor visits where the health professional prescribed buprenorphine greatly rose. Despite this, a research report found that of 13.4 million medical cases involving buprenorphine, there was no increase in prescriptions written for minority groups. Dr. Pooja Lagisetty, one of the authors of the study, reported that white populations are nearly 35 times more likely to have buprenorphine discussed in their visit than black populations. Accessibility and insurance ability are commonly cited as reasons why this disparity has occurred, especially as the majority of white patients paid for their treatment using cash or insurance whereas only 25% of visits were covered by Medicare or Medicaid. This is especially concerning when it is taken into consideration that the rise in the use of buprenorphine occurred at the same time that opioid overdose related deaths were rising significantly faster for black populations than for whites.

In many cities, opioid addiction treatment is segregated by income. Lower income patients find themselves needing to attend a clinic in order to receive treatment while more affluent patients are able to avoid the clinic and instead receive treatment from a doctor’s office where medicines can be prescribed. These clinic programs are federally funded and often covered by Medicaid. However, in order to receive treatment from the highly regulated clinics, patients must visit daily. Many patients commute for hours every day before waiting within the clinic to receive their life-saving medication. These patients, who are already part of a lower income bracket, are losing precious hours where they could be working or with their families. Work, childcare, families, and other related life events must revolve around the daily trip to the clinic. Some patients have described needing to turn down job offers. Because of this, methadone has earned the nickname, “liquid handcuffs.”

In order to prescribe buprenorphine, physicians are required to undergo a special form of training. Only 5% of physicians have participated in this training. The shortage of clinicians has resulted in the ability of physicians to demand cash payments in return for a prescription of buprenorphine. 40% of white patients paid cash while 35% relied on private insurance. Just 25% of these visits were covered and paid for by Medicaid and Medicare. These percentages highlight just how costly a lifesaving prescription can be for people of low income. Because of the racial disparities within the United States economy, the people who fall into this category tend to be of a minority group. Gentrification has also caused a problem within the clinic community as their buildings get bought out in favor of other businesses. In 2016 in New York City, 53% of participants in methadone programs were Latino and 23% were black, while 21% were white. Also, in 2016 more than 13,600 people in New York filled at least one prescription for Suboxone with nearly 80% of these 13,600 paid for the medication using private insurance.

Buprenorphine was purposely introduced into a private market, intended only for those who could pay a high price. Therefore, the unequal distribution of the drug can be determined to be not accidental. Due to the government regulations surrounding the prescription of the drug and the training required for doctors, there are too few doctors actually allowed to prescribe the medication. Those who can often do not accept insurance for their services as demand is so high and they can make more of a profit. Insurance will pay for the actual drug, but patients must pay for the doctor out of pocket.

A permanent stigma surrounding methadone has developed, hailing from the War on Drugs days in the 1960s. Racially charged stereotypes regarding addiction have fueled this stigma which has in turn caused lawmakers to be reluctant in passing legislation that would make the drug more accessible to underprivileged populations. However, this would be the push the community desperately needs. Medicines like buprenorphine and methadone need to be significantly more accessible, both for patients and doctors alike. They need to be included in more clinics while therapy based solely on mental counseling should be phased out from the common addiction treatment centers. In order to close the racial and economic disparities within this crisis, it is important to first recognize them. Once that has been done, our communities need to take direct action that will result in a positive change.

A Human Rights Perspective on the Opioid Crisis in America

The opioid crisis in the United States is not something I often hear about in the news nowadays. Or maybe it is so often in the news that the title fades into the background amongst the news about politics. However, the opioid epidemic affects millions of people across the United States, and it has affected them for years. Human rights concerns connected to the epidemic have begun to grow in recent years as controversies regarding the United States health care system and law enforcement systems have come to light.

The crisis began with the expansion of opioids for medical purposes in the 1990s. The initial goal with opioids was to treat pain but the drugs soon became exploited by pharmaceutical companies eager to increase their profit revenue [1]. Before the addictive and harmful properties of opioids became known both to the public and to healthcare professionals, prescriptions for opioid medications increased rapidly across the country.

The introduction of extended-release oxycodone in 1996 along with claims by the manufacturers that it was less addictive and effective for up to 12 hours was a major catalyst for the epidemic. There are three described waves of opioid overdose deaths in the United States. The first wave began with an increase in the prescription of opioids, increasing since at least 1999. The second wave included overdose deaths involving heroin, the increase beginning in 2010. The third wave included an increase in overdose deaths involving synthetic opioids such as illicitly manufactured fentanyl (IMF) in 2013.

The first reaction to the opioid crisis was to limit the number of prescriptions in the market. However, this drove many to use the less expensive and more accessible street heroin. Cheaper and stronger opioids kept reappearing on the market, leading to an accelerated rate of fatal overdoses. Most addictions start with diverted supplies instead of among doctors’ patients. This was the case with heroin, which causes 4% of those who were using prescription opioids to switch to heroin. While 4% seems like a small percentage, 4% of the large number of people taking opioid pills is actually very large and enough to exacerbate the crisis [2]. In 2017, the United States Department of Health and Human Services declared a public health emergency. Over 130 people die every day from opioid-related overdoses and 10.3 million people in the United States misused prescription opioids in 2018. In 2017, more than 70,200 people died from drug overdoses. Of those 70,200, around 68% involved opioids.

White Americans make up roughly 80 percent of opioid overdose victims. The attention of the coverage of the opioid crisis has primarily centered on white Americans, pushing aside the attention on minorities affected by the crisis. Minorities made up 20 percent of opioid related deaths in July of 2019, but that number is growing. The crisis has highlighted the racial disparities in the US healthcare system as many experts believe that the number of opioid related deaths in minority populations would be greater if minorities had access to the same level of health care as white Americans. It is known that people of color have had a significant lack of access to the American healthcare system throughout history and throughout the recent years. This disparity lowers the probability that non-whites in American would be prescribed opioids and thus lowers the chance that the population would suffer fatal overdoses. Despite the low death rates due to the exclusions within the health care system, the abuse of opioids is still abundant in communities of color. Scientists have witnessed a doubling of overdose death rates among African Americans, a factor that is being overshadowed by the media and societal focus on the death rates of whites.

The law enforcement system has failed minorities in the opioid crisis as well. The War on Drugs, an attempt at cracking down on the opioid epidemic, has disproportionately affected African American communities across the United States. Studies have shown that law enforcement officials target black communities for drug violations significantly more than they target white communities. While drug use is similar between white communities and black communities, members of the black community are 13 times more likely to be arrested for buying and using drugs. In 2013, black and Hispanic populations represented 29 percent of the entire United States population. Despite this, the number of black and Hispanic prisoners arrested for drug related charges dominated that of whites. Not only is this true, but the United States Sentencing Commission also released a report stating that black prisoners receive longer sentences than white prisoners, despite both groups being convicted of similar weighted crimes.

The opioid crisis has hurt millions of people and families across the United States, one of the most diverse countries in the world. Despite this, the national attention has primarily focused on how the crisis has affected the white population. It is important to focus not only on how the opioid crisis has affected minorities, but also how the health care and law enforcement systems have responded to the opioid crisis in minority groups. The disparities within these systems must be fixed in order to provide an equal treatment of all groups.
